"Well, Linda Tripp — remember, Clinton was impeached because of Linda Tripp’s testimony, which was complete hearsay!"/"Well, she was not under the desk with Monica. Let’s put it that way. So that’s hearsay."

Discussion of the hearsay rule on "The View."

It's hard to believe, but back in the day TV political talk shows, which only existed on Sunday morning, consisted of sober journalists interviewing a range of dignitaries on key issues. No celebrities. No focus on one issue. Serious conversation by serious people on serious subjects.

How far we have fallen in....40 years?

This weekend, I saw some pundit start trying this "hearsay is better than eyewitness accounts" argument. It's obviously something that's gone out as a talking point. The idea is supposed to be that eyewitness testimony is often unreliable. Which is true. So then we are supposed to not really think very hard, and come to the conclusion that hearsay may be more reliable than eyewitness testimony.

Yeah, it’s a cute point other than being completely false.

We're often told he was impeached for extra marital sex. Make up our minds, please...

You couldn't pay me to watch that dreck. Amazing that people think The View is a valuable source of information. I guess our schools really do suck.

David Begley said...

We had the blue dress so that issue was not in doubt. As I recall, Linda’s testimony wasn’t whether the sexual acts occurred or not. It was along the lines of Monica’s actions and her state of mind.

Speaking of Monica and Bill, why no intercourse between the two? Why not go all the way? It must have been very unsatisfying for Monica.

MayBee said...

It must have been very unsatisfying for Monica.

IIRC, that's exactly how Clinton explained how what he did was not *sexual* harassment.

I can never keep track of whether what Clinton did to Monica was just sex, or if it was #MeToo.

I thought it was the Paula Jones case that got Bill impeached. You know, the government employee that he harassed? Or did that one just get him disbarred.

So hard to keep them all straight.

that was the 'depends what the meaning of is is'
as in: is sodomizing a girl having sexual relations

Probably everyone here knows that rehajm is correct. The four articles of impeachment were: lying under oath to a grand jury; lying under oath in a deposition in a civil suit; encouraging others to lie and mislead; refusing to cooperate with COngressional impeachment proceedings.

If I recall, Clinton was impeached because of his own false testimony. Linda Trip just led to the discovery of direct evidence of such, in the form of DNA.

Democracy dies in lazy thinking.

Steven said...

Clinton was impeached because of Monica Lewinsky's testimony, and physical evidence provided by Monica Lewinsky. Neither was hearsay.

And the evidence of Lewinsky's own perjury (in an affidavit in the Jones case) that was used to pressure her to testify was actual tape recordings of statements by Lewinsky (taken by Tripp). That was also not hearsay.

No, no, NO! Clinton was impeached for committing felony perjury, and because of incontrovertible DNA evidence in contradiction of his claim, made under oath, not to have had sex with Monica Lewinsky. An investigation can begin due to hearsay, but conviction requires proof.

Earnest Prole said...

Her point is bullshit. Tripp taped her phone calls with Lewinsky, which means the evidence was not hearsay.

That was FUN!
They talk about how there was THE REAL CHANNEL with Taylor, and The Patriots
And opposing them, was:
This WEIRD Channel, THE SHADOW GOVERNMENT, consisting of The President and his people

It's no longer "there isn't a Deep State"; it's they ARE THE REAL CHANNEL
as opposed to THE SHADOW GOVERNMENT, consisting of The President

I've heard deep dark rumors that prisoners at Gitmo are forced to watch "The View" 24/7.... not sure if there are any group of people evil enough to do that, but if it works...

Bruce Hayden said...

“It wasn't hearsay-hearsay.”

In addition to the tape recordings, her testimony about what Lewinsky said to her probably was not hearsay because it wouldn't have been to show that Lewinsky had had the affair, but rather that Lewinsky had contemporaneously told her of such, corroborating her story. It was a present sense impression recorded, introduced to show that Lewinsky had said it, and not that it had actually happened. It very likely falls into one or more of the FRE 803 hearsay exceptions.

"Whoopie looks weird. I mean, really weird."

It's horribly heteronormative of me, but when discussing serious issues it really pays off to have a serious appearance and demeanor. The Wavy Gravy school of public debate has some profound shortcomings. Nevertheless, I delight in watching the ideological allies of the oddballs uncomfortably pretend that there's nothing unusual or off-putting about them.

HoodlumDoodlum said...

I don't think that's making the point they want to make.

Tripp's testimony was hearsay. It was also dismissed, by pretty much everyone, in part because it was hearsay. If that had been all she had it wouldn't have meant anything. The physical evidence was the only reason anything came of Tripp's accusations.

MadisonMan said...

Linda Tripp was mocked on SNL pretty mercilessly. John Goodman played her. I await a similar job on "the whistleblower".

wendybar said...

Ignorance is bliss...how The View is considered part of the ABC News division, when they don't know what the hell they are talking about, is beyond me. Clinton got impeached for lying, not for having sex with Monica.

MacMacConnell said...

No Linda Tripp wasn't there for the blow jobs or the cigars, but she had tapes of conversations with Monica, then there's the blue dress and Monica's testimony.

Dave Begley said...

Where is the blue dress? I think it should be in the Smithsonian.

Dave Begley said...

Washington Examiner, November 13, 2018.

"Monica Lewinsky said that she initially didn't realize a semen stain was left behind on her dress from her hook-up with then-President Bill Clinton, a dress she then wore out to dinner.

“I went to dinner that night. None of these people said to me, ‘Hey, you’ve got to go to the bathroom, you’ve got stuff all over your dress,’” Lewinsky said in the new A&E series, “The Clinton Affair,” according to the New York Post.

In her testimony in 1998, Lewinsky said she thought the marks on her dress “could be spinach dip or something.”

Yancey Ward said...

This is why the media has no respect- they lie relentlessly.

Tripp had recordings of her conversations with Lewinsky- so not hearsay.

Tripp had recordings of Lewinsky trying to suborn perjury.

As far as I know, Tripp never testified at the impeachment trial. I am still trying to confirm this, but even if Tripp did testify at the trial, she still had the recordings, so still not hearsay. Additionally, by that time, we already knew Clinton had lied about the affair because we also had his semen confirmed on Lewinsky's dress.

Yancey Ward said...

HoodlumDoodlum is correct- until Tripp came up with the recordings, no one took the story seriously. The same thing is happening now with the Ukraine Hoax.

The hired gun for Schiff, Daniel Goldman, is doing all the testifying. I am listening to his questioning of Marie Yovanovitch and all his questions are calling for an answer of "yes." Of course, the media will say that her testimony was significant. But was it?

rcocean said...

Morons on parade. Clinton was impeached because he lied under oath. He committed perjury and tried to get others to commit perjury. Clinton was NOT convicted because of "Hearsay" - he was convicted because Ken Starr proved Clinton and Lewinsky had sex in the oval office, and had tried to get others to lie for him. Under oath. Tripp's notes and recollections, were confirmed by all the other evidence.

Here we have Bill Taylor saying a staffer told him that he "overhead" Trump say phrase in a cell phone call with Sondland in a Kiev restaurant. And both men deny they said it. Which bring up the question, why is Sondland talking to Trump in a kiev restaurant?

rcocean said...

This is zero question that Billy Bob lied under oath, committed perjury, and tried to get others to commit perjury. The Senate found him "Not Guilty" because they didn't have the guts to remove him.

The result is that we know have Bureaucrats and Pols lying to Congress or the FBI IG - under oath - and if they're D's then its "What the big deal?" and the DoJ refuses to prosecute.

"The View" current hosts know about as much about hearsay as Rosie O'Donnell did about how the WTC buildings collapsed: "I do believe that it's the first time in history that fire has ever melted steel." Take their comments for the level of knowledge they've already demonstrated: none.

But I get it. When you're party is rife with wrestling coaches committing sex crimes that prey on kids like Foley, Jordan, Hastert, etc. do, it must be really important to pretend that you're the consensual sex crimes police. Very important to look busy.
