If there's a plea deal, it will likely be in the federal case, not the NY state case. There are two reasons.
First, if the federal case is resolved first bu a guilty plea deal to one or more counts of the indictment, the federal conviction would bar the NY case on double jeopardy grounds. NY has a more defense-friendly view of double jeopardy than the feds, in that NY rejects the 'dual sovereign' doctrine applicable in federal court. Thus, a prior conviction on a federal charge bars a subsequent NY trial for the same offense. In contrast, a prior NY conviction would not bar a subsequent federal trial for the same offense (because the charges were brought by separate 'sovereigns,' meaning NY and the US, each of which has a right to vindicate its own interest).
Second, there is no reasonable likelihood that Mangione will be acquitted in either case. Upon conviction, it is highly likely that Mangione will get a life sentence, and could end up with two if the NY case goes first. So, might as well get rid of the state case entirely, and end up serving the federal sentence in a federal facility. The federal facilities are a better place to serve a prison sentence.
It's not my life, but if I had his looks, I would rely on the jury and get as many women on it as possible, that with the justified anger at our health system could turn a juror. It only takes one.

Dolan, given your analysis of NYS double jeopardy, should Presidents start doing prophylactic convictions of their underlings, right before the prophylactic pardons? This would protect an e.g. Fauci just in case New York had a Republican DA and jury pool somewhere in the state. Or does the pardon nullify the double-jeopardy effect of the federal conviction? Plus the judge gets a vote.
