"Trump Takes the Fifth Amendment in New York Deposition."

The NYT reports.
The former president invoked his right against self-incrimination during a deposition that the New York attorney general’s office had hoped would be a turning point in a civil investigation into his business practices....
Trump is no stranger to facing questions under oath, having once boasted that he has sat for “over 100″ depositions.” And until now, he rarely passes up an opportunity to answer questions — or spar with his questioners. He once told a lawyer that her questions were “very stupid.” And one of the lawyers who questioned him said Trump is, “completely fearless in a deposition.”...

Trump said:  “I have absolutely no choice because the current Administration and many prosecutors in this Country have lost all moral and ethical bounds of decency.... Under the advice of my counsel and for all of the above reasons, I declined to answer the questions under the rights and privileges afforded to every citizen under the United States Constitution.”

This old clip of Trump in 2016 is getting a lot of play on Twitter right now:

Good for him. Just another show trial by the progressives who are afraid of him, because he was trying to root out their corruption. Al Sharpton is walking free. After all of HIS problems paying rents and tax bills, should they go after him?? Or is he on the right team, so he can do and say whatever he wants?? This is why America doesn't trust ANY of them. They are running political witchhunts against anybody who isn't progressive enough for them, and doesn't think and say exactly what they are supposed to. When will Nasty Nancy, the Insider Trader get this treatment??

And unlike a criminal prosecution, in a civil case you can use an invocation of the Fifth against the defendant. The jury will know and be free to conclude that he broke the law. Not a great week for Trump, but I'm sure his donations are up.

So will the DemoncRATic prosecutors now tell the jury that’s absolute proof of his guilt?

Let’s face it, it’s not past them to totally destroy the Constitution to get Trump. They’ve already lied to the courts without consequence, committed perjury before Congress without consequence, convinced or coerced media into censorship to get him and support his political opponents. Seems there’s no downside for them.

Yet.

In California, there is statutory protection for party that invokes fifth amendment in civil discovery. Although still the problem that you would be precluded from trying to turn around and testify for yourself at civil trial. But I think NY hews to older common law rule on allowing factfinder to know and adverse inferences to be argued for.

It does seem this man's powerful political opponents are using the Govt to disqualify this man by whatever means necessary. We know the FBI lied to the courts to get a FISA warrant and spied on his campaign. We know the justice department and congress spent 3 1/2 years 'investigating' a lie against him. Why should we believe they're being honest and above board on this? We just can't.

No, no, no! You destroy the Constitution in order to save the Constitution. Getting rid of one's political enemies is the way you save it - the means. Once the political enemy is gone, you put the Constitution back where it was before you broke it, and all is well again.

LilyBart said...

What do you think changed since then? he addressed this:

“I once asked ‘if you’re innocent, why are you taking the Fifth Amendment?’ Now I know the answer to that question,” Trump said in the statement. “When your family, your company, and all the people in your orbit have become targets of an unfounded, politically motivated Witch Hunt supported by lawyers, prosecutors, and the Fake News Media, you have no choice.”

Trump took documents that were declassified and released to the public. Then he returned them to the archives and allowed investigators to go through them for retrieval.

Hillary took NOFORN and TS/SCI materials off of SIPR and other classified networks, put them on her personal computer, emailed them to various non-secured receivers, then deleted them during the investigation.

Every single leftist here knows they are lying thru their teeth and.....that's the very point.

They know they are lying.
We know they are lying.
They know we know they are lying.
And they know that right now they hold all the levers of power and can enforce their lies as truth and paint truth as lies...and they've got "judges" and "juries" lined up to make it all happen.

That's precisely what they love most about this.

87,000 new IRS agents are going to be kept quite busy as the lefties in govt have databases across different federal agencies cross-referenced to identify Trump donors, gun owners, school board reform candidates, etc for Tea Party treatment. The FBI is demanding local sheriff's offices provide detailed lists of gun owners in their areas. CA "accidentally" leaked detailed info on all gun owners in the state....except for the criminals. Those guys are fully protected in CA.

And the lefties will lie about it happening right up to the point where they not only admit that its happening but that its always been happening and that its always been justified.

Which is precisely the same talking point evolution followed with the spying on Trump, creation of the hoax dossier, weaponization of the fed agencies for Russia Russia Russia collusion, etc.

Because Trump had the power to declassify absolutely anything when in office, and for all we know, he did. Yet to be determined, of course.

As Secretary of State, Hillary did not have that power. She could declassify nothing.

And it wasn't just the classification of the Hillary documents, but where they were shoddily and amateurishly stored, and how they got there over the supposed 'air gap.'

The Japanese are lost in their submarine off the coast of California. Their ship's compass is broke. They go ashore and take a lumberjack prisoner. Aboard the ship they discover he is in possession of a small Cracker Jack compass. The lumberjack grabs the compass and swallows it. So, the Japanese force him drink prune juice.

Cut to the next scene and they have the guy tied up sitting on the toilet, and the first line he says to the Japanese is "You ain't gettin' shit out of me!"

That's Trump in NYC today. It's why we love the guy.

Taking the Fifth is often because the person taking it is guilty. Perhaps not guilty of the particular charge before the court, but guilty of something. I would say this happens the majority of the time.

Taking the Fifth is sometimes taken because the target gains nothing by cooperating. It is not unheard of for a person to be innocent but the truth to make it seem like the person is guilty because the full context is missing.

Taking the Fifth is completely justified when you have reason to believe that the investigation is politically motivated. These is rarely ever a good reason to cooperate with someone out to get you and does not give a damn about the truth.

Pfizer continues to push the vax, which at this point is like pushing a 1996 flu vax.

"Admitting that Trump is guilty of more than one thing is a good start."

That's exactly how the prosecutors think. First they start with the assumption of guilt, then they comb through the testimony to try to create a process crime on theories every bit as outlandish as gadfly's.

Here is a ZeroHedge story about how the FBI planted a spy in Trump's organization over the Presidential Records Act. Also, all of these demands that Trump "show us the warrant if he's innocent!" Well the factual basis for the warrant is under seal and he is not allowed to see it. The story is a pretty good summary of what happened.

https://www.zerohedge.com/political/trumps-reveal-how-fbi-raid-went-down-former-prez-suggests-planted-evidence

There is also an old story in the Miami Herald about the Epstein case, and it turns out that the magistrate who signed off on the warrant had rented office space and created a company *In Epstein's building,* He did this *prior to quitting* as a US attorney on the case, and started representing targets of the investigation *the day after* he quit as US Attorney. He managed some pretty sweet immunity deals for some pretty awful human traffickers.

Sorry if I am repeating stuff that's been said, but I don't think that I can stomach the dishonesty from the usual suspects who know that this was a setup and an abuse of power, but like it because, right now, they have control of the secret police.

Speaking for myself, a Republican voter, I didn't think Bill Clinton was a bad President, but when I learned that the President of the US had committed outright perjury, I became a supporter of impeachment, and to this day I think the failure to remove him from office is a blot on our government.
But it gets worse. Ms. Clinton didn't just violate some technical rules about using the internet as Sec.State. She used her status as Sec.State to advance her personal interests and those of her suppoters, and then had her own lawyers wipe out the evidence. Everyone who pays attention knows that, right?
So is Trump a victim of unfair attacks by the Democrats, the Deep State, the Establishment? OF COURSE HE IS! The question for us is: What do we do about that?
In my opinion, Trump started the country on a lot of productive directions, and those projections need to be resumed by the next Republican President: Lower taxes, reformed regulations, less militaristic foreign policy.
But Trump isn't the one to do this, because he would be too involved in defending his own conduct and record. And frankly, he's not really very good at it.
Right now, I think DeSantis is the one to do this, but my mind is open to alternatve canditates.

Trump had a point when he said "They are really after you. I'm just in the way."

Merick Garland and Christopher Wray (not to mention red faced John Brennan and Clapper) have created a deep state security force with all the worst features of the Gestapo and the Stasi combined. Fortunately so far (or at least I think so far) the have not added features from Papa Doc Duvaliers Ton Ton Macoutes--otherwise there'd be a lot of bodies in the street.

My money is on Joe Biden declaring a health 'emergency' prior to the election and suspending fraud protections that the states have put in place as a last desperate attempt to avoid oversight.

My money is on a nationwide injunction, that gets appealed up to SCOTUS, which says "no, you can't change the election rules right before an election"

As Option 2 is a whole bunch of dead people as righties decide to block the vote fraud by an means necessary, I consider it highly likely SCOTUS will go with Option 1.

Esp given the way they've ruled this year on every single gerrymandering lawsuit

As stupid as his cultists?

The stupidest person on this blog is YOU, who still believe the propaganda the progressives and the media spewed to you. Look in the mirror to see the biggest fool of them all.

Unhunh. She'd be the one loading the train. "Prisoner! Face forward! A step to the left or a step to the right and you will be shot!" She's orgasm over power like that.

To quote from everyone's favorite Reich Minister:

[Sympathetic hand on arm] Congratulations, jim5301, the first step is admitting that you have a problem.

I would absolutely treat any 'civil' complaint brought against me by a government official as a criminal complaint, and respond accordingly. And so would every lefty jackwagon commenting here. No, I don't care at all that Trump said stupid things in the past. I'm glad he's finally saying something not stupid.

Well the factual basis for the warrant is under seal and he is not allowed to see it. The story is a pretty good summary of what happened.

I see what you did there! Go ahead and pretend the factual basis for the warrant and the actual warrant is the same thing.

Like I said to Michael K. How stupid do you think I am?

Freder Frederson said...

Freder is sure that the FBI raid was not to look for whistle blower evidence.

No, you offered a bet that the FBI was looking for whistle blower evidence. I said I was willing to take the bet.

And now you are backing off the bet.

But it gets worse. Ms. Clinton didn't just violate some technical rules about using the internet as Sec.State. She used her status as Sec.State to advance her personal interests and those of her suppoters, and then had her own lawyers wipe out the evidence. Everyone who pays attention knows that, right?

And the exact same thing could be said about Trump (assuming he was too stupid or arrogant to bother to declassify the documents he took). And why the fuck did Jared Kushner and Ivanka Trump have jobs in the White House?

Cult 45 in here are grasping at straws trying to quell their cognitive dissonance.
Maybe the latest Q drip, breitbart or OAN broadcast has the answer; something, something…….nothing to see here; the left rapes babies.
