I'm a little confused about your take on this, Professor. If the father filed an emergency petition, shouldn't that have been heard (as a legal matter)? Or is possession really 9/10 of the law?

They didn't need due process to invade our country, so I don't care that they have to leave with none. They don't belong here. Apply for due process from your home country, don't gum up OUR so called justice system for people who broke the rules to get here.
I hate these articles that refuse to name the Judge. Tell us who it is. Its not "A judge in LA" its "Judge X". But this is just more of the same.
This is what you get when you worship Judges and Lawyers. People have given them unlimited power and they're using it. Don't like it? Get Congress to do something. Or tell Trump to pull an Andrew Johnson.

rrsafety--nobody (as far as I can tell) is claiming that Mom wasn't properly deported. And nobody seems to dispute that the child is a US citizen (whether birthright of because Dad is a citizen isn't clear). It looks like the question of the appropriate treatment of the child wasn't addressed.
How much "light due process" is due? Trials? Appeals?
To me this looks more like a child custody issue. If Dad "should" have custody, presumably the US can ask Honduras to facilitate the return of its citizen. Maybe the child is also (by birth) a citizen of Honduras. Maybe the court will decide that it is in the best interest of the child to stay with the mother. As Breezy points out above, the child hasn't been "deported".
The father is also an illegal alien, and is going to be deported when found. As of now, he is avoiding ICE, and has appointed a non-relative guardian for the child to pursue his demands. I'm not sure what ICE is supposed to do when one custodial parent signs papers indicating the 2 year old should go with her back to Honduras, but the father, also subject to deportation, wants the child to somehow remain under sketchy circumstances. Most likely, this is the product of our foolish anchor-baby system, and an attempt for the family to remain. Since the baby is a citizen, the parents can always return her from Honduras to some custodian if that's what they really want...but it's not. They want to stay here.
Show me the Final Order of Deportation for the two-year old or it's just another international custody dispute that should be handled in the normal course of action.

Test question: is the child banned for a time from reentry to the US, as are other deported persons?
Test question: anytime a us citizen child leaves the US, is that a deportation?
Test question: Is the father legally (under US immigration law) prevented from going to Honduras, picking up the child, and bring him or her back to the US?

The child was sent with the mom. When did the Father attempt to stop his wife from being deported? Who did he file the appeal to?
Regardless, there is nothing unconstitutional about a mom refusing to be separated by her child. Based on the laws at the time, the child had the same rights of Elian Gonzalez, except this child can reenter the United States later, unless birthright citizenship is changed before then.
We should be deporting all the illegal anchor baby mothers/parents when they file for citizenship/birth certs. for their kids. Let them take their children back home.

You don't mention the citizenship of the father, probably because the lying liars who always lie at the NYT did not choose to dissemble on that particular topic.

Unless there was a deportation order, I don't see how the court has jurisdiction.
At the cabin, the farm, the hospital most recently, etc.
Parents sometimes leave their U.S. citizen child with a legal guardian, usually a family member, when the parents are deported, but rarely when the child is this young. If the mother wants to take the child with her and the father wants to leave the child with a guardian, I think few judges would rule for separating the child from the mother (and the father). If the father wasn't deportable, it would be a custody case, and the mother might still win.

No American 2 year old was ever deported. Mother, or father, or both may have been. And chose to take the child with them.

The child can re-enter the USA with her passport at any time, assuming she has one. There is a process to go through to get said passport and I highly doubt that it was done. And I note the statement was not “the father asserted, without evidence, that the child was a US citizen”
