I recently criticized the position of my fellow witness from the Trump impeachment hearing, Professor Noah Feldman, that Trump is not technically impeached until the articles of impeachment are referred to the Senate. I have known Noah for years and respect him but this theory is utterly without foundation in the text or history or logic of the Constitution. The theory is a chimerical conflation of the impeachment and removal provisions. President Donald Trump however has seemingly embraced the theory that he is not actually impeached. Even as mockery, Feldman’s theory should not be further referenced in my view as credible. The President’s status is clear. He stands impeached, but untried.

President Trump lashed out at the Democrats from West Palm Beach yesterday, declaring:

“They had nothing. There’s no crime. There’s no nothing,” Trump said. “How do you impeach? You had no crime. Even their people said there was no crime. In fact, there’s no impeachment. Their own lawyer said there’s no impeachment. What are we doing here?”
The reference to Feldman’s theory could be simple taunting but there have been reports that the White House was thinking of adopting the clearly erroneous interpretation.

I have already explained why this interpretation is unsupported and untenable from either a textual or historical standpoint.

Trump added that the Democrats have elected to “pursue an illegal, unconstitutional and hyperpartisan impeachment.” I have obviously criticized this impeachment. However, the way to oppose the effort is not to simply force a muscle vote while citing dubious constitutional interpretations. There are strong defenses against conviction but such defenses are undermined by opportunistic or unsupportable interpretations.

Yeah, he’s “impeached” but it will always have an asterisk. The political “impeachment" over policy differences and Pelosi is demanding that it not be tried with the same rules that the Senate used for Clinton. Well the Senate has the “sole power” to try the impeachment and it’s really none of the business of the House as to how it is done. When the Senate passed a resolution saying that the House needed to give POTUS due process, the House ignored it. What goes ‘round comes ‘round Nancy.

During the impeachment debate the Dems used high-priced criminal lawyers and House staff. But there was not an authorization for payment. One thing you aren't supposed to do is go ahead and spend money before the House authorizes payment. Otherwise the Senate could just go ahead and hold its trial and get authorization later. But neither the House nor the Senate can do that, yet it seems they did. Impeach Pelosi?

I think the "impeachment" might be invalid because it took money to carry it out, yet the spending bill has not, even yet, been passed.

I'm trying to get into Witcher on Netflix. I've seen a few episodes. It's not awful, but it makes you realize what an achievement Game of Thrones was. GOT could put you in a fantasy world that was both recognizable and comprehensible. There were allusions to Shakespeare, Sophocles and Seneca with guest appearances by the Mongols, Lancasters, and Mamelukes....Witcher seems more involved with the myths of Universal Studio horror movies than with the great events and heroes of civilization. There aren't any characters whose story arc is particularly compelling or recognizable. Still, there's a fair amount of nudity, gore, and special effects. I'll stick with it even though the plot is confusing and pretentious. It's better than the impeachment drama but a far cry from GOT.
