"Trump is the 47th president; '86' can mean banning or removing someone, but it can also be slang for killing a person. Comey quickly removed the post after receiving criticism that the phrase could be used to communicate the threat of violence."


Here's the post I wrote last year when Comey purported not to "realize some folks associate those numbers with violence": "James Comey purports not to have known that 86 means to get rid of (after he posted a picture of rocks in the form 8647 (47 being easily read as a reference to Trump)). Is Comey credible?"

The post title was a Grok prompt. Additional prompts: "Compare that to how Trump was treated for telling protesters on January 6th, 2021 to walk 'peacefully and patriotically' to the Capitol" and "I'm interested in the difference in seeing violence in words and consider that Comey, like Trump, has loyalists who might hear direction and take it."

8647 is by no stretch of the imagination a “true threat” outside of First Amendment protection.

This indictment, however, is a threat — a threat that the Trump Administration will bring frivolous indictments to attack enemies, including for rhetoric and criticism.

Comey had the political acumen to climb D.C.'s notorious "greased pole" to the top of the FBI. He had the political acumen to write and send contemporaneous documentation to himself (proving premeditation, and only done by those with legal experience). The FBI and other three-letter agencies expressly recruit those who are smart and clever and slick and slippery.

Comey knew exactly what "86 47" meant. I give him credit for being intelligent, and also for being a high-functioning psychopath. D.C.'s management class is packed with clinical psychopaths -- way more than anywhere else in the country. These are the "Deep State" players.

Still, this is a weak case and the process is the punishment. I figure that half of Trump 47's actions are meant to show that "he can play that game too" -- promising a future of tit-for-tat lawfare and passive aggression to match the Trump 45 and Biden kangaroo court eras.

1. Comey is a liar, he intended the posted image to convey the message "86 President Trump".
2. I have heard "deep six" used as a euphemism for "kill", but I've never heard "86" used to mean "kill".
3. I believe Comey intended the image to say "throw out" or "ban" President Trump.
4. Even if Comey intended the image to threaten the President's life, I don't see how that can be proven short of a confession.
5. And even if it's proven, I think it falls under the "true threats" exception laid out in Watts v. United States (1969).

Comey is a true dork. But the First Amendment still protects dorks.

But many of us have heard it used that way and it incredible that an FBI veteran who has listened to hours of mob wiretaps has not heard it used in this context. All it takes is one cooperative witness to establish such prior knowledge/use of the term. Discovery will be interesting!

Are the "seashell" charges the only charges in the indictment? Perhaps those charges were thrown in for statute of limitations purposes, as well as to force Comey to explain himself--and defend himself.
I'm not in favor of chickenshit indictments but if anyone deserves it it is Comey. Check with Roger Stone.

"86" is a restaurant reference, that you are out of food. "86 the lobster tail."

It doesn't mean shoot the lobster. It means strike it from the menu. So, metaphorically, it's a reference to getting rid of a president you don't like. There are multiple ways of doing this, including voting him out or impeaching his ass.

This is a ridiculous indictment. Trump is now following UK precedent and is looking for internet crimes that he can use to attack his enemies. It is utter bullshit and I am not impressed.

The point being it's not as important how the messaged was received by a variety of groups, but how Comey might plausibly explain the message in a way that doesn't wish the President severe harm.
