"How does it feel to be nominated for the Supreme Court of the United States?" — Lindsey Graham asked Amy Coney Barrett.

I got the feeling he resorted to this question — which sounded like the way athletes are interviewed after winning a game — because Barrett had given such short answers to his questions that he'd run out of substantive questions. But I think this is pretty interesting. I like her answer, and it leads Graham into opining that he and all of the Senators are insane. (Scroll to 1:21:56 if it doesn't automatically start in the right place.)

   

She says the process is "excruciating" and she had to question whether a sane person would go through with it. Her answer was: "Why should I say that someone else should do the difficulty if the difficulty is the only reason to say no? I should serve my country."

Graham: "A lot of people would say you've got to be insane to run for the Senate in this world. But good news for you: We've all chosen kind of crazy stuff to do."

OH YEAH! Future Supreme Court Justice, the Honorable ACB, just bitch slapped Durbin for his misreading of Heller v DC. The case was a narrow test case limited in scope to questioning the constitutionality of a ban on an entire calls of firearm ownership within a federal enclave. Perhaps the "cleanest" and simplest test case for gun rights imaginable. And Durbin regurgitated the lie that Scalia approved all other gun regulation in the Heller Decision. Comey explained the difference between dicta and the case's decision to him in two sentences.

I just watched a good chunk of the video of Barrett's hearing. She's very impressive. Her manner and speech is that of an ordinary middle class American. Her mind is extraordinary.

If a movie were ever made about her, Amy Adams would get the role.

One must wonder what the value of this bear baiting process is for confirmation of a Supreme Court nominee? And yet honorable people have to hold their nose and plunge into and through the pit to get to the seat they deserve.

I can't think of many Supreme Court nominees in my lifetime who weren't at least well qualified to sit on the Supreme Court. Well Abe Fortas--corrupt. R. Clement Haynsworth--mediocre, although he did give occasion for Senator Roman Hruska to give one of the most unusual speeches ever put forth on the Senate floor "mediocre people deserve a seat on the Supreme Court". Maybe George W. Bush's putative nomination of Harriet Miers was not well considered. Other than that, if they've been nominated, they generally deserve a seat on that bench.

But having tasted blood with Bork, the Dems seem to have a bad case of rabies where Republican judicial nominations are concerned.

I had the misfortune to tune in for two minutes while driving to work, and heard an R Senator (90% certain it was Sasse) droning on about "Packing the court" and how it would "delegitimize" the Court, and would hurt the Constitution. I was pretty sure it was Sasse, since it had that lofty, pompous, professorial wordiness that I expect from him. He even gave us a little history lesson about FDR's packing plan.

Imagine being being Barrett and having to listen to this crap and appear interested! I'm sure she's probably thinking "What's for dinner" as they're droning on.

During testimony this morning John Cornyn asked her to hold up the notes she was using for her testimony and show them to the committee. She held up the small, US Senate note pad on the desk in front of her, which is all that is on the desk. The notepad is blank.

Very sharp. Very well prepared. And by all appearances (so far!) a very high quality person. I'll admit, and this does me no credit, that at first I found her voice a little off putting. But when you listen longer it grows on you. And after all, the SC justices mostly communicate by writing.

A clear thinking person in Washington DC....very refreshing.

What we are seeing now really doesn't matter. The hearing is mostly about making political points that have more to do with the election than with the ACB conformation.

Mollie Hemingway made the excellent point that the Democrat MO is to smear ACB after she is voted out of committee. Look to see WaPo, NYT, CNN and Politico smears that the rest of the media will use as talking points. Thus, the Democrats can avoid looking like total assholes.

However, it is impossible for Sheldon Whitehouse to avoid looking like a complete nut. Who do you think is dumber, Mazie Hirono or Shelly boy?

Tried really hard to play the gotcha game by leading the witness down a path of easy yes questions only to be thwarted by her anticipation of his, clumsy, attempt to get her to opine on a case currently in the courts. He folded with the obligatory sob story about some constituent or another that is struggling with, something.

Stolan Valor Blumey was never, ever IN Vietnam. He is not a combat veteran, just a guy who was in uniform in the Vietnam era - nothing more. So if he is suffering the effects of agent orange, he was exposed stateside or in his dreams. Probably just a bit too old and suffering the usual decline with age.

Just anecdotal, but we have a daughter and a daughter-in-law who are both nurses here in Northern California and they’ve told us that they have been pleasantly surprised - amazed, actually - at the number of colleagues who have strongly expressed their intentions to vote for the Trump-Pence ticket. I wouldn’t have expected that, given their union pushing hard for the alternative.

I watched some of the hearing. She had an impressive ability to look impassive and neutral during the harangues, both positive and negative, that were directed against her. I saw Sen. Kennedy's questioning. He has a courtly manner that managed to bring out her charm and humor...His questioning came right after that of Kamala Harris. This is kind of unfair to Harris, but you can't help thinking of how different are the lives of ACB and Harris and the different paths they chose to achieve success and distinction. Harris made the point that if ACB gets on the Supreme Court, lots of people, principally women and children of color, will die painful and unnecessary deaths. Lots more children will die in school shootings too. ACB looked impassive and respectful as Harris recited her indictment. Call it judicial temperament. It showed impressive composure. She wasn't like Kavanaugh who hot under the collar when the Senators accused him of being a drunken rapist

I've really enjoyed watching ACB slam the ball over the net at the Democrat questioners, but I'd like to talk about something else. The BIG ISSUE is Roe v. Wade; that's what's really at stake here (sure and Casey, too). Ask yourself this: Suppose that in 1973 (47 years ago!) the Supreme Court had ruled that nothing in the Constitution prohibited States from regulating or even prohibiting abortions. Today, almost half a century later, most States would have laws that permit abortion under some circumstances, because political opinion would require them to do so. Politics would lead some States to allow abortions fairly freely, and other States might impose more stringent limits.

But what would not be the case is that the MOST IMPORTANT ISSUE in deciding who should sit on the Supreme Court is what the nominee believes about the "Constitutional Right to Abortion."

I wound up watching Kamala and thought to give up at that point. Fortunately, I kept going.

Having tasted of some of the hearings, the horrible (Kamala, Klobuhcar) as well as the sublime, I found Grassley good. However, VASTLY superior to all the rest of the ones I heard was Kennedy of Louisiana, with a close runner-up in Blackburn of Tennessee, both at the very end of the session. I have never seen as masterful and educational a Socratic dialogue as the one Kennedy conducted with ACB on originalism and textualism -- as well as on the absolutely vapid nonsense much of ACB's detractors on this committee tried to dump on her and trip her up with. What I loved was his down-home plain speaking which for the prejudiced may mask the impressive grasp of the issues he had to have to pulled of what he did.

And after seven hours or so, ACB's absolutely direct and to the point responses to every question from those two at that late time in the day proves what an astounding mind she does have. It is a great day for the republic that she will be on the Supreme Court.

I watch these things and wonder how our dear hostess would fare under this sort of scrutiny.

If nominated by a Democrat she would sail through the nomination process because her policy of cruel neutrality.

If nominated by a Republican, her every post would be scrutinized because of her policy of cruel neutrality. Neutrality is never allowed on the subject of progressive dogma.

However, our hostess would aquit herself very well. Of that I have no doubt. Unless she completely lost it while being questioned by such absolute morons.

I would understand how neutrality would only go so far when faced with such stupidity. Especially after years of experiencing it in the classroom.

Lucky for me I could skip ahead.

Out of the 31 minute video, she did not ask a question until about 10+ minutes in.

For someone that was a DA, she is not too bright. Her "gotcha" questions were just dumb. Also, don't you love when these mental midgets ask a question and then specifically say "just a yes or no answer". As Barrett correctly pointed out, she is under oath and if "just yes or no" does not properly answer the question, she can suffer consequences AND the MSM would jump all over it.

Harris is a walking ad for term limits and a qualification test for high office. She is mostly envious that Barrett didn't have to make it to the top on her knees.

One other thing that stood out for me when watching the Booker session: his presumed and desired judicial philosophy versus ACB's. Booker went to great lengths to say it is the judge's responsibility to focus on the outcome of judicial rulings, particularly negative outcomes, for people that would result from overturning laws such as Obamacare. She explained, several times, that judges are supposed to, obligated even, review the case as presented, read the law as written and in the context of the time it was passed, assess the application of any legal precedents, and determine if there is anything in the Constitution supporting or negating the law. Booker either didn't want to or didn't see the difference.

Left unsaid explicitly by ACB was this: if a law you like, Senator Booker, is struck down by the Court then you should write a better, constitutional, law. As a legislator you have that power.

Believe me, if Senator Merkley (of Portland) were on the Judiciary Committee he would be the most stupid member by far, so the Nation escapes that trial at least. He did a townhall meeting here in Eugene once and at one point spent ten minutes going on about 'Multnomah County this' and 'Multnomah County that' (Multnomah Co is Portland) until he eventually realised he was supposed to be saying 'Lane County'. And I will admit that he is nice.
