"President Trump was not the first Presidential candidate who declared himself cheated out of victory."

"Andrew Jackson, for instance, strongly believed that the 1824 election had been stolen from him because powerful forces refused to accept his candidacy on behalf of the common man. Richard Nixon believed in 1960 that he had been cheated out of the Presidency by widespread voter fraud in Illinois, which he thought secured John F. Kennedy’s victory. And in 2000, Vice President Al Gore and many of his political supporters thought he would have won the Presidency had all of Florida’s votes been properly counted. Yet despite their feelings of grievance, all of these Presidential candidates accepted the election results and acquiesced to the peaceful transfer of power required by the Constitution. President Trump, alone in our Nation’s history, did not." 


What is the significance of this historical record? That there's a tradition of accepting what you believe is abuse, of not speaking about it and rallying supporters? But after Trump won in 2016, there was vigorous speech about the illegitimacy of the election. Is it just that these other candidates "acquiesced to the peaceful transfer of power"? But Trump acquiesced. He left on schedule. He just talked belligerently and had lots of adherents who believed him.

What is the House Managers' point in recounting this history? This section of the memo (at page 44) just concludes that his belief that he won is "no defense at all for abuse of office." Fine, but even if his belief is not a defense against a charge of abuse, is his belief itself an abuse of office? Is his speech about his belief an abuse of office? 

The question is whether he intended to incite the crowd to commit acts of violence. We care about his state of mind. What does his belief that he won have to do with any of that? The memo just moves on to the next issue. I suppose one might say that Trump's assertion that he's the rightful winner was an essential part of the motivation to attack the Capitol, but that doesn't mean that the assertion alone is a call to attack the Capitol.

The latter three certainly didn't stop claiming the election was stolen, and Jackson and Nixon continued to run for president afterwards. None of the three ever conceded they lost a fair election. Hell, even Kerry thinks he won Ohio in 2004. Trump pressed his claims until the last possible moment, doing nothing different from what Gore did.

Several days after the election I sent out the following email to friends, some of whom still remain friends though it took work, asking if the current mess wasn't the fault of Richard Nixon for failing to contest the 1960 election.

"Those of you who are as old as I am may remember the 1960 presidential election. Highly credible allegations of voter fraud were made about Chicago, where democratic mayor Richard Daley ran a tight political machine, and in Texas where Kennedy’s running mate Senator Lyndon Johnson had extensive clout. Johnson had previously been credibly suspected of voter fraud in his initial election as Senator. Together Illinois and Texas gave Kennedy a solid majority in the Electoral College. He would have lost without those two states.

Nixon did not concede the night of the election when it became obvious he did not have the required votes, although he did announce 3 days later that he would not contest the election. My memory is that he said that he did not think the country should suffer from a contested election. I recall thinking at the time that this was both a generous and patriotic act.

Now I am not so certain.

What does seem clear is that, at the moment is that elections in the United States are not transparent, and millions of people – regardless of the outcome – will think that this election was stolen. Which is a shame, regardless of your party affiliation. And there is no reason a better system could not be devised, if the country had the will to do so. For those of you on the left who don’t think that the suspicions on the right are justified, then perhaps you are getting your news from too narrow a range of opinion. Should current results be overturned by the courts, well, it is obvious what the complaints of the left will be, and they will be somewhat understandable. Regardless of what the true legitimate vote was (and I don’t claim to know), this didn’t have to happen and the country needs a better way. Perhaps it is Richard Nixon’s fault. Perhaps if he had contested that election, we would have long ago moved to a system where trust in election outcomes would be higher.

That Special Counsel, Robert "The FBI Whitewasher" Mueller, staffed his team with Trump-hating lawyers and Trump-hating FBI officials.

Mueller and his team then tried for years to entrap Trump relatives, associates and supporters in process crimes that could be used to pressure them to snitch or to compose accusations against President Trump.

Herein lies three problems. First, Trump is not the president. Second he cannot be removed from office and therefore not prevented from holding subsequent office since these two are joined by the comma and word "and" meaning they are each part of the same penalty. Three: The chief justice is not presiding; an absolute requirement for an impeachment trial as denoted by the word "shall".

The language clearly means that many members of congress are themselves in violation of their oaths of office. Not one of the 70 or so individuals who stormed into the Kavanaugh hearing are in jail, despite disrupting official government business. How can anyone take this as anything other than abuse of power?

Plus CBS is said to have fiddled the framing and focus of the camera-work at the Debate to the great advantage of JFK. I would think all the calls for protests over the summer to protest the federal government, including the efforts to provide space to destroy, was a more obvious attempt at insurrection than Trump's claim that he won if not for a rigged election.

I read the Brief by the House Managers as mostly, these are things different when Trump does them, because nearly all of it I can find an example of a Democrat doing far worse in the past year.

One of the big differences was the political distance between Nixon and Kennedy wasn’t that wide. Both were anti-communist.

But in 2020 we witnessed a coordinated effort between modern day communists and totalitarians to get the outsider [Trump] out of office no matter the cost. They started by shutting down the economy via COVID in Blues States. They uses COVID to increase fraud-ripe mail in voting. Our courts (Wisconsin) even refused to clean up voter rolls do dead people could vote.

State Legislature voting laws were ignored our outright broken in places like Madison, WI where ballot harvesting and the destruction of ballot chain of custody was done right out in the open.

In my opinion a person's true state of mind is something other people can never truly know for certain (unless and until we develop mind reading technology or something anyway). We can only really judge a person by what they said and did.

Is it possible that Trump wanted a violent insurection? Sure. But lots of things are possible. Is it likely that Trump wanted violent insurrection? Well, what did he do and say in the months and weeks and days leading up to January 6th? Did he ever openly and clearly ask or encourage his supporters to commit actual violence? Did he personally take specific actions to bring about what happened? I'm not talking about actions that could perhaps be interpreted subjectively to lead to the violence, but actual clear and unequivocal actions that can't really be interpreted any other way.

It seems to me at worst that there's much more of a case for negligence than anything deliberate or planned. And if so... if you could persuasively make such the argument that Trump was negligent, that he should have known that this sort of thing could happen, that might disqualify Trump in the minds of many of his supporters for any future attempts at the Presidency.

But the problem for pretty much everyone whose been trying to make the argument that Trump shouldn't ever be allowed to become president again is that they've shown themselves to be dishonest, hypocritical, and corrupt for at least the past 4 years. They're proven that they're bad faith actors over and over again. And as such, few actual Trump supporters will ever listen to their arguments no matter what they say.

So ultimately it doesn't matter if some point could be made that Trump was negligent if the people making the argument appear to be far worse than negligent in the eyes of Trump's supporters. So this whole show trial seems unlikely to separate Trump from his supporters and far more likely to anneal his supporters to him even further. There's no trust here. There's no honest attempt at finding any good and fair solution. We're only left with anger and revenge.

Right on the money Glenn. I don’t think that was so much the motivation of the swamp creatures in on the fraud, but I’ve believed this is basically Althouse’s motivation post-election. Especially the Texas lawsuit with received the tag “lawsuits I hope will fail”.

In places like Madison, Wisconsin (America’s #1 place to retire, but not to be a ballerina) this would be an earth shattering reality, and the destruction of a community’s world view. They only perceive themselves from within. Any REAL concern for anyone or any culture other than their own is destructive to their superiority complex. It’s why they are so skilled at using Milwaukee’s inner city minorities for their own political comfort.

In Sicknick's case, it's still not known publicly what caused him to collapse the night of the insurrection. Findings from a medical examiner's review have not yet been released and authorities have not made any announcements about that ongoing process.

According to one law enforcement official, medical examiners did not find signs that the officer sustained any blunt force trauma, so investigators believe that early reports that he was fatally struck by a fire extinguisher are not true.

This puts the vote count into play in the trial. We can finally examine what happened with witnesses and evidence and cross examination. Bring it on!

Democrats don’t want us looking into an election that they assured us, along with Google, Facebook, and Twitter was totally above board with “robust” protections for mail in voting, such as oversight of ballot canvassing by both parties and signature matching (both of which never happened in the hotly contested precincts)

Just check the “yup I’m a citizen” box and voila, instant Democrat. Then to ensure lotsa fraud we do not remove people from a county when they relocate, we simply add another ballot to their mailer. For our final act we allow activists to “harvest” votes from people who would otherwise sit or sleep (coma patients welcome here) through elections. So we get a lot of ballots amassing at certain addresses just waiting for bundlers to come “harvest” them. You actually have to appear in most county registrar offices to get your old address OFF voter rolls if you change counties in between elections. Death is also not enough to trigger the registrar, unless you show them the cert in person in San Bernardino County (largest county in lower 48).

What's interesting in these discussions for me is that people who are certain there was no cheating or voter fraud are people who never watched any of the state legislature hearings, listened to first hand testimony on the fraud, and base their opinions solely from main stream media reports which were repeating non stop there was NO EVIDENCE of fraud. Then the story got changed to there was no evidence of widespread fraud.

People who actually took the time to listen to the hearings and testimonies of poll watchers and a brave truck driver (who witnessed a shipment of fake ballots taken from NY to PA), and a brave poll watcher in Detroit who reported that in her experience the number of votes never matches the number of voters in certain precincts, know what happened is fraud. And those are people like me, for example, who are very hurt and disappointed by the attitude of our political class who know better than the citizens what is right.

If nothing is done about cleaning up voter registration rolls then there will always room for ballot stuffing. etc. because there is no way of accurately comparing the amount of votes compared to registered voters. As far as big cities such as Philadelphia and Detroit are concerned their corruption is well known.

Of course Dominion is going to sue, they have to at least make an effort to defend their reputation. Anyone who thinks that the Dominion machines haven't been completely cleaned and given the "Hillary Clinton email server and phone treatment" are foolish indeed. She actually destroyed evidence and got away with that too.

What bothers me now is that Democrats who never followed the hearings, etc., insist that people who did should forget what they heard. That's not going to happen. I'm willing to accept what happened but not to pretend it didn't happen.

The difference between now and the previous events is that there are many more witnesses because of the internet and social media.

Do you remember the big flap about counting illegals in the census ? San Diego and the central valley, which you know nothing about, have millions of illegals.

When I was reviewing worker's comp claims in CA, about half were by illegals, about a third of those did not speak Spanish and most claimed a second grade education if they did. That doesn't mean half of all workers are illegal but it does mean that about half in dangerous occupations are.

Even Orange County, where I lived for 50 years, has Mexican ghettos with largely illegal populations. When my wife's drivers' license expired in January 2016, that coincided with the new law allowing illegals to get DLs. She tried for an appointment calling in December, well ahead of time. She could not renew her license until April. So, to accommodate illegals, she did without legal ID for 4 months. We moved to AZ a year later.

AlGore attempted to steal the election. The NYTimes review of all methods of vote recounting show that ONLY the selective partial recount desired by AlGore would have led to his victory. Every single other way of partially or fully counting and recounting votes in Florida resulted in a Bush win.

AlGore failed to steal the election. But the Democrats learned from his failure, and used purposefully-unauditable votes from urban centers to win in several states. Were the votes from those close states valid? There was, and is, no way to tell. That alone makes for a compelling case of perfidy in the vote counts.

As with the first impeachment trial, the Democrats want to have it at least three ways:

1. Impeachment is a political, not criminal, matter (so no criminal charges need to be brought).
2. The opposing party has a constitutional obligation to make the same political judgments the party in control of the House of Representatives does.
3. The Senate voting process is a criminal trial, with the article(s) of impeachment now becoming, not just the accusation(s) of crime(s), but their existence being ipso facto proof of the commission of the crime(s).

The transfer entails the incumbent administration cooperating with the incoming administration. To some extent, Nixon and Gore were "incumbents" as vice presidents, I suppose. But not really. The demands that Trump "admit" either that he lost the election or that he was lying all along about believing that he won the election (or both) have the ring of "Say Uncle!" and nothing more. And everyone knows it's only nominally about Trump; he's the stand-in for everyone who is indignant about the opacity and, at minimum, shenanigans of this year's elections.

I've said many times, and will keep saying until the situation changes, that if you wanted to be able to commit vote fraud where you needed it, the actions taken this year by Democrats, especially in the cities that would move the needle in battleground states, would be your template.

It is certainly possibly that there's no way, now, to "prove" that significant, targeted fraud happened in those places, much less that the election turned on that fraud - because that's the way the Democrats in those places set up the process. But that means you also can't "prove" that Biden won fairly - you can only assert it, over and over.

Of course, all this may be moot if HR1 passes, extending the "fraud if, when, and where we need it" template nationwide. That's one of the situational changes that might shut me up about it, since it could be the precursor to criminalizing certain political stances and I have kids whose lives I don't want to see ruined through my criminality. But I'm not quite ready to say uncle yet.

I would like to point out that when Al Gore disputed the vote tallies in FL, we all watched on live TV the review of each vote being contested. Complete transparency of the how votes were being tabulated. When Democrats tried to prevent Republicans and the public from being able to witness the recount, Republicans boisterously, but peacefully protested and forced Demorcrats to allow public scrutiny.

Notice that neither Republican legislatures or the public were allowed even minimal scrutiny of the contested counting.

As several people (including me, on a different thread) have already posted, this info is out of date. Sicknick had, according to the ME, no blunt-force trauma, so he was not hit on the head. They are apparently still investigating possible bear/pepper spray, but have seen no video evidence of same. The two resuscitations on the way to hospital are news to me, but what isn't news is that he was out of hospital and back in his Capitol office when he collapsed and died, not "the next day" but later the same day.

The info above comes from a CNN(!) report dated today. What's the date of your Reuters citation?

We have one for Ashli Babbitt; she was shot, and the Capitol police know by whom, but aren't saying. (NB I hold no particular belief for Babbitt, who was at minimum behaving very aggressively in a nasty situation.)

The biggest difference between past contested elections and this one in 2020 is that Trump was not the only one who was calling for investigations and hearings. In fact most of the hearings were not filed by Trump's legal team.

Again, this mass interest is because of the internet and social media, not because of anything Trump did or said. You might as well blame and impeach millions of citizens for watching Youtube videos and sharing their outrage online for what happened at the Capitol, because it wasn't just Trump who was upset by the apparent fraud. There were poll watchers, truck drivers, IT personnel, advanced mathematicians etc., who testified about the anomalies the witnessed first hand and outright fraud they witnessed first hand.

In fact there are already calls for mass control of US citizens:

A speech that includes phrases like "go home peacefully," and "don't forget we are on the side of law enforcement" cannot possibly be consistent with a call to insurrection.

There is also a lot of evidence of fraud, starting with the fact that a 78 year old man, who didn't campaign, who came in FIFTH in the NH primary, and who clearly has dementia prevailed, with the highest vote count in the the history of US elections, against the incumbent who had the second highest vote count in the history of US elections.

That alone justifies an investigation.
