i.e. "I will not comment on what I said before."

So bad. And the governor gives the game away by saying she knows the AG will conduct a fact-finding investigation. With her conclusion already reached! What a brutal smackdown at a press conference.

I don't think this is really as bad as everyone is saying. Prosecutors often come to a set of facts with the initial belief that a crime has been committed and X was the perpetrator. It may not be best practice in terms of getting a credible investigative result, and it would be nice if prosecutors had a bit more humility, but structurally, the prosecutors's office (like the rest of the executive branch) is not a neutral or impartial participant in the process. They're just there to put people in jail (unless it's Philadelphia, I guess).

In the US, we have structural roadblocks to restrain prosecutors' expected bias against possibly innocent parties: grand juries, petit juries, and judges. Where this breaks down is "the process is the punishment," where prosecutors have enormous discretion to harass the targets of investigation before they hit any of these checkpoints. But that's an inherent problem with the discretion given to prosecutors, and the lack of outside oversight over their decisionmaking (and what outside oversight exists is usually just hacks looking at crude race metrics and complaining they indict too many non-Asian minorities). You can't really paper over that problem by asking prosecutors to *pretend* to be neutral in their public statements. And that's all it would be -- a pretense. I don't think anyone *really* thinks a special prosecutor appointed by the governor would be objective in this case. The whole point of looking again is exactly that political actors think the wrong result was reached the first time.

From reading Rod Dreher, the girl came back to her Dorm told her roomies she'd had a drug filled orgy at a Frat house, and then later went her University "Counselor" who told her rumors were circulating she was a "Slut".

The Frat house then disinvited her from a halloween party, "for her own good", and then that's when she filed charges.

Lots of men in a similar situation would've kept their mouths shut and certainly never would have raced off for a hand-holding session with their counselor to discuss their sex life.

Liberal/leftists with power and in the MSM really hate Frat boys. Whether its the Fake rape charges at Duke, or the fake U of VA story. At least this one actually had a rape victim who had sex.

If we don't expect the government to at least attempt to be fair, how can we say a fair trial is important? Open bias may be common, but it's a slippery slope, and we are at the bottom. If we don't object to it, people get railroaded, and that should not be OK. A lot of evil is perpetrated with the permission of "well, it's always been like that". Imagine hearing that if you are wrongly accused. Sometimes all we have is our voice.

Lawlessness is not a problem when you have no foundational belief in the Law.

You have people whose reasonings begin with the premise that equality is inherently unfair: there is always someone poorer, shorter, fatter, uglier, less talented, less skilled, etc etc; there is always a Man that was unfairly born a Woman.

For them, a government that doesn't try to equalize the outcome of such things is fascist; laws that don't seek such forced balance are illegitimate: above all else, it is Unfairness that should be illegal.

You cannot build a bridge to these people: they are over very different waters.

Not just the girl and the frat bros, but the press and the justice system.......The girl was probably right in the first place to not wish to press charges. She might be a victim, but not everyone will find her innocent. The men involved can never be considered completely innocent.......The network news has only reported on the facts that point towards the guilt of the frat members and not on those facts that caused the original DA not to press charges. Tilt......I think there's a significant portion of the population who do not think James is a fair minded person, and I don't think she will make any attempt to allay those concerns. Well, she's got a proven record of incompetence so the frat bros have that workiing for them.....Has anyone ever done a follow up story on that girl with the mattress? Whatever became of her?

Based on the girl's own texts and sworn statements contemporoneous to the events in question, no ethical prosecutor would bring this case to court or even a grand jury. The only rational conclusion here is that, at best, you bankrupt the defendants in defending themselves against this case for which the not guilty verdict should be a slam dunk decision- or you actually get a jury to convict them with no evidence actually supporting a guilty verdict (which is what I expect will happen given the jurisdiction).

MeToo is back. In Canada, allegations against Professor Steven Galloway started to get widespread attention in 2015 over actions that took place in 2010-11. He was about 35 in those earlier years, and had a long extra-marital relationship with a woman of about his age, i.e. not a kid. That somehow ended with hurt feelings. He liked to go out drinking with students. The words "assault" and "rape" started to get attached to the one original charge, with the sense that the University might do nothing about it. After years of Galloway suing various people to try to get his reputation back, Chelsea Rooney (about 5 years younger than Galloway) has settled her part of the lawsuit, which is finally supposed to go to trial this month. He's probably in the neighborhood of 50, Rooney in the neighborhood of 45. She has seen the light. She never questioned the word of the one original accuser, she did everything possible to broadcast all charges, and encourage women to come forward with any and every charge they could think of. She did everything she could to ensure any due process was violated in a way to hurt the professor, whom she now admits helped her career, asking nothing in return. An investigator in 2018 found no criminal activity, but something like poor judgment in a love affair. The U fired him, 8 years ago.

This is so wrongheaded. Prosecutors are of course supposed to be neutral and evenhanded in terms of investigating crimes and making charging decisions; and their job is not just to put people in jail: it's to sort out who's guilty and who's innocent and only put the guilty people in jail.

And what James did this is every bit as bad as it looks, not necessarily because she came into the case with a preconceived notion that the named individuals had probably committed rape, but because she PUBLICLY BRANDED them as guilty without giving them any due process, and before she conducted any investigation. The fact of her PUBLICLY condemning these men creates a conflict of interest, because now she has a personal interest in seeing that they are in fact found guilty. If she fails to achieve that result, she will likely suffer huge personal and career embarrassment and possibly have to face defamation claims and/or disciplinary charges.

If you think what she's done here is normal and expected behavior for a prosecutor, you're either being extremely obtuse or you have a very dangerous view of what our justice system should look like.

They cannot proceed unless they have probable cause to believe that a crime has been committed. Assumption of guilt is not something a prosecutor ought to be doing. She has to investigate and find a factual basis for a criminal charge.

We know James fucked up because she wiped away her Facebook post. Deleted it.

To me, her original statement is evidence of prosecutorial misconduct. Quite similar to her campaign promise to prosecute Donald Trump for crimes. Either Hochul yelled at her, or she figured it out on her own.

Her Facebook post was gross misconduct by a supposedly impartial (ha) prosecutor. And her deleting the post is evidence that the AG covers up misconduct by her and her office, when she notices it. She's trying to hide evidence that could be used against her in a judicial review.

It’s tempting to want to link child murders by mom to the Clancy phenomenon but the average number of children killed by their mother is approximately 15 a month (average might be higher)
There is no evidence that the Lindsay Clancy case has caused a measurable change in the rate of child murders by mothers.
