Having carefully read Trump's Mount Rushmore speech and analyzed it line by line, I will now look at the mainstream media headlines.

Go to the previous post for my untainted assessment of the speech. I will now see what's being said:

The front page of the Washington Post has "Ahead of July 4, Trump exploits racial, social divisions/In a dark speech at the foot of Mount Rushmore's monument, President Trump focused on what he described as a 'left-wing cultural revolution' that aims to rewrite U.S. history and erase its heritage" — reworded at the article page as "At Mount Rushmore, Trump exploits social divisions, warns of ‘left-wing cultural revolution’ in dark speech ahead of Independence Day."

Oh, it's a "dark speech." It was full of optimism and painted the beautiful version of American history, but what the Washington Post saw is darkness. But it certainly did attack the left — for its dark vision. The article brings that out, giving the most highlighted position to this quote from Trump:
"The radical ideology attacking our country advances under the banner of social justice. But in truth, it would demolish both justice and society. It would transform justice into an instrument of division and vengeance and turn our free society into a place of repression, domination and exclusion. They want to silence us, but we will not be silenced."
The New York Times has "Trump Uses Mount Rushmore Speech to Deliver Divisive Culture War Message/Down in the polls and failing to control a raging pandemic, the president cast himself as waging battle against a 'new far-left fascism' that imperils American values and seeks to erase history." The speech is full of material that can be used to make the argument that Trump was pulling Americans together, but he was calling on us to reject the destructive message that he ascribed to the far left. The left is very conspicuously "waging battle" against American values, so it's not as though Trump is starting it. He's fighting back. Whether he's fighting for America — as he says — or because he's "down in the polls and failing to control a raging pandemic" is a matter of opinion.

The quote the NYT puts in the most highlighted position is:
"Our nation is witnessing a merciless campaign to wipe out our history, defame our heroes, erase our values and indoctrinate our children. Angry mobs are trying to tear down statues of our founders, deface our most sacred memorials and unleash a wave of violent crime in our cities.”
The CNN headline is "Trump tries to drag America backward on a very different July 4th." He's "stirring fear of cultural change." The highlighted quote is "merciless campaign to wipe out our history, defame our heroes, erase our values and indoctrinate our children."

NPR has "Trump Flouts Virus Rules, Warns Of 'New Far-Left Fascism' In Speech Ahead Of July 4th." One way to spin the speech is to downplay the text and stress the disease risk in holding an event at all. Like CNN, NPR highlights "merciless campaign to wipe out our history, defame our heroes, erase our values and indoctrinate our children."

Politico has "Trump seeks to claim the mantle of history in fiery Mount Rushmore address/The president’s speech, part of a July 4 weekend celebration, comes after weeks of protests against racism and police brutality that have forced broader discussions over America's monuments." What's most interesting about that is that it's not a big headline on the front page. In fact, it's squirreled away under the much larger headline, "Yes, Biden is thrashing Trump. But he could still blow it/Biden’s polling lead over Trump is significant, though not unprecedented." I'm going to interpret this to mean that Political saw an effective speech and is afraid and seeing an immediate need to boost Biden. The Biden article is long, and it's not about any news, just speculation about what could go wrong:
Biden might say the wrong thing at a debate, or have an awkward moment in an interview or at a press conference.... Biden’s campaign might make poor decisions about spending allocations in the battleground states.... It is possible that Trump before November will announce a coronavirus vaccine.... And it is possible that the economy will improve....
Oh, heavens, no! Not a coronavirus vaccine and an improved economy! The double whammy!!

Also, had to make a trip to TN on Thursday, back on Friday. Going north, lots of FL tags heading to cooler climes. Heading south, lots of tags from various northern states heading to the beach. Most people were wearing masks at the rest stops, but the shutdowns are on their way to being over. People aren't buying into it any longer.

Let's talk about the first amendment. The Supreme Court has ruled that burning the flag is protected speech, yet Trump wants a law banning it. He has tried to suppress the publication of two books within the past month, and his liberal use of NDA's demonstrate he is not a fan of Freedom of Speech.

Promising to send people to jail for 10 years for vandalism is hardly an "American Value", unless you think that excessive prison terms are a good American Value.

If anything Trump's vision of America is more fascist than the "fascism" he decries on the left. Extreme nationalism, putting America First, and condemning those who point out flaws in the system, or protest excessive use of police and military power, are hallmarks of fascism.

1666. ..."The penalties for violations of this section are tied to the extent of the property damage. As amended on September 13, 1994, if the damage exceeds $100, the defendant is subject to a fine of up to $250,000, ten years imprisonment, or both."

In his EO President Trump simply directed the enforcement of the law as written. Took about 60 seconds in DuckDuckGo to find this. Perhaps you should learn how to look up things on the internet.

The district court doesn’t have to dismiss until the court of appeals issues its Mandate. In turn, the court of appeals doesn’t issue its Mandate until the time to file a request for panel rehearing and/or rehearing en banc has expired or decided if filed. In the Mandate, the court of appeals tells the district court to now do what we told you to do in our earlier opinion.

I wonder if the NYT or other papers would describe putting huge, block long letters spelling out Black Lives Matter on city streets and in front of Trump properties as being in some way "divisive". Perhaps they should close the street altogether and erect a huge statue of George Floyd there. Make it big enough so that's the first thing Trump will see from his penthouse window.. ...Is toppling statues a 1st amendment right? It is, at any rate, a more significant act than vandalism....I have some immediate antecedents who fought on the Union Side. They were shot at by Confederates, and a great-granduncle was wounded. If they were willing to shrug off the erection of Confederate monuments in the interests of binding the nation's wounds, why do others, generations later, have more right to be offended by these monuments?

I have a great hope for the Great Americans Hall of Fame. If done right, this area would become a very popular place on the Mall. It would be accessible for selfies and teach Americans about why these men and women are important to us all.

I can see these statues being replicated and taken on the road to other parts of the country where school children could visit and learn about our shared heritage. I'm getting weepy thinking about it.

I'm a member of The Church of Jesus Christ of Latter-day Saints. It has a strong pioneer heritage. My mom and her parents joined when my mom was 12. My dad when he was 18. I have no part in that traditional pioneer heritage, but I feel like it's my own too. Our church sponsors mini pioneer treks for the youth so that we can identify with those pioneers, even if you're like me. The statues can be a bit like that for all Americans.

What a great idea. I'm sad that our media elite can't see that.

Here we have an almost perfect example of leftspeak. American values have been well known for many years and only recently have communist inspired rioters tried to change the definitions.

Antonio Gramsci explained it years ago.

Apparently, Freder is living in that universe where Spock has a beard. The only ones whitewashing history are the left. Trump isn't pulling statues down. Trump isn't destroying historical places. The left is doing that. That is completely undeniable.

Democrats are the real fascists because they stand back and let mobs tear down statues, burn businesses and assault people all because they want those victims to be scared. Statutory maximum sentences don’t happen all that often. Trump could direct prosecutors to seek the max, but its ultimately up to judges, and even Trump-minded judges aren’t likely to do it in most cases.

Thanks for the info. I spent most of my practice time in Bankruptcy Court and the only appellate work I did was with the Georgia Ct of Appeals and Supreme Court. I have now (thanks be to God) been retired 3 years and to save me having to do any more legal research could you or one of our other commentors tell me what the how many days between issuing the order granting mandamus and requirement to file a request for an en banc hearing?
If Sullivan was going to obey the Court of Appeals, he easily have dismissed the case by now. Just how long can he drag things out? Certainly not until the election.

Near as I can figure, the next scheduled action by Judge Sullivan in the Flynn case is scheduled for 16 July. Wouldn't surprise me if he thumbed his nose at the appeals court and sentenced Flynn on that date.

In places like North Carolina, even when polling majorities approved the removal of Confederate statues, even larger majorities condemned the unlawful removals by demonstrators.

So it truly is a mark of Trump’s radioactivity that he cannot even successfully pull off the message of, ‘We should protect all federal monuments from any unlawful vandalism...’

Circuit Rules 35 & 40, because this is a criminal case, not a civil action, the request for rehearing must be filed within 14 days of the court of appeals’ decision. Usually, the mandate is issued the next day or a couple of days thereafter. I think that the dissent in the Flynn case was trying to setup a basis for an en banc rehearing by arguing that there’s now a split among the D.C. Circuit’s cases on Rule 48 of Criminal Procedure, but the majority disputed that in its decision. Nevertheless, I suspect that a request for rehearing en banc will be filed next week.

This is simply false. No one has criticized fault-finding, or criticized protestors who stay within the limits of the law.

For the latter: I think I've mentioned that I've seen a couple of demonstrations in my small town of 24,000, in which several hundred people of different races marched down the sidewalk with home-made signs shouting "George Floyd! Say his name!". Absolutely no one objected: no one stuck out a middle finger, or shouted abuse, or even snickered at them, and they didn't do any of that to the non-demonstrators. Those who had other things to do (as I did) walked past or through the demonstrations without bothering them or being bothered by them. It was not a problem.

Lately I have read a lot of leftie tweets claiming to have been assaulted or tear-gas'd or even rubber-bulleted while "peacefully protesting", but I note that (a) even the most violent looters and arsonists like to claim to be "peacefully protesting", apparently thinking that "peaceful" covers any amount of wanton destruction except assault and murder and maybe rape, and (b) no one ever claims to have been "legally" protesting. If you're out after curfew, or knowingly on private property without specific permission of the property-owner, or spray-painting other people's property without permission, or ignoring a police order to disperse, or tearing down statues without the owners' specific permission, or blocking streets without a parade permit allowing you to block that specific street at that specific time, you may (or may not: see 'a') be acting peacefully, but you're still not acting legally, so fuck you if you get tear-gas'd or rubber-bulleted when you ignore a direct order from the police to go home. Any injury is your own stupid asshole criminal fault.

The courts have no business enforcing NDA's that purport to protect the reputation of someone, that is what libel and slander suits are for. Also NDA's are abused most by people who have much more power.

Judge Sullivan has a statutorily limited number of days by which to ask the circuit to reconsider the decision of the 3-judge panel. After that date passes, or after the circuit denies his request, the 3-judge panel will issue an order with a time limit for dismissal.

If the reconsideration request is granted (if applied for) Judge Sullivan could wait for a further decision. And the DOJ could appeal if the circuit reversed the 3-judge panel.

Sullivan is biding his time, as he is free to do. But he risks looking more ridiculous with each day. The DOJ continues to turn up Brady material.

I think that the issue is timing. I think that it would work better to hit this hard, after the Dem convention, however much they have of it. Now, it would be fairly easy to swap Biden out for a less demented candidate. After that, they very well might have a mess on their hand. By then he will have a, presumably black female, VP pick, who will of course, expect the nod. But unless it is Michelle, they won’t have much of a power base of their own. Bernie has a power base, but will most likely be ignored. That could be a problem. Then there is the problem that states have different ballot cut off dates. If they wait too long, there are going to be lawsuits contesting substituting Presidential candidates after the statutory deadlines. It won’t be an issue in deep Blue states. NJ showed the way with Torricelli. And they are likely to lose in deep Red states. Which leaves the swing states, and, in particular, Crooked Hillary’s Blue Wall states. If the Republicans can keep the replacement off the ballot in just a couple of these states, it may be impossible for the Dems to win.

Where do you think that most of the combat vets go, after they leave the service? Do you really think that many of them are going to join your team? Infantry, and other combat specialities, tend to be white (after that, Hispanic) rural, southern or mountain states western, with a representation from the Midwest. Mostly Red Team, esp in the enlisted ranks. It’s partially a patriotism thing. Blacks, when they enlist, tend to select specialties that will train them for a career after the service.

He can ask the panel to reconsider. They won’t. They might agree to an en banc hearing of the entire court. That is a hard sell. The dissent studiously ignored the significant Separation of Powers issues. Moreover, they seemed to accept Gleeson’s theory, based as it was on rumors and innuendo that was not in the record.

I think that it probably goes directly up to the Supreme Court at that point. The Solicitor General signed onto the DOJ brief, which is rare. He spends most of his time at the Supreme Court (where he has an office). His presence on the filings said two things. First, he was speaking for the DOJ and the President. Brandon Van Grack was speaking for himself, as well as maybe Andrew Weismann, Bob Mueller, and the Lawfare Group, but never for the DOJ or the President. Second, that he will take it up to the Supreme Court if the government loses at the Circuit Ct. And SCOTUS has long given the SG significant deference on what he wants them to hear.

“Sullivan is biding his time, as he is free to do. But he risks looking more ridiculous with each day. The DOJ continues to turn up Brady material.“

But if he bides too much, I expect the DOJ to go back to the Circuit Ct panel and ask that the case be reassigned based on Sullivan disobeying their orders to dismiss. The panel saved face for him by denying the government’s request that a new judge be appointed. But that always assumed that he would do the right thing, and carry out their orders. I don’t think that they will be as patient a second time around.

Ah, the myth of William Jefferson Clinton and his overwhelming popularity. In 1968 Nixon received a bare plurality of votes, winning with 43.4%. Hard to say which way the Democrat voters for Wallace would gone. In his first election Reagan had an absolute but small majority with 50.75% of the popular vote. William Jefferson Clinton won with a plurality in his first election with 43% of the popular vote, less than Nixon.

In 1972 Nixon took 60.7% of the popular vote. In 1984 Reagan took 58.77% of the popular vote. In 1996 William Jefferson Clinton brought his popular vote total all the way up to 49.2%, becoming the only POTUS in history to be both elected and re-elected without garnering a popular vote majority. His wife also failed in her attempt to get more than 50% of the popular vote.

Well, first of all, they were the Iowa class, not the Missouri class. There were six planned and four built. (USS Iowa, USS Wisconsin, USS New Jersey and the USS Missouri. The Missouri was actually the last of the four built.

The New Jersey did indeed shell Vietnam. She also attacked positions in Lebanon in the early 1980's. The Missouri and Wisconsin were used against Iraq in Desert Storm in 1991. They did in fact fire their 16in guns at enemy targets during this time.

There are no battleships on active duty in any fleet. There are 9 20th century battleships still afloat and on display as museums. 8 in the U.S. ( the 4 Iowa class, the Texas (A WW I era ship), the Massachusetts and the Alabama (which were members of the South Dakota class built in the 1930's), the North Carolina (Also built during the 1930's but a different class than the Massachusetts and Alabama).

The 9th is the oldest and only non-American modern(ish) battleship still afloat. Japan still has the Mikasa as a museum ship. She actually sank once during the Russo-Japanese War but was re-floated. She became a museum ship before WW II and saw no action in WW II.

Let's talk about the first amendment. The Supreme Court has ruled that burning the flag is protected speech, yet Trump wants a law banning it. He has tried to suppress the publication of two books within the past month, and his liberal use of NDA's demonstrate he is not a fan of Freedom of Speech.

And two of them were used during Desert Shield/Storm. They cruised up and down the shoreline, shelling any military target they could hit with their 16” guns, with drones flying above their targets to offer real time shot assessment. In reality, they were probably more a distraction for the Iraqis, from the fact that the actual attack was going to come through Saudi Arabia and Kuwait.

Infantry, and other combat specialities, tend to be white (after that, Hispanic) rural, southern or mountain states western, with a representation from the Midwest. Let's put that aside for a bit, and assume the enlisted aren't going to enthusiastically gun down all the Pentagon diversity drones the second the flag goes up. There's some truth to the fact that many suburbanites are middle-aged and overweight, but this means only so much. When a housewife is ready to wave a pistol in the face of a thuglet, Opposite Day stands to become Opposite Daily- and actual black people are quite aware of the savagery with which white Americans will behave when pressed. This is also knowledge held by the Cherokee, but you have to expend far more time finding one- mainly because of said white savagery. An honest appraisal of the antebellum era would say that America genocided the native tribes more or less as a team-building exercise between the reconciled armies of the nation. You can assume Donald Trump hasn't learned these lessons himself, but you'd be wagering your life on it.

I would say the battle was pretty even. I have friends with a 30,000 acre ranch in southern Arizona . At the eastern end of the ranch is a burnt out ranch house from the 1880s.

The Iroquois had the best chance to adapt to the whites but they chose the wrong side in the French and Indian War. The movie "Last of the Mohicans" has a pretty good account of that war. Dartmouth college was founded for the Indians' children. It has gone lunatic PC but that was the original intent.

The Cherokee, as well as the other Civilized Tribes, did a pretty good job at adopting white ways - to the extent that they apparently brought their black slaves along on their forced trek to what is now OK. According to one of their descendants I knew, they did too good of a job. They kept the best farmland, and sold the lower quality land to the whites moving there. And it was ultimately for that better farmland that they were removed by the government to OK. It should be no surprise, that they supported the Confederacy, over the Union in the Civil War.

I think that one factor for the Iroquois picking the wrong side in the French and Indian wars was that the French and English had very different methods of colonization. The French came over, almost entirely men, and worked closely with the tribes, often taking Indian wives. The intent typically was always to retire back in France. The English brought their own wives, with the intent of being fruitful and multiplying, filling up this new continent with their descendants. Which they proceeded to do. Population pressure was why they could never keep treaties, first with the French, then later with the Indians. It’s logical that those tribes picked the French over the British (and later American) settlers. The French were more trustworthy, because they didn’t have to deal with the pressures of population growth, which saw colonists sneaking across the mountains into the Ohio territories, etc, despite treaties that were supposed to prevent it.

But that population pressure, of actively encouraging large families, was also why the Indians were ultimately going to lose. They could have been the best fighters in the world, but by the time that the Plains tribes were fighting for their survival, in the late 1870s, they were outnumbered maybe up to 1,000x by the encroaching Americans. There was a decade after the Civil War, when the US was too exhausted to fight a lot. But that essentially changed on the country’s centennial, July 4, 1876, when word was received of Custer’s Last Stand. Within several years, the US was fielding multiple regiments to fight single Indian tribes. They just didn’t have the numbers to resist long run, esp when they had to protect their women, children, and old folks.

It also didn’t hurt that the government effectively sanctioned the butchering of the vast bison herds that had, up until then, filled the western plains. The Plains tribes had undergone a couple generations of rapid growth, after acquiring large numbers of horses. They could finally follow the bison, instead of waiting for them to come by once or twice a year. But it was still hunting, and not farming, then city dwelling, which allowed much denser populations. In any case, the Plains tribes found themselves starving after their primary food source was eliminated. Their tribes had grown too big to support without the bison herds.

Remember though that this sort of population expansions of one group, taking the lands of another group is as old as history. This has happened constantly, even into the 20th Century. And with our Indians, we had hunter/gatherers fighting the encroachment of farmers, and then city dwellers. The number discrepancy made the ultimate result inevitable.

The history of the native tribal is a bit more complicated than that. Before Jamestown, English colonies had a long history of "unexpected" failure. You can make the argument that the eastern seaboard was more hostile than tropical islands, but I rather suspect the tribes of those days wouldn't tolerate any amount of immigration that wasn't under their terms. Ie, kill the men and "take" the womenfolk. Modern feminists would have you believe the tribals had a 100% consent rate with white settlers, but then they can be silly optimists about their favored ethnics.

As for Indians choosing between the French and the English, the French chose to give away their North American colonies after the Seven Years' War. Voltaire remarking that the war was costing more than all of Canada was worth might have been apt, now as then: it was probably not worth forcing the Thirteen Colonies into independence or the French Terror. There were many tribes, who made many choices: they had influence upon wars, but clearly it wasn't terribly decisive or they would still have influence today.

As for the bison, I rather imagine the native tribal was pleased both to have horses to chase them, and rifles that made hunts less wasteful. I'm sure they were completely virtuous flower children who used every part of the buffalo, while the mean old white man merely took the skin and left the meat behind. Forget the many uses, including industrial ones, that the white man could put even buffalo bones towards.

It's a fascinating history. But it is over now, excepting some obnoxious white virtue signaling over a greatly reduced nation. Such is life.

During the height of the (almost) extermination of the bison, they were taking maybe the tongue, and little else. The less urgent reason that the bison herds were eliminated was to open the plains to farming. With our rapidly growing population, we needed more farmland, and the bison, even more than the Indians, prevented the western Great Plains from being farmed. Barbed wire fences, like those used to control cattle, weren’t more than a small nuisance for Bison. The fences required for bison are formidable, and thus expensive.

I was not trying to minimize the effect that guns had had for the Indians’ ability to hunt bison, but rather was suggesting that the reintroduction of horses was more significant. This resulted in an increase in the sizes and power of the tribes most dependent upon bison, the Plains tribes, and esp, I think the various Sioux tribes. We saw the effects here in NW MT, where white settlement here retreated in the 1830s, with the Blackfoot pushing out the more friendly Salish, and who had been pushed over the Continental Divide by the even more aggressive Sioux. Of course, by 1876, the Plains tribes were overall better armed with repeating rifles than the cavalry units sent to fight them, who were still using Civil War surplus arms.

My point was not any homage to earth worshiping native Americans, but rather to point out that technology, combined with resulting increases in population density, have been the reality behind much of our world history, and it was just as significant here in the US, as the Germanic tribes that ultimately destroyed the western Roman Empire, and the Turks who destroyed the Eastern part almost a millennium later. Europeans moved in here in the early 1810s, and traded with the friendly Salish. Whenever the Salish found Blackfeet west of the divide, they would grab their newly acquired guns, and rush off to kill them. Until, 20 years later, the Blackfeet came over in enough numbers that they were able to push the Salish out. But this wasn’t unique here. Indians from one tribe happily, and almost automatically, killed Indians from neighboring unfriendly tribes. It was both necessary, for the survival of their tribes, and great entertainment. The dynamic was the same in my native CO, with the more aggressive plains tribes, with increasing populations, pushing out (or killing) less aggressive and less successful tribes, to the west. The century before, we saw the same dynamic, with Indians happily killing Indians of competing tribes, and allying with different European powers. And before that, we see evidence of the internecine wars between Indian tribes with the construction, then abandonment of the cliff dwellings in the Four Corners area.

Bottom line - I don’t consider the subjugation of the Indian tribes by people of European ancestry to have been evil, but rather human. Human nature. The Indians did it to each other. They killed each other for their land. Constantly The Eurasians constantly did it to each other. Africans did it to each other, and continued to do so throughout much of the 20th century. We did it to the Indians because, once we gained a foothold on this continent, we had a much faster growing population. So it was inevitable.

The Indo-Europeans invented the wheel and domesticated horses. As a result they conquered Europe and much of Asia down to the middle of the Indian subcontinent. The DNA of the people post Indo-European invasion showed Y chromosomes of IE origin while the X chromosome was usually of the indigenous population. The same is seen in the Mestizo culture of Mexico.

I overstated that but I do go to other blogs, like Chicagoboyz or Ricochet, for more serious discussion that are not full of trolls like ARM and Inga and Freder. It has improved since Ritmo was banned. I quit coming here a couple of times because of his abuse. Chuck is annoying but harmless.

Agree. The French did not bring wives, for the most part. Remember Marshal Dumas, father of the writer Alexander, was a French army marshal with Napoleon but his mother was slave in the West Indies.

FWIW the USN’s last ship utilizing 8” guns was the USS Newport News (CA 148). She was the Navy’s last all-gun cruiser. She saw her last combat action off the coast of Vietnam. She was decommissioned in 1975.

For the few USN vets that regularly comment on this blog my earlier comment should have noted that the USS Hull (DE 945) was a test ship for an 8 inch gun during the period 1975-79. Never fired a shot in anger. First time that size naval gun was mounted on a ship as small as a destroyer. Although the test of the new mount/technology was deemed successful the program was never rolled out.

French leadership, up to the monarch, was usually opposed to development, because they didn't want an alternate power center to develop in the colony. They were especially leery of Protestants settling in America. During the 7 Year War, the Canadians assumed that all they had to do was hold a few bits of land, and that the bulk of Canada would be returned as part of the global piece.

The French influence in Canada wasn't completely benign. They introduced smallpox to the Algonquins, and so weakened them that Iroquois had about a generation where they could raid as far north as they wanted.
