Don't expect to see Inga here tonight.

Georgia’s law does NOT criminalize doing a D&C (nor does any other state law), especially when there is no detectable fetal heart rate (which there weren’t in this case).

GA’s law also allows for a D&C, even with a detectable heartbeat, to prevent the death or serious physical impairment of a pregnant woman. It prevents a D&C that has the sole intent of ending the life of a preborn human being."

“Thurman could have been cured with a D&C, or dilation and curettage, a procedure in which the cervix is dilated to create an opening through which instruments can be inserted to empty out the contents of a uterus. The procedure is a popular form of abortion, but it is also a routine part of miscarriage and other gynecological care. If the tissue was promptly removed, she probably would have been fine: a D&C requires no special equipment and takes only about 15 minutes.

But Georgia’s abortion ban outlawed the D&C procedure, making it a felony to perform except in cases of managing a “spontaneous” or “naturally occurring” miscarriage. Because Thurman had taken abortion pills, her miscarriage was illegal to treat. She suffered in a hospital bed for 20 hours, developing sepsis and beginning to experience organ failure. By the time the Georgia doctors were finally willing to treat her, it was too late.“

Thurman needed a dilation and curettage, or D&C, a procedure in which tissue is removed from inside the uterus. However, Georgia's ban considers a D&C a felony if performed outside of specific circumstances and could land doctors behind bars for up to 10 years.”

“It’s the combination of the vague wording and high personal stakes for the medical providers that create a situation where a patient like Thurman can fall through the cracks, said Greer Donley, an associate professor of law at the University of Pittsburgh who is a national expert on abortion.

“They’re afraid that if they act too quickly, they could lose their freedom, their vocation, everything – like the stakes are exceptionally high,” Donley said. “And so, you have to understand when you think about the vague laws, how you would act, how any rational person would act when those are the stakes of trying to understand vague laws.”

But she also said in Thurman’s case, the risk of prosecution would have been low since the fetus was deceased when Thurman arrived at the hospital. Doctors met at least twice to discuss whether to perform a D&C, according to ProPublica.

Still, Georgia’s law is not crystal clear on that point either, Donley said. The law says it is not an abortion to remove a dead fetus if the fetus died because of a spontaneous miscarriage.

“This just shows you the types of questions that have to be answered at the very outset, like whether it was an abortion at all, and then from there, the next question becomes, if it’s an abortion, at what point is her health in such great risk that the medical exception kicks in,” Donley said.

Still, Donley said, despite the ambiguity, it is clear that the doctors should have acted in Thurman’s situation.“

“Georgia’s committee has 32 regular members from a variety of backgrounds, including OB-GYNs, cardiologists, mental health care providers, a medical examiner, health policy experts, community advocates and others. This summer, the committee reviewed deaths through Fall 2022, but most states have not gotten that far.

After reviewing Thurman’s case, the committee highlighted Piedmont’s “lack of policies/procedures in place to evacuate uterus immediately” and recommended all hospitals implement policies “to treat a septic abortion on an ongoing basis.”

Piedmont did not have a policy to guide doctors on how to interpret the state abortion ban when Thurman arrived for care, according to two people with knowledge of internal conversations who were not authorized to speak publicly. In the months after she died, an internal task force of providers there created policies to educate staff on how to navigate the law, though they are not able to give legal advice, the sources said.“

Things l, however painful to contemplate, that need to be considered:

(1) Did the doctors deliberately allow Amber Nicole Thurman to die in the expectation, or at least hope, that her painful death would embarrass the legislature into repealing the law?

(2) We are told that her death was the consequence of a “rare” side effect. Precisely how rare is it?

(3) Related to the second point, death being a very serious side effect of Ms. Thurman’s abortion medication, was the decision to certify the drug for use the correct medical decision? Or was it merely a political decision, not justified by a proper evaluation of the medical risks?

Propublica refrained from clearly investigating and writing about the medical delay decisions -- not based on Georgia law nor, per courts, ignorance of it -- until long after the tragic death and the settlement compensation for medical malpractice had been resolved, with the accompanying non-disclosure. One hospital in question has quite a record of medical errors and fraud.

Do the victims of either case deserve excited Meryl Streep tears? Of course, but hundreds of thousands of other also do for horrific med-mal not related to abortion.

This was all -- all -- merely grim, exploitative theater. Both women who died had multiple places to go to receive timely, legally-informed medical care: Grady Hospital, Feminist Woman's Health Center, Planned Parenthood, multiple other clinics, all medically reputable, at least three undoubtedly known to them, or if not, a helpline or ten away. Tragically, neither their families nor they followed instructions to act quickly enough. And where the hell were the grown men who impregnated them? Absent.

Also, one patient likely should not have received that sort of abortion due to underlying conditions without competent medical oversight. Her body was also found to have fentanyl and other painkillers. Since it is alleged she was too ill to see a doctor, how did she acquire them? Were they prescribed? By whom? Why isn't any doctor charged with negligence there? So the medical board did not deem it an abortion complication death, and ProPublica, a political firm, wormholed all this crucial evidence.

Tragic and horrible? But not because of Georgia law. Democrat fear-mongering may have killed these women. But I frankly don't think that little of them -- I believe it is a narrative constructed after their deaths. I believe the lawyers, journalists, doctors, hospitals, and activists looking to exploit these cases or avoid professional consequences, are lying and concealing the real facts.

The absolutely worst, incompetent, non governing body of MAGAS in Congress probably in history, the get nothing done group has now revolted against the absolute worst nominee in history never to be elected again. House Republicans are overwhelmingly dismissing former President Trump’s calls for a government shutdown in the absence of a proof-of-citizenship voting bill being signed into law, a public break from the GOP presidential nominee in the lead-up to the November election.
A group of Republicans this week rejected a bill that combined a six-month continuing resolution (CR) with the Trump-backed voting bill, tanking the legislation in a move that thwarted Speaker Mike Johnson’s (R-La.) funding strategy.
Now, as the Speaker prepares to defy Trump’s wishes and stage a vote on a “clean” three-month stopgap, rank-and-file Republicans are expected to back it — balking at the former president’s request. Republicans almost universally support the voting bill, but they say pushing the issue so intensely that it results in a shutdown would backfire on the party.
