The failing wasn't mainly a cult of personality -- it was that the Democrats initiated court lawfare no later than the 1960s for the civil rights movement, which became obvious in 1973-1974 with Roe v. Wade and overturning the death penalty.

Those rulings precipitated (1) right-wing defensive lawfare per developing law schools to train future SC judges, and (2) the open politicization of the Supreme Court with the rejection of Robert Bork on ideological grounds and weird attacks on Clarence Thomas.

RBG was a Dem justice appointed after the Thomas episode...so her sycophants had descended into superficiality before she arrived. As always, pride goes before destruction. Those on the left who feel they've 'overcome' something are routine victims of their own pride.

This Josh Barro fellow is an asshole even if he makes good points. In a truly just society, Justices should be fair not because of their political appointments, but the left has made it clear Justice is based on political interest, which isn’t extraordinary in history. Indeed that it was ever not the case is extraordinary.

Also, if you believe as Barro does, that a cult of personality is bad, then why the hell do you support selecting justices by politics? Sotomayor should retire if she is no longer capable of doing the job. If she is retiring because Biden is in office now, but Democrats are currently losing in the polls because Biden is in office; then having Sotomayor retire because of Biden’s inability to win a second term seems a bit like of cult of personality for Biden. No, that’s not quite right either. Really, it is a cult of the left only which seeks power regardless of what it takes. So, if Sotomayor needs to go to retain the left’s power over her seat and you can’t get rid of Biden and Harris to secure a win in November, then she must go. Retire bitch, as Barro recalls.

Sotomayor should never have been a judge in the first place. And I don't mean a Supreme Court justice. I mean a judge in general. Her actions on the high court have done nothing but confirm this position.

That said, she's far better than Ketanji Brown Jackson, who does not fulfill the minimum requirements for a government official. Her argument that she does not want the First Amendment to restrict the government when that's the entire point of the First Amendment is an immediate disqualification.

The Democrats understand the SCOTUS is the key to Power in the Government. They are now going to decide if Trump goes to jail or not. Or whether the immigration laws can be enforced or not.

However, the SCOTUS doesn't spend $$. Which is all the GOP establishment and the sainted "Moderates" really care about. Hence, the passion gap on nominees. The Democrats in Congress scream abuse at the Rightwing judges and try to manipulate the Leftwing ones to leave or stay depending on the situation. While, the DC Republicans don't want to fight to get hard right judges confirmed.

I think it's a pretty big leap to attribute Ruth Bader Ginsburg's delay in retiring to a cult of personality. There are too many people in all three branches who have stay on too damn long. It's a phenomenon among members of the boomer generation to stay past the time when they should move out of the way and let the next generation have a shot. Not just government, either.

In the Olden Days, the Capitol Building (and the Supreme Court Building), and IN FACT;
EVERY building in Washington had Tall Majestic Stairs leading up and into the buildings.
IF you were to go in; you'd HAVE TO climb up those Tall Majestic Stairs.

Also, In the Olden Days..
Few politicians/judges/reporters/etc continued climbing those Tall Majestic Stairs in their old age.
They would decide to "retire from public office".. Why? was it the stairs?

The Supreme Court needs to step up its pace because leftwing maverick lower courts keep doing things that are beyond what should be acceptable. SCOTUS can't keep up because Congress is limiting its funds. The Democrats are counting on this. I don't think Roberts is up to changing processes fast enough to stop the crazy crap that Democrats are doing. If Roberts had any balls, he would start issuing things faster just to uphold SCOTUS's power.
