The Appeals Court ruled last night that I can use the National Guard to keep our cities, in this case Los Angeles, safe. If I didn’t send the Military into Los Angeles, that city would be burning to the ground right now. We saved L.A. Thank you for the Decision!!!
You never get to find out what would have happened if what was done had not been done. When do courts choose to stop a President and find out what the alternative would look like? Depends on the judges, but I tend to think they don't want to know. It's scary, and Trump is trying to scare them.

From what I understand, Judge Breyer had a 36 page Order written in less than a day.
That’s Althouse level speed!
The view from here:
I think the LAPD was bravely trying to deal with a situation about which its senior leadership had ambivalent feelings. If a trumpet give an uncertain sound who will gird himself for the battle? Trump's assertion of federal authority was timely and necessary to restore order in the streets. Gruesome Newsome appears to be a phony opportunist pushing a fantasy about what is happening outside his front door.
Just people having fun watching cars burn. And throwing rocks around.
Why would anyone think it could threaten the safety of the city?
I don’t know if he saved L.A., but the message is clear, the civil government in California doesn’t care if cars are burned, officers are pelted with rocks, stores are looted, or people can drive to work. They called it all peaceful, until someone tried to stop it.
Trump's probably right, though. If nobody can or will stop the rioters, they will be encouraged to go further. Then the state would have to send in the NG anyway, but more damage will have been done and maybe somebody is killed. That's something a judge should be afraid of.
Even Barney Fife knows that.
Judge Breyer had a 36 page order written long before today.
Things are scary because of Trump? She never sheds her fundamental libtardism.
Almost half a century of goverment union corruption and far left lunacy from the "entertainment " aristocracy have brought LA to this.
The question is: why do we want to save LA?
Trump did save LA, but not by sending in the National Guard.
Trump saved LA by ordering the DOJ to begin looking into the funding of the Democrat Party NGO's that organized the arson and riots: CHIRLA directly funding protestors, the SEIU union supplying the bodies, the Southern California chapter of the ACLU (providing free legal services for those arrested).
They immediately stood down the riots down once their funding was threatened.
Maybe thanking the Ninth Circuit is bad form and maybe it isn't but I kind of like the idea that Trump sent a fruit basket.
The left got all their Bs talking points out. ... to their ever shrinking loyalists.
Its nice Trump won. But this is another area that should be not be subject to judicial review. Whether the NG should be used is a decision for the duly elected POTUS. Not some obscure lawyer in black robes.
It's scary, and Trump is trying to scare them.
Oh deary me! Trump explaining reality to liberal judges is scaring the poor dears. The National Guard is trained and equipped by the federal government. They are there for federal use whenever they are needed. There are no legal nuances for judges — or retired law professors — to consider.
One interesting thing is all these District Judges when they overstep their authority and decide they are POTUS is they write 50, 75, 100 pages of bullshit justifying their decision. Almost none of which makes any real sense.
The problem is that none of this in Constitution. None of it is in the Law. And based on American history, its been newly invented by power-mad judges. Why people put up with it, I don't know. Maybe 'muricans are just dumb.

She’s referring to the Judges. She is actually mocking them for being scared of upholding the law. When she writes, Trump is trying to scare them, it is sarcasm negatively directed to these people who chose a job to protect the public. Why are judges scared of the National Guard? The Ninth Circuit was quick to slap down this judge. Ninth Circuit is many things but scared is not one of them.

There is no joy in shared responsibility without "benefits".
LA burned and burned again while Newsom fiddled and Bass strummed a DEIst cacophony.
You will never know if a decision you made is right or wrong because you can never know what would have happened if you had chosen differently.
To improve understanding (and grammar), I added an "s" to the word "judge" in "Depends on the judges, but I tend to think they don't want to know. It's scary, and Trump is trying to scare them."
My point is that judges — some more than others — are rightfully afraid to make decisions about life and death emergencies happening out in the real world. It's one thing to assess blame and calculate damages after the events are in the past. But it's different to tell the President that he must refrain from doing what he's decided he needs to do to protect the public from violence, here in America.
This is a standard conlaw topic. Judicial restraint, Youngstown Steel, etc etc.
My statement in the post is very condensed. I'm writing a blog not a book. But I mean what I'm saying.
civil government in California doesn’t care if cars are burned, officers are pelted with rocks, stores are looted, or people can drive to work
I disagree. The highest levels of government want it to happen. Expect it to happen. Have leadership roles in making it happen….
Some may have murder in their hearts for these district court judges.
I’d be interested in what’s taught about activist judges, ‘Hawaiian’ judges in current language. A very current topic I expect is actively ignored…

Back in high school, we had to take a test for some mandated reason. IIRC, it was a state requirement to see if we were able to test to grade. The teachers gave us sample questions that were multiple choice with 4 options.
I was working on the practice questions with another guy who was far smarter than me, and we were doing a math question that neither of us had seen before. We agreed one answer was wrong, and were going back and forth on two other answers that were similar. I asked him why he discounted the 4th one, which was a more complex equation that looked very impressive at first glance.
“No,” he said. “There’s too much shit in there.” At a meta level, that insight has served me well.
A judge in San Francisco might think LA was just getting what it deserves.

Yes. As always, follow the money.
Leftwing judges are just like the worms who appointed them.
Trump should declare California's nullification of immigration laws treason. The evasive schemes of its police departments and courts, its school districts and employers and literally every single government agency, should not be tolerated. Trump should seek Congressional authorization and, if he gets it, send in troops. California' defiance of the federal government must end.
I hate to break it to some of you guys but NG and USMC grunts aren't trained or prepared for urban warfare. They are young men 18-35 with no real training for civil unrest/riot situations and neither are their officers. Think of a Tim Walz but younger & with a rifle. That's what you have. It would better to just let it burn. They voted for this stuff, so let them have it.
The premise is unprovable either way. So it will 100% be labeled a lie by the Left. Don't worry, Deep State, all the NG and Marines are doing is guarding/encircling the exterior of Federal Buildings in LA. So far so good.
"I hate to break it to some of you guys but NG and USMC grunts aren't trained or prepared for urban warfare."
Irrelevant, since they're not being deployed to conduct urban warfare.
Soros and Biden should be brought up on charges for their illegal immigrant infiltration plan.
To the OP, this doesn't seem like a major "what if?" proposition. Isn't it kind of obvious that deployment of the NG (or any such force) would help prevent the rioting from getting out of control?
Of course one can not PROVE "Y" would happen if "X" did not occur. But..... History is instructive. We've seen "cooling off periods" to let rioters blow off steam. We've seen "defund the police and the after effects. We've seen Governors call in the National Guard AFTER the riots grew exponentially and then calm restored.
I can't prove to a flat earther (or a TDS sufferer) that the sun will set in the west tonight. Nor can I prove that early, and forceful, intervention isn't effective. But that's the way to bet.
"Saving LA"
Yeah but why?
Anyone keeping track of how many of these District Court “Judges” have been overturned to date?
“When do courts choose to stop a President and find out what the alternative would look like?”
Where does choice come into it? Aren’t the courts supposed to follow the law? “Following the law” appears to be another one of those civility bullshit items.
"Judge Breyer had a 36 page order written long before today...."
Well I would say it was that long, after all, he was careful to make a snotty reference or two in his injunction to the USA not being led by 'King Charles', just a couple of days before the coordinated, nationwide 'No Kings !' protests that are under-written by a Walmart trust-funder AWFL. My, what a coincidence, totally impartial and above politics, y'unnerstand.
I had a bit of fun last night contemplating what Gavin's next move was going to be, once he had control of the National Guard again. Comb your hair and pull on your big boy pants, Gavin. Do you send them home, and really show up Trump? How good is your communications network? The rioters don't seem to be following those 'peaceful' marching orders very well......
"Anyone keeping track of how many of these District Court “Judges” have been overturned to date? "
There are 91 federal judges. The Trump Administration has been sued 350 times so far.
Only 11 of those judges have been appointed to hear every single case against Trump and all were appointed by Democrats.
The judicial system in the United States is horribly corrupt and should be entirely replaced.
Ann, they were BURING CARS, ASSAULTING PEOPLE, LOOTING, ETC... and you think it would not become another Portland Antifa scene???? It had be stopped... and stopped fast least they barricade it and make it into Portland...
I'll retract, but not delete my comment, now that it has been clarified by the original author.

"Trump is trying to scare them." How much blood do they want on their hands? How many torched businesses?
Anyway, Trump is trying to check the prog checkers, to balance things just a bit.
Ninth Circuit is many things but scared is not one of them.
The district judge is The younger brother of Justice Breyer, both of whom were appointed by BillyBoy. Two of the 3 Ninth Circuit judges were appointed by Trump 45.
We’re not supposed to see things this way… but he got lucky with the composition of the appeals panel. I’ll bet that if the Marxist Ninth Circuit hears it en banc, OrangeHitler could well be forced to take it to the Supremes yet again.

"Thank you for the Decision!!!"
Thanking judges for being allowed to do the job? Worst dictator ever.
I suspect the real target and purpose of Trump's use of USC Title 10 was not so much specific to LA, but a 90 mph fastball under the chin to clearly collaborating activists in other cities, ahead of this weekend. FAFO, idiots.
And now he's got judicial affirmation of his right to do that.

Key quote:
"But Bill Essayli, Trump’s recently appointed U.S. attorney for the Central District of California, has come up with a way to compel California’s cooperation. Local officials can “ignore detainers, but they can’t ignore [federal criminal] warrants,” he told me in an interview.
So, in his first weeks in office, Essayli launched Operation Guardian Angel, a federal task force that is scanning criminal databases every day to identify illegal migrants arrested in the Los Angeles area, and then checking their fingerprints against immigration records to see whether they have previously been deported. If they have, Essayli charges them with illegal reentry, a federal crime, and obtains an arrest warrant from a federal judge, which cannot be ignored by sanctuary jurisdictions."
A few things there:
This template gets around NY's sanctuary policy.
It shows that nobody is being randomly deported, and in fact, the people being targeted are individuals previously deported for committing crimes in the US.
It is reminder that progressives are fighting for people harming Americans.
If judges had to take responsibility and the suffer the consequences of their rulings we would get a lot more common sense rulings. And probably quit a few not alive judges.
DSR: "NG and USMC grunts aren't trained or prepared for urban warfare."
I know you meant urban policing, but in either case, they are.
The Guard has civil disorder as one of its mission sets and does at least a couple hours of training on it each year. I believe the Cal Guard was brought out for at least some of the 2020 demonstrations.
Marines are interior guards for Naval property.
Guard and Marine units did plenty of what amounts to civil policing in IRQ and AFG. They had to distinguish between innocents and massively-destructive terrorists, and they were severely punished when they got it wrong (either by getting prosecuted for shooting the wrong people, or blown up for failing to shoot the right ones). In many cases they were advisors for indigenous police units. Time flies and servicemembers are young, so there may not be a lot of junior enlisted or company officers with direct experience, but the senior leaders remember and the units have institutional knowledge in SOP's and OPLANs.
There are plenty of good arguments against using the Guard or Marines for these riots, but lack of expertise is not one of them.
JSM
Perhaps the judges had to drive through the riots to get to the courthouse.
We found out in 2020 what would’ve happened during the BLM riots.
As Achilles points out we have ample evidence what happens if you don't act quickly in such situations. People may not have long memories but surely most of us remember as far back as 2020, right?
We do have several historical examples oif what happens when you DON'T call out the national guard, so I'd say Trump's on pretty solid ground here.
"You never get to find out what would have happened if what was done had not been done."
True, but past experience with Leftist riots gives us a good idea. They don't diminish and disappear on their own.
They immediately stood down the riots down once their funding was threatened.
They stood them down until tomorrow.
“We got lawyers too, bitch!”

Yancey: “… surely most of us remember as far back as 2020, right?“ Most of who aren’t Democrats remember.
It warmed my heart to see Sen. Alex Padilla (D-Denso) taken to the floor and placed in handcuffs. Good job, gentlemen!
The rule is this: no TRO absent the likelihood of Irreparable Harm if there is no TRO. So … deploying the National Guard for the purpose of PREVENTING harm to people and property is somehow likely to CAUSE irreparable harm. This takes Heckler’s Veto logic to new heights (or depths).
The Federal District Judges of 2025 are doing to their profession what Public Health Officials did to theirs in 2020.

What I find amazing is that five years later so many Public Health officials simply cannot grasp how far they’ve fallen in public esteem.

They're there to protect and safeguard federal facilities. Pretty sure they can handle that.

That shouldn't be a problem, the left insists nothing like that is happening.

Trump says a lot of things...
Interesting to read Trump's actual words on all this.
On the morning of June 12, Trump posted on social media:
“Our great Farmers and people in the Hotel and Leisure business have been stating that our very aggressive policy on immigration is taking very good, long time workers away from them, with those jobs being almost impossible to replace. In many cases the Criminals allowed into our Country by the VERY Stupid Biden Open Borders Policy are applying for those jobs. This is not good. We must protect our Farmers, but get the CRIMINALS OUT OF THE USA. Changes are coming!”
*****
On the afternoon of June 12, speaking to reporters, Trump said:
“Our farmers are being hurt badly by, you know, they have very good workers, they've worked for them for 20 years, they're not citizens, but they've turned out to be, you know, great. And we're going to have to do something about that. We can't take farmers and take all their people and send them back because they don't have maybe what they're supposed to have, maybe not. And you know what's going to happen and what is happening? They get rid of some of the people, because, you know, you go into a farm and you look and people don't, they've been there for 20, 25 years and they've worked great, and the owner of the farm loves them and everything else. And then you're supposed to throw them out, and you know what happens? They end up hiring the people, the criminals that have come in. The murderers from prisons and everything else. So we're gonna have an order on that pretty soon, I think. We can't do that to our farmers and leisure too, hotels. We're gonna have to use a lot of common sense on that.”
Where has Trump been for 80 years? Undocumented workers have settled in and the vast majority do great work.
I imagine the American Hotel and Lodging Association (AHLA), The American Farm Bureau Federation (AFBF), the National Roofing Contractors Association (NRCA) and the National Association of Home Builders (NAHB) probably got him on the phone and started the process of educating him.
People need to understand that the Judiciary, especially those appointed by Democrats, are completely political and are not - I repeat NOT - judging cases by the law and the constitution. Get that naive "After school special" "American Government 101" idea out of your head.
They are ruling based on their politics. And their personal preferences. We basically have 700 unelected, responsible to no one, Kings with unlimited power. Because the D's in Congress will refuse to hold them accountable. Unless, they rule in a Conservative way.
District courts overuling the POTUS is nowhere in the Constitution. Go read it. Congress is responsible for the number of appellete Courts, and their jurisdiction. This is the problem that must be solved. But of course the Right, wont solve it. They'll fantasize that somehow by doing nothing or complaining, the Left will change. And they wont.
I live in Los Angeles and have some expertise in the politics of the place. The extreme left is useful to Bass and Newsom and the other corruptocrats because they provide muscle backed by regiments of left wing lawyers.
After every riot, the lawyers sue for civil rights violations and the city pays big bucks to the brownshirts. The citizenry is basically the Eloi from HG Wells Time Machine, or perhaps more accurately the shmoos from Lil Abner. Corruption is widespread. This must end.

The Marines on the other hand are more than enough to stomp the crap out of the Democrats foreign invasion army.
And this little insurrection needs to be put down and the financiers need to be charged with sedition.
