“When it came time for us to ask for a urinalysis test, he refused, and so he’s been charged with DUI, with property damage and refusal to submit to a lawful test in the crash."

Said Sheriff John Budensiek, quoted in "Tiger Woods’ mugshot released after his arrest/Golf player charged with driving under the influence after a crash near his home in Florida. Police said he appeared to be on 'some type of medication or drug'" (London Times).

That also shows Woods's mugshot from his 2017 arrest "after he was found asleep in his car blocking a stationary line of traffic with his engine running."

This time around, we're told, "Woods was not injured but was 'lethargic' on the scene and was alone in the car before he crawled out of the passenger door." And: "Under Florida law, he had to remain in jail for at least eight hours before being released on bond." That's harsh for such an eminent man. 8 hours!

Why does he go out driving alone? It must be very important to him to keep taking an obvious and known risk. Those who are failing to stop him share responsibility.

Yes, Tiger can certainly afford to be driven everywhere. OTOH, does this arrest really matter to him? How does it really affect his life? He's still rich, famous, and will be invited to golf tournaments.

He rolled over in news reports I read. That's much more serious.

I suppose Tiger likes the freedom and privacy involved in driving himself. IRC, the elderly William f. Buckley will all his money, and a servant who could drive, would often drive himself to various places - to chagrin of his son.

Yes, the laws around driving started the erosion of so many of our liberties. Decent people afraid of the new technology created this concept that driving is a privilege, not a right. And as a condition of the privilege, you submit to testing when asked.

Unless of course you're an illegal invader. Then we don't care if you even have a license, insurance, or any of the other things we require of citizens.

I don't know why there has never been a serious drivers-rights campaign, on par with gun rights or drug rights. You would think there's a huge base out there for it. CC, JSM

You can't be compelled to be a witness against yourself, but the broad reading of "witness" that you're thinking of has been rejected. Doesn't include peeing.

The trouble with good judgment is that people don't know when it's gone. His judgment wasn't there when he was cheating on his wife and she took a golf club to his car windows. That crash was back in 2009. He never recovered.

Under Florida law, by driving on public roads, you are deemed to have given implied consent to submit to a chemical test (typically breath, but also urine or blood in some cases) if a law enforcement officer has reasonable cause to believe you are driving under the influence of alcohol or drugs. This is governed primarily by Florida Statute § 316.1932.

All I can add to this is that I have driven on that road many times, I have friends who live very close to it, and have a condo, and the only challenge is to keep yourself from gawking at the homes. It's more fun though looking at the boats of these golfers from the water. Tiger's boat is pretty awesome.

Sad. Tiger broke his back, basically, and is on some pretty serious meds. If his off-course judgment was as good as it was on the links, he wouldn't be in this position today. That's the basic reason he doesn't hire a driver full-time or didn't say no to having it off with the neighbor girl or the waitress. It always catches up with you.

Just because you got away with it once doesn't mean you're protected by the fact that you're just that special.

Considering the importance of driving in today's world, not to mention the pleasure and freedom it provides, that seems like being forced into a contract under duress.

I was hit head on and nearly killed by a drunk driver when I was 19. My friend and I were driving back roads smoking a joint and drinking one 20oz. beer each. He was on the wrong side of the road. I was fine to drive, even stopped in time, but he didn't, because he was loaded. I think the DUI level of intoxication is set too low, or should dictate the level of punishment. The danger is the severely impaired, not the mildly, who drive better than someone who is tired or stupid. If you have a drink on the way home from work, you are not anywhere near the danger as someone who has been drinking to blindness all night, but the punishment is the same.

David Begley, a breathalyzer only detects alcohol. If they suspect some other substance (which they clearly do), need something different. Not sure if blood reveals less than urine, but if Woods refused a urine test, which is much less physically invasive, he surely would have declined the blood draw.

He was going to need to pee sooner or later, and then they would have it. They could also have waited for him to fall asleep, and put his hand in a bucket of warm water. That worked when I was in camp.

Not all drunk drivers are alike. There should be a proficiency exam to see the exact level of inebriation a particular individual can achieve, and still safely operate a motor vehicle. This should be stated on that person's license.

Full disclosure: I have never been cited for DUI, but.....

Perhaps he had illegal drugs in his system, heroin, fentanyl, something like that. Maybe he still has severe pain or maybe he' has a residual addiction to pain killing drugs. A drug test might have created worse problems for him than a DUI.

How do they administer a urine test. Do they take you to a hospital or collect it at the cop shop? I can't imagine they collect it on the side of the road.

I am guessing based on the sequence of events that he hadn't been drinking but was on something else, possibly painkillers. He was right to refuse the urinalysis.

I know exactly where the accident occurred. I often pass by on my morning walks.
On his wife's battery:
When the LEO investigated the incident, he asked Mrs. Woods how many times she had hit Tiger with the golf club. She replied, "I think maybe 5 or 6 times, but put me down for four."

I don't know about FL, but in many states you can refuse the breathalyzer/urinalysis/blood test but lose your license for a period of time (as I recall 6 months in CT). The rationale is that having a driver's license is a privilege, not a right, and the penalty is not criminal, so there is no Fifth Amendment issue.
Tiger probably called his lawyer who told him not to submit. His lawyer also probably told him--"You stupid bastard--you shouldn't be driving anywhere anyway."

His lawyer is going to say there was no proof Tiger was guilty of anything other than speeding. His attempt to over correct resulted in the accident. He appeared dazed and confused as anyone would after a rollover accident. He was not consuming alcohol as evidenced by his blowing a BAC of 0.00. He refused, as is his right, to submit to further testing.
