Trump paid it via Cohen, his lawyer, again completely legal and undisputed. It was listed as "legal expenses"- where in NY State law is it written that one can't list as "legal expenses" the payment of extortion and/or legal agreements of non-disclosure?
The only issues the witnesses for the prosecution should be testifying about is whether or not the facts above are, indeed, facts, and legal testimony demonstrating to the jury that, (1) labeling the payments as "legal expenses" is a false business entry and (2) they qualify as an undisclosed campaign expenditure under federal law. Any other witnesses should be limited to testimony in rebuttal to the defense's witnesses' testimony, which hasn't happened yet.
Pecker's testimony touches on exactly none of those issues- literally none of them. Any judge with a sense of fairness would have barred all of Pecker's testimony as prejudicial and irrelevant to the case. This is literally reversible error writ large. Politicians lie about their political opponents in every single election, and almost always done via campaign surrogates and supporters.

My understanding (she says tentatively - please correct me soundly as needed) is that the issue at hand is that the prosecution has to come up with The Felony in service of which The Misdemeanor (the ledger entry) was committed. And it has to be a state felony. And so after scouring the New York legal code, the prosecution came up with A Felony - it's apparently actually a misdemeanor but when you combine it with The Aforementioned Misdemeanor it is transformed into A Felony through legal alchemy - of conspiracy to influence an election, which evidently includes negative campaigning against your opponent. Pecker's testimony is being interpreted as his admitting having entered into a conspiracy with Trump to influence the election.
I am also given to understand that the statute of limitations on The Second Misdemeanor, now transmitted into A Felony, has also expired.
You know. Because it's Trump, and we're justified in cutting down every law in New York to get him. Nay, we're obliged to do so.

Just to reiterate because Drago keeps lying about me:
1. I do not support the lawfare against Trump. He is being victimized because of who he is which is a perversion of justice and represents several miles on the road to the destruction of the Republic. This is something I have said before. I hope he is acquitted across the board for no other reason than it would strike a blow against the two tiered justice system.
2. I have not and will not support a Democrat in any race in the election this year. I will vote for Republicans up and down the ballot except for the top line. I have voted for two Democrats involved in competitive races n my life. One Ed King for Governor of Massachusetts in 1978 because he was the conservative candidate. The second is that I voted for Ben Jones over Pat Swindell for the 4th Congressional district in Georgia in 1986 because I believed Swindell to be corrupt.
This does not mean that Trump is fit to hold the office because he is not.

Back in the day, the Enquirer was actually very reliable, unlike the other supermarket tabloids. The Star, Globe, Sun, etc., ran fake stories. These made impressive headlines, because if they were real they would have been important. ("Queen Will Abdicate", "Clintons Divorcing", "China Takes Over Disney")
The Enquirer didn't make stuff up. Instead they were very heavy on celebrity gossip, often tricked out with misleading but technically accurate headlines. Like "Action Star Jock Macho's Gay Sex Scandal!" - a martial-arts instructor he trained with years ago made a homosexual porn video.
The Enquirer even did some genuinely important investigative reporting. They exposed Sen. John Edwards and Jesse Jackson Sr. as baby daddies.
I believe it was when Cohen took over that the Enquirer went down the tubes.

~ Trump and Michael Cohen cooked up the fake scandals involving Cruz and Rubio. They supplied the fake stories to Pecker and the National Enquirer. As they supplied them, David Pecker knew perfectly well that he was being given fake stories as part of coordinated attacking by the Trump 2016 Campaign.
~ The Enquirer tarted up the stories, including faked pictures of Ted Cruz's father and Castro, and published them.
~ Not surprisingly, Cruz and Rubio each individually denied the stories, denounced them as fake, and counter-attacked Trump directly for having helped to inspire them with the National Enquirer. Go back and look at the reporting from that time; Cruz and Rubio were beside themselves with fury over the fake stories, and their language directed at Trump was righteously vicious.
~ For his part, at that time, Trump denied any involvement with the Enquirer. Trump made lots of public statements in which he acknowledged talking about the Enquirer stories but he denied any personal knowledge about how the stories were produced or reported. All of it lies, we now know.
~ Now, years later, we have Pecker's testimony under oath in the Trump trial. Cruz and Rubio have been proven to have been thoroughly correct in their denials of the phony stories. Trump is shown to have been instrumental in advancing the stories. And Trump lied about all of it at the time.
~ But last is the best part. Rubio and Cruz were asked by NBC to comment on the courtroom testimony. And that fact that years later, they were both proven to have been right in their suspicions about, and condemnations of, Trump. Fundamentally, it should have been a triumphant moment for Rubio and Cruz. But it wasn't. Both Rubio and Cruz ran away from NBC when they were asked to comment this week. They could both have said, "Yep, I was right. I told you so. You need to remember that." But of course they didn't say anything like that. They are way, way too deep in the Trumpist Cult of the Republican Party. So instead they dodged the NBC questions. It is frankly embarassing that they can't even face up to the obvious reality of this story. Even when they were spectacularly right and Trump was wrong.

You are yelling at me because you think I declined to resppond to a comment that you aimed at me in another post's comments page. In fact, I did respond, but my comment seems to have never made it through moderation. Which is ironically hilarious, because in my comment I suggested that instead of personal back-and-forth commentary (which I suggested that Althouse doesn't want), there be some other venue for personal arguments with me.
(I said that personal back-and-forth on the blog's comments pages had become dissatisfying to me because of the delay in seeing comments due to moderation. And indeed the fact that many of my comments myesteriously seem to never appear at all through moderation.)
