Here's the order of discipline from the Colorado Supreme Court, issuing a public censure to Trump attorney Jenna Ellis (Jenna Ellis Esq.!), for her misrepresentations in the course of representing Trump. STIPULATION TO DISCIPLINE PURSUANT TO C.R.C.P. 242.19.

Now this might not be any big deal normally; she's a lightweight (I had not realized until reading the Stipulation that she never actually appeared in court, anywhere, from Trump) and this is penny-ante stuff in the world of Trump legal depravity. But you gotta love the 10 bullet-pointed specifications of Ellis Esq's misrepresentations:

~ November 13, 2020: Respondent claimed that "Hillary Clinton still has not conceded the 2016 election."

~ November 20, 2020: Respondent appeared on Mornings with Maria on Fox Business and stated: "We have affidavits from witnesses, we have voter intimidation, we have the ballots that were manipulated, we have all kinds of statistics that show that this was a coordinated effort in all of these states to transfer votes either from Trump to Biden, to manipulate the ballots, to count them in secret ... "

~ November 20, 2020: Respondent appeared on Spicer & Co. and stated: "with all those states [Nevada, Michigan, Pennsylvania, Wisconsin, Georgia] combined we know that the election was stolen from President Trump and we can prove that."

~ November 21, 2020: Respondent stated on Twitter under her handle @JennaEllisEsq.: "... SECOND, we will present testimonial and other evidence IN COURT to show how this election was STOLEN!"

~ November 23, 2020: Respondent appeared on The Ari Melber Show on MSNBC and stated: "The election was stolen and Trump won by a landslide."

~ November 30, 2020: Respondent appeared on Mornings with Maria on Fox Business and stated: "President Trump is right that there was widespread fraud in this election, we have at least six states that were corrupted, if not more, through their voting systems .... We know that President Trump won in a landslide." She also stated that "The outcome of this election is actually fraudulent it's wrong, and we understand than when we subtract all the illegal ballots, you can see that President Trump actually won in a landslide."

~ December 3, 2020: Respondent appeared on Mornings with Maria on Fox Business and stated: "The outcome of this election is actually fraudulent it's wrong, and we understand than when we subtract all the illegal ballots, you can see that President Trump actually won in a landslide."

~December 5, 2020: Respondent appeared on Justice with Judge Jeanine on Fox News and stated "We have over 500,000 votes [in Arizona] that were cast illegally ... "

~ December 15, 2020: Respondent appeared on Greg Kelly Reports on Newsmax and stated "The proper and true victor, which is Donald Trump ... "

~ December 22, 2020, Respondent stated on Twitter, through her handle @JennaEllisEsq, "I spent an hour with @DanCaplis for an in-depth discussion about President @realDonaldTrump's fight for election integrity, the overwhelming evidence proving this was stolen, and why fact-finding and truth-not politics-matters!"


I want to single out just one of these misrepresentations. November 23, 2020. Ellis Esq's appearance on Ari Melber's MSNBC program. Her appearance was such classic Trumpdom; she argued with Ari, talked over him, wouldn't stop talking, serving up such a blizzard of lies that no one could actually keep up. Here is that video. I warn you; you won't be able to take much more than about 90 seconds of it. I just wanted you to have the full MAGA flavor. You won't miss much if you tune out quickly.

Can anyone understand Egyptian 1000 thread count bed sheets??

My wife recently started complaining that her bedsheets were threadbare. She purchased Egyptian 1000 thread count bed sheets for herself, and the loofah bedsheets for me. That 1000 thread count bedsheet is marketing bullshit. The sheets felt thread-bare when they arrived. Women love to pay extra for less.

Loofah bedsheets??.......you know, they remove the dead skin while you sleep.

Her choice: litigate the issues against the state in a hostile jurisdiction or pay $224 in “costs”? Ellis should feel lucky, Chansley got 41 months in DC.

June 30, 2021) (radio statement about a judge, along with other misconduct, warranted suspension); State ex rel. Couns. for Discipline ofNebraska Supreme Ct. v. Gast, 296 Neb. 687, 707-09, 896 N.W.2d 583, 597-98 (2017) (suspension for dishonest public statements and attempts to influence a judge); In re Disciplinary Proc. My Amish friends repeatedly travel to Mexico for health care. They travel from NW PA to New Mexico via train/ bus and then are met at the border by clinic representatives who drive them directly to the clinic. They have stayed up in Mexico for up to two weeks.

Former Trump official Ken Cuccinelli has launched a super PAC backing Florida Gov. Ron DeSantis.

Cuccinelli was once a close aide to former President Donald Trump. He is now calling DeSantis the "strongest Republican" candidate the GOP has for 2024.

Ken Cuccinelli, was acting deputy secretary of Homeland Security from 2019 to 2021. He pushed hardline immigration policies under the Trump administration, and now has praised DeSantis for rolling out more restrictions on undocumented immigrants from Mexico.

Maybe "Trump's wall" will finally be built. But not by Trump.

Think about the precedent set by the Colorado Supreme Court. The effect on free speech is way worse than the alleged underlying conduct by Ellis. State bar overseers are now some kind of supreme talk show moderators?

It's as if the state of Colorado is implicitly saying "don't worry, this case is only a one-off, because it's targeted against Trump."

Emphasis added. You say that, like it's a bad thing.

Slightly more seriously; this was not simply public speech by the Respondent. It was speech in the course of representation, even though she had not appeared as litigation counsel.

And, it was speech that harmed a legal public interest; the public confidence in elections. So you inadvertently touched on the other half of what I found so interesting and newsworthy. Ellis Esq's speech was (1) false and misleading, BY HER OWN STIPULATION. And it was (2) also harmful to the public interest. AGAIN, per Ellis Esq's OWN STIPULATION.

If in the future another Colorado attorney (a) makes major, repeated public misrepresentations (b) in the course of professional representation of a client (c) which seriously injures the public interest or some other legal proceeding... then, hell yes that Colorado attorney can expect to get a bar grievance. That attorney will be afforded what Ellis Esq was afforded, but chose to decline. A full hearing, with her own counsel to represent her and the ability to cross-examine opposing witnesses and to present witnesses of her own ; a presumption of innocence with the burden of proof on the Complainant; and a standard of proof on the Complainant of "clear and convincing" evidence.

So, no; I'm not concerned at all about any chilling of free speech by Colorado lawyers.
