"Mr Biden's memory also appeared to have significant limitations...."
“He did not remember when he was Vice President... He did not remember, even within several years, when his son Beau died,”
There's no way a jury would convict an elderly man who clearly has almost no clue where he is. But yet we're supposed to believe that this same man is capable of serving as president for another term.
Also, the fact that his family continues to allow how him to be used like this is cruel beyond measure.
Justice with not a thumb on the scale but its entire fat ass sitting on it flicking off the other side with both middle fingers.
"a sympathetic, well-meaning elderly man with a poor memory"
This sounds like a perfect candidate for president of the United States.
Welcome to the loose standards of the Obama administration. Wave at Hillary as you pass by, Joe. What an effing joke. Trump had a right. Joe did not, but they won’t prosecute Joe because he is a senile old man. The ads are pre-written. Now the question, who is going to replace him? He is over.
'We conclude that the evidence does not establish Mr. Biden’s guilt beyond a reasonable doubt,” wrote [Robert K. Hur, the special counsel].
What he didn't say is that Joe Biden get the Democrat exception to the classified information handling laws.
I had S/TS/SAP clearances for decades. We had annual refresher classes on how to handle and safeguard classified information and the penalties for mishandling such information. Gross negligence is punishable with fines and prison time. Gross negligence is the deliberate disregard for protecting classified data. It's allowing CI to just sit around outside of an approved safe, so just anyone could see it. The was a case of sailor on a nuke boat taking a picture of his workstation and showing it to his girlfriend. Prosecuted and convicted.
Deliberately leaking it also punishable with fines and prison time, more so. Joe Biden left boxes of CI in his garage where his foreign agent son had access to it.
Democrats can never do anything wrong. Two-tier justice system.
The Department of Just Us reminds us once again that we are a nation of men, not of laws.
He stole some when he was a Senator from a skif YEARS ago. Anybody else would be in prison for THAT....
If they think this is going to help them, when all we see is a double standard, and the Left going after Trump, they have another thing coming. We aren't blind.
"as a sympathetic, well-meaning elderly man with a poor memory" - Just who I want as the president. We are such an unserious people.
Oh for f§s sake:
"Later in the report, the special counsel said that the president's memory was "worse" during their interview with him, compared to his memory in recorded conversations from 2017.
"He did not remember when he was vice president, forgetting on the first day of the interview when his term ended ('if it was 2013 — when did I stop being Vice President?'), and forgetting on the second day of the interview when his term began ('in 2009, am I still Vice President?')," the report said.
Biden also had difficulty remembering the timing of his son Beau's death, as well as a debate about Afghanistan."
And this is what the Americans have as president?
Some animals are more equal than others.
Remember when Hunter wrote that letter proffering his services to Burisma, in which the crackhead included many astute observations about the political situation in Ukraine, the kind of stuff that is often found in classified State Department documents, you know, the kinds of documents that Joe Biden, who, as Vice President, was in charge of Ukraine, Joe Biden kept in a cardboard box in the garage of the house where Hunter was staying.
Remember when the Penn-Biden Center, run by the current Secretary of State, Tony Blinken, who paid Joe Biden a million dollars for a no show teaching job, that same Penn-Biden center contained many classified documents, and that Chinese Nationals were, on Hunter Biden's request, provided with keys.
Oh yeah, the Penn-Biden Center was funded in large part by the Chinese.
But the prosecutor is probably right, no DC jury is going to find a Democrat guilty of any crime.
These are the times when I would be curious to see how the balance in someone's bank account changed this month.
Why is a man with no memory running for President?
He’s right. A DC or Delaware jury would acquit Biden if he lived long enough to stand trial.
But there’s enough to impeach & remove him from office.
'Mr. Biden would likely present himself to a jury, as he did during our interview with him, as a sympathetic, well-meaning elderly man with a poor memory,'
Who apparently is quite qualified to be the most powerful man on earth as President of the United States of America.
Eating your cake and having it too.
"... a jury was unlikely to convict Mr. Biden, given the fact that he had grown accustomed to legally retaining documents as vice president..."
Um, what authorization permits the VP to take classified documents out of the White House, even when he was serving as the Vice President?
It seems to me, Biden had grown accustomed to illegally retaining documents.
The two-tiered system of justice, gets another weight that yet again only goes on one of the scales.
Helluva defense! A jury would find him so confused he couldn't be held responsible for taking classified docs. FFS. But wait. There's more! He shared the classified documents with his biographer who, upon hearing Special Counsel was sniffing around, DELETED his copies. He won't be charged either. Meanwhile, the Puerto Rican cleaning guy at Mar-A-Lago is charged with FELONIES for moving boxes from one room to another. Didn't even open them. Didn't destroy 'em.
You leftists have no idea what shitstorm you are encouraging. Ya'll made Thomas break his 20-year vow of silence by bringing such a bone-head stupid case to the court and you're running a guy for president who can't even recall what year his son died or what year he left the VP office. And he's still talking to dead Euros today. Today!
Fuck. The world is finally seeing the shit the media has tried like hell to cover up.
Aren't people reading that wrong. Hur didn't say that Biden was "a sympathetic, well-meaning elderly man with a poor memory," but that Biden would "present" himself to a jury as such.
My early read is that Hur saw it as a front.
G. we are all so shocked.
Gee, who could have guessed this outcome? And of course, Trump's situation is entirely different, because...well, Trump.
So Biden gets a "Hillary"...
Now the SCOTUS is going to have to give Trump immunity or the whole executive branch is going to look like an asshole.
The campaign slogan has just been written - Biden '24 "a sympathetic, well-meaning elderly man with a poor memory"
VP doesn't have the authority to classify or de-classify docs; only the Pres does. Trump had it; Biden never did until Jan. 2021. If while still Pres Trump says roughly: all those boxes now in my possession, make sure they go to Florida; he has thereby, while still Pres, de-classified anything in the boxes that might be classified. Andy McCarthy's talk about some papers belonging to agencies is bullshit if the Pres has come into custody of the docs, i.e. he is not going to a different office to get them.
Ah the old Uncle Leo defense!
democrats are above the law.
Oh ok. That makes me feel better. All our secrets are safe because he can’t remember them…

From Special Counsel report:
"Biden would likely present himself to a jury, as in our interview, as a sympathetic, well-meaning, elderly man with poor memory ... It would be difficult to convince a jury to convict him ... of a felony requiring a mental state of willfulness."
Em-pathetic politics.
There’s no argument for prosecuting Trump on classified documents that doesn’t apply at least as strongly to Biden, even ignoring the fact that Trump had plenary power to declassify the documents he held, and Biden did not.
My conspiratorial side is telling me that this is the beginning of a 25th amendment action.
Also, obviously he wasn't senile when he committed the crimes outlined in the report. Does one age-out of accountability?
We are not going to indict Beiden because he looks like an old dumb fuck, but we are going to indict Trump because we are sure the jury will hate him, says the prosecutor.
"...as he did during our interview with him, as a sympathetic, well-meaning elderly man with a poor memory."
Yes, I will go through the 300+ pages of the report.
But that fragment of a sentence seems pretty damning.
Okay - not seems - IS damning.
Mr. Hur is more in need of an education in ethics than any white adjacent man in history, with apologies to Robin Williams.
I would take issue with the "well-meaning" part.

@DanODonnellShow
Holy living sh*t: Reading through the Special Counsel report and the main reason Biden will not face criminal charges is that HE IS TOO SENILE TO KNOW HE WAS HOLDING CLASSIFIED INFORMATION.
So I think Sandy Berger was caught stealing documents out of the national archives that incriminated the Clinton's and was not charged.
Obama kept secret documents after leaving office and was not charged with a crime.
Now we know as we did before that Biden left with secret official documents and was not charged with a crime.
But President Trump leaves with secret documents and it's now important not only that he is charged criminally but that we televise breaking into his home and arrange for all the media to be outside filming it?
And you wonder why people don't trust the government at all.
Totally fair and impartial. It's especially good if you can contrast the law-breaking behavior of the preferred party with someone who behaved worse. That's in the Constitution, I am pretty sure. The "Relative Unlikability Clause" for deciding whether to prosecute or not.
Gak!
"Equal justice under the law" is and always has been a pretty lie the government tells schoolchildren. It never has been true, and this is yet another example.
Gak!
"a sympathetic, well-meaning elderly man with a poor memory."
My view too. Why I'll only vote for him if another name on the ballot in November is Donald Trump.
My view of Trump is as an evil-intending, unstable elderly man with a poor memory who is a former office holder and former insurrectionist within the meaning of the Fourteenth Amendment.
I gather a majority of the USSC indicates they are not too concerned about that. The alternative would be unmanageable.
More unmanageable than the recent reinterpretation of the Second Amendment as applied to persons who are not members of a militia?
More unmanageable than the recent reinterpretation of the Fourteenth Amendment as applied to abortion rights?
"If his memory is shit, you must acquit"
"Mr. Hur said... a jury was unlikely to convict Mr. Biden, given the fact that he had grown accustomed to legally retaining documents as vice president....”
He broke the law so many times we can’t get a conviction?
“Mr. Hur cited Mr. Biden’s cooperation with investigators, in stark contrast with former President Donald J. Trump’s behavior when documents were discovered at his resort in Florida....”
Maybe this kind of crap has something to do with Trump’s attitude towards “investigators”.
Just how long do you leftists think a two-tiered justice system is going to last?
As Vice-President, Biden was entitled to keep none of those documents.
Babylon Bee headline: Man Ruled Too Senile To Stand Trial Still Fine To Run Country
'Mr. Biden would likely present himself to a jury, as he did during our interview with him, as a sympathetic, well-meaning elderly man with a poor memory,' Mr. Hur wrote."
Yeah. So was PolPot.
I guess they didn't investigate how much Joe collected from interested parties for the information he disclosed to them from these sensitive documents. I'll bet it was more than just "10% for the Big Guy."
This admission of Biden's willful behavior and the assessment of the mental health of the sitting President of the United States who is seemingly running for reelection, in conjunction with Trump's situation is nothing short of shocking. (Though, not surprising)
NYT has distorted the circumstances to protect their favorite elderly thief and grafter. The Post's coverage is far more truthful.
just to be clear:
IF you have NO authority to have classified docs (such as, because you're a VP, or a Senator)..
BUT! you are: a sympathetic, well-meaning elderly man with a poor memory
THEN! it's A OKAY!!!
BUT!
IF you're The Freaking President of the Freaking United States (THE Person that decides classification)
THEN; if you un-classify something.. YOU GO TO PRISON.. Because The Judge thinks you're mean
(or, the Judge didn't receive HIS payoff)????
Biden is America's Uncle Leo.
He's an old man
He's confused
How could you do this to him?
Hunter is coming to visit him today!

Always remember Whatever happens to you as you go through this life, there is a Seinfeld clip to provide, guidance, inspiration or perhaps just a chuckle.
Can we elect Jerry for president? The one from Seinfeld, not the one from Comedians in Cars getting coffee. That one is OK for VP maybe.
John Henry
rule of law is dead...
...and now we have Schrödinger's President- simultaneously a doddering old man who forgets stuff AND the effective leader of what was formerly known as the free world....
Biden: "I am a sympathetic, well-meaning elderly man with a poor memory ... vote for me."
So a President (Trump) is charged but a Senator, Biden at that time, is not....
And somehow Biden is senile but still president!!!
Only in America!
Gee--it's like some, but not all, Presidents have immunity. Who woulda thunk it?
Yep, this sort of decision where Ds escape but Rs are ensnared is certain to restore confidence that Lady Justice is blind in order to ensure that real justice is meted out to each person regardless of his or her station in life. Remember, no one is above the law.
"as a sympathetic, well-meaning elderly man with a poor memory"
Remember when Comey let Hillary off the hook, a former First Lady, US Senator, and Secretary of State confirmed by the Senate, because she didn't understand that she was breaking the law? She got let off not because she did not break the law, but for lack of mens rea, which was irrelevant to the way the law was written, since it did not require proof of intent for conviction?
"Come on guys! She's just a girl!"
The Department of Just Us. When they say "our democracy," they mean it the way the Mafia used the term La Cosa Nostra, "This thing of ours"
Then we can't forget that the Obama White House, in its final days, created the Cyber Threat Intelligence League, which trains sock puppets in pushing the DNC narrative on social media, you know, like blogs like this one. Keep that in mind as you read the comments.
Be proud, America. The elderly idiot Biden is POTATUS.
"If they think this is going to help them, when all we see is a double standard, and the Left going after Trump, they have another thing coming. We aren't *blind.*"
"The most important command of the Party was to ignore the evidence of your own eyes."
The above quote is from the "How To" manual 1984.
Well, that's damning with faint excuses. "He's too senile and old to charge."
I expect to see the mem if the elderly lady with the young woman with Biden in place of the old lady:
"I spoke to Ike last night."
"Sure, Mr. President, let's get you to bed."
The Cabinet and the DNC now have cover to remove Joe. Harris steps in as President and she runs in November. Her VP nominee will be Pete. Historic.
And 5 million illegal aliens will be voting in swing states. The Dems win TX. America is fucked.
We need to start thinking about secession. I'm serious. Conservative states cannot stand to allow this invasion of illegal aliens to continue.
This is insane.
He clearly took and possessed documents he wasn't allowed to take or keep.
Like Hillary destroying evidence subpoenaed by congress.
There is no accountability for democrats.
If Trump is elected, I want him to form a special task force within the DoJ to go over all of these crimes and find ways to indict, charge, and convict.
If they have any sense, all trials will be held in the panhandle of Idaho.
Liberalism is cancer.
I saw him spinning lies about the "unprovoked" invasion of Ukraine the other day, and I was actually pretty impressed, maybe he is a lot sharper than I think, keeping contradictory narratives in his head, and only speaking about the public one, but then I realized that they are probably drilling him in these responses, which are directly contrary to the actual facts of the situation, until he can't get them wrong. He probably believes the lies now.
In the old days, Joe was called the Gaffe-o-matic, because he had a hard time keeping his true agenda quiet, and publicly only talking about the false story that they were telling the American people. In a way now, I bet they think that this is a better situation. No more tension in the guy's head. No more announcing publicly that we would blow up Nordstream, with the German Chancellor at his side, and then having to pretend that he didn't mean it when Nordstream then got blown up. Better to just have him an empty vessel that can be programmed to say what he is supposed to say by repetition.
Grandpa Joe or Grifter Donny? It’s a shit menu but forced to make a choice, I’ll take senile and well meaning over demented and criminally inclined, any day of the week.
Oh yea, Hillary was a trained lawyer, and still the FBI let her off for not understanding that she was breaking the law.
And that's the best report that the special counsel could write in support of his decision.
Imagine how the first draft read.
Both the Biden case and the Trump case are bogus. Everybody at that level has "classified" documents at home, interesting only because they worked on them and not interesting to anybody else.
The hysteria started in order to lawfare Trump, but then Biden and Pence also turned out to have them. The problem is the hysteria, however, not the documents.
He didn't know what year his son died!!!
He didn't know what years he was VP!!!
Even idiot lefties cannot defend him now.
I think this was released now to get him out of the race.
Force him to resign or go full 25th amendment...
I guess we’re all waiting for a naked Slow Joe Biden - wearing only a shower cap - to walk down Pennsylvania Ave..
"well meaning" old man. Since when? He's ALWAYS been a bully.
Nary a peep about the 25th amendment being used to put the old mook out to pasture.
Wow, the NYT really buried the lede.
Biden was let off because he could not remember when he was Vice-President or when his son, Beau, died. We all know he is senile, including our enemies. I thought he was senile when he debated Paul Ryan in 2012.
The chef’s kiss in all this is Biden instigated the Mar-a-Lago raid. He did that not remembering or not caring that he had the same legal jeopardy. But he’s D, so nothing bad could happen, right?
As far as I know, being a feeble old man now doesn't mean you can't be tried for committing a crime when you were cogent.
Trump's first act should be to arrest Biden and try him, even in DC or Delaware if necessary.
Make his spend some of his Ukraine blood money on lawyers.
Best case he spends the rest of his days in prison.
As the libs say, "No one is above the law."
P.S.
You know this is the way to force him out as it wasn't released on Friday...
""The special counsel investigating President Biden said in a report released on Thursday that he had decided not to seek prosecution of Mr. Biden over his handling of classified material after leaving the vice presidency in early 2017, but had found evidence that Mr. Biden willfully retained and disclosed some sensitive material.... 'We conclude that the evidence does not establish Mr. Biden’s guilt beyond a reasonable doubt,” wrote [Robert K. Hur, the special counsel]. Mr. Hur cited Mr. Biden’s cooperation with investigators, in stark contrast with former President Donald J. Trump’s behavior when documents were discovered at his resort in Florida...."
From "Special Counsel Seeks No Criminal Charges in Biden’s Classified Records Case/The inquiry found that the president had willfully retained material after finishing his term as vice president and had shared sensitive information with a ghostwriter" (NYT).
"Mr. Hur said... a jury was unlikely to convict Mr. Biden, given the fact that he had grown accustomed to legally retaining documents as vice president.."
Which is it? Mr. Biden "willfully retained material after finishing his term as vice president" [which as VP he was not entitled to do], or was he "accustomed to legally retaining documents as vice president" when, as I understand it, he wasn't allowed to retain them, much less share them with someone not cleared to review them?
Mr. Hur cited Mr. Biden’s cooperation with investigators,
Of course. Play nice they’ll let you get away with stuff. Stand up for your rights and they’ll throw the book at you.
“He did not remember when he was Vice President... He did not remember, even within several years, when his son Beau died,”
Democrats have a lot to answer for.
These episodes remind me of my liberal friend who told me he voted for Biden over Trump because of "competence".
I'd wonder what he's thinking now, but he gets his news from NPR, so he'll be shielded from this.
Democrats think that they can abort the baby, cannibalize her profitable parts, sequester her carbon pollutants, and have her, too. They're right... I mean, moderately left.
Well, that's damning with faint excuses. "He's too senile and old to charge."
I expect to see the mem if the elderly lady with the young woman with Biden in place of the old lady:
"I spoke to Ike last night."
"Sure, Mr. President, let's get you to bed."
Is lack of memory an element of the crime?
Reminds me of that old Steve Martin bit about not paying taxes: “I forgot!”
"No reasonable prosecutor..."
At least this guy has the actual authority to make this call, unlike the rabid never-Trump former FBI director who was not authorized to make the decision to let Hillary skate...
Same as it ever was...
But is Biden viable? The Democratic Choice... uh, choice, depends on that answer.
To abort or not to abort is the question.
"No more announcing publicly that we would blow up Nordstream, with the German Chancellor at his side, …"
That really happened?
Wow. I tend to be cynical about most defendants' "I don't recall" responses in depositions, but the details of Biden's inability to recall much of the events of the last 15 years, even his own son's death, sure resonate with what we've been seeing in his handful of public appearances lately. What is a 25th Amendment for, if not this situation?
DC jury also awarded Michael Mann a million dollars. Seems fitting for the justice system we have right now.
This will be tolerable if and only if the prosecution against Trump is dropped. They can even drop a few nasty comments in their dismissal, but if they decide to go ahead and prosecute then that will be perceived as a much bigger crime than the pirating of some classified documents. I know Biden is an addled old man but what excuse does the prosecutor have. You can only circumvent ethics so far before you start talking out of your ass.
I’m only guessing, but perhaps the plan is to get him through the election, somehow, and then, soon after he takes office, he’ll resign for unspecified “medical” reasons. That’s the only way Kamala is ever getting into the White House.
As another former member of the TS\SCI codeword SCIF dwelling community, I have no doubt that had I accidentally removed a single page of classified material from said facility I would have lost my job and possibly done some time. This stuff is really irritating to most of us.
They just keep telling us that we are peons, and that there are two sets of laws.
Or what Leland said.

At least you tried.
I stopped watching the US Kevin Spacey version of House of Cards (which was marvellously acted and produced) because I thought it was too cynical; every character with a tiny shred of decency was destroyed and only the evil bastards triumphed.
I was wrong. It was a cleaned-up version of DC politics.

Seemed to be on drugs, giggling ,a lot. Ryan looked as if he could not believe Biden's behavior.
Joe Biden has been running for president for over 40 years. He isn't leaving voluntarily. The 25th Amendment is a more difficult process than impeachment.
In other words he isn't leaving, he will not be forced out, and the only other way for "the shadowy cabal" that all speculate about is what I won't mention because, yeah - that would be so not awesome for the country.
Jim at: "Just how long do you leftists think a two-tiered justice system is going to last?"
The Old Soviets lasted (officially) from 1922 to 1991.
The New Soviet Democraticals and their LLR lap poodles no doubt believe they can pull it off for much longer.
Just add Biden's mishandling of classified docs to the impeachment articles. Willful release of classified data to his son and others. Prison time and mighty fines.
Hur is channeling Jim Comey: "Sure. Hillary broke the law with her email server, but no jury would convict her, she wasn't negligent enough."
Hur: "Sure. Biden broke the law by storing the documents in his garage and elsewhere, but no jury would convict him, he is too old and doddering."
"The law is for thee, not for me." Democrats hate Trump and Republicans so much they can't see that our country is losing the rule of law to the rule of men.
"We conclude that the evidence does not establish Mr. Biden’s guilt beyond a reasonable doubt ...."
The business of Democrat prosecutors and their consorts when investigating Democrats is not probable cause, but second guessing juries.
I remember an old old post about Germany sending the now 90 year old secretary of a concentration camp to prison. I remember comments like, well, she new what she was doing when she was 18 years old didn't she!
We always refuse to charge mob hitmen after they exceed 80 years old.
"Wull, Beiden was not a nazi secretary or a hit man!!, OK then only sentence him to 6 months.
All our secrets are safe because he can’t remember them…
I get the sarcasm, but i believe the suggestion actually presented is that Biden can’t remember who he told the secrets to and if he actually told them. Helps when the person who he likely told deletes evidence.
*if* SNL was funny..
They would this saturday redo the senile Ronald Reagan/President Reagan, Mastermind skit.
But, OF Course.. SNL is NOT funny
Special Counsel Hur was a Rehnquist clerk and a Trump AUSA. Kinda seems like he's trying to cover his backside when people complain about not bringing charges.

But he did not disclose and volunteer all the classified materials he had. Some were found only after federal investigation.
I'm a professional statistician, perhaps we chould count up the number of times special counsels have indicted Democrats vs Republicans. Give the numbers and I can do a T Test.
"Did that happen?"
He didn't actually use the words "blow up," he just said that we would end it and didn't give a crap about the fact that it was under German control.
"If Russia invades, that means tanks or troops crossing the ... border of Ukraine again, then there will be ... no longer a Nord Stream 2. We, we will bring an end to it," Biden said. Asked how, given the project is in German control, Biden said: "I promise you, we'll be able to do it." - Reuters
"We conclude that the evidence does not establish Mr. Biden’s guilt beyond a reasonable doubt ..."
I admit I didn't read it, but I am sure that they explained what the "reasonable doubt" was, or was it pretty much that he is a doddering old fool, and no DC Jury would convict him.
Apparently the death of Beau Biden, that Joe seems to raise on every occasion where is expected to show empathy, is none of our damn business after all.

So Rich,, THE US JUSTICE SYSTEM IS RUN BY WHO WAS WHO AND THE PALS I HAVE!!!!
That is a great this for ordinary citizens to know RITCH!!
Thanks, tim.
So what are we seeing here? If you're of the right ethnicity or immigration status, you can steal, rob, rape, murder or deal drugs, and the prosecutors in major cities will let you off with no jail time.
Or if you're a Democrat politician, the Justice Department never seems to decide to prosecute you for your many crimes.
But if you're an ordinary white middle class American, or you're a Republican politician, given the slightest opportunity, the government comes down on you with both feet.
This does not seem a recipe for long-term success.
Biden's 2024 campaign slogan, stolen from Bullwinkle: "I'm SO confuuuuuuused!!!"
Fuck the criminals in our justice system. And that is exactly what they are. All they are doing is pissing off regular hard working Americans who know that they will NEVER get a fair trial if they are accused by any progressive in this country. EVER.

It’s weird to for the DOJ to come this conclusion unless Biden’s lawyers made this argument. The DOJ starts with the presumption that there was a crime and it’s going to prosecuted and the opposing lawyer raises arguments as to why that reasoning is flawed. Biden has to work in concert with his lawyers to support these arguments (hey dude, we’re making the claim you can’t remember, so, don’t remember.).
If these aren’t the arguments Biden’s lawyers raised, the DOJ then came to an independent conclusion that Biden is incompetent to stand trial. That assertion deserves a hearing, especially if Biden is publicly denying the claim. In fact, now that Biden has publicly denied the DOJ’s claim, their only reason to not charge him has evaporated. All they have to do is show Biden’s public remarks saying he can remember to refute any defense argument as to sympathy and competency.
Of course, the fix was in and none of what I just said actually matters.
There is the US Medical Center for Federal Prisoners.
