In the meantime, here are various reactions to the first debate.

So about the Census/Citizenship question case; I know that several commenters wanted to talk about it, and I was sympathetic, but Althouse handled her moderation very well in the blog post about the redistricting case and shut it down.

I expect that she will welcome it here.

And I think there is a growing conservative consensus, that the result was a bad one, and even a surprisingly bad one. And that the further consensus is that the decision was a peculiarly bad one for Trump, and not merely the issue of executive branch power over the operation of the census, free from judicial second-guessing.

David French makes this observation at National Review Online; that it was Trump Administration chaos that lost a winnable case:

https://www.nationalreview.com/2019/06/why-trump-lost-the-census-case/

And Michigan lawprof Sam Bagenstos makes the same point more directly in a Tweet:

https://twitter.com/sbagen/status/1144256005372633089

It is a point that I agree with. I don't like the result. Had I been on the Court, I think I'd have ruled for the Administration. But the Administration seemed to have done its best to screw it up.

narciso said...

You are so tedious, you want to devalue citizenship you do what this court did, that they got a head start collecting data, one needs to start early because the left throws minefields left and right. Its ridiculous to think that a legitimate function which btw the Obama administration had appropriated by bring the census into the White House, can be derailed like thar

Genuine question: I’m seeing in my social media feeds all the Concerned Moms posting approvingly about the growing shaming movement of companies doing business with the detention centers at the border, starting with Wayfair and now snowballing. So-exactly how is CBP supposed to care for these people humanely, which is supposedly what everyone is shrieking about, if companies are allowing themselves to be bullied into not providing the supplies necessary for this care? I want to ask this question on Facebook but don’t want the headaches.

P.S. Bank of America was a terrible company before this and I already refused to do business with them, but this seals it for me. Assholes.

"Genuine question: I’m seeing in my social media feeds all the Concerned Moms posting approvingly about the growing shaming movement of companies"

Psychologically, mothers are not thinking about practicalities. They are horrified by the picture of the dead two year old girl and reports of kids under the age of 7 w/ no adult childcare in CBP custody. They don't understand why toddlers and elementary age kids are in detention with no volunteer supplies allowed . They don't know the difference between CBP and ORR.

I'd guess those beds aren't for the CBP but for ORR.

On facebook -- no stories about those beds. But I'm seeing mothers asking how they can foster the kids. Some are asking how they can send baby formula and diapers and clothing. They are asking who they can contact and offering to fly down to get the kids so they can take care of the children. They don't know it's CBP detention. They don't understand why they can't foster through CBP and CBP will not accept supplies from volunteers.

They're hearing stories of sick toddlers being cared for by 11 year olds. So they want to help. When they are told they are not allowed to help, they get distressed, because of the news stories of young kids w/ out adult child care or basic supplies.

However, all the candidates promising free healthcare to illegal immigrants is basically telling the electorate to fuck off. This will not win votes in the general election. My feed isn't talking about Wayfair. On my feed they're upset and freaked out by the reports of young kids, asking how to foster kids and where to send money. They're upset that donations aren't being accepted. But no Wayfair convo.

Why people are talking about Wayfair is anybody's guess. My guess is that people are flipped out by the reports of the young kids. They want to do something or see something done because they feel powerless to help these kids. Something is happening with Wayfair so they direct attention that way.

I Have Misplaced My Pants said...

*yay Wayfair walkout, that should be

Also I want to ask are you ladies not aware that these are not necessarily unknown conditions for these kids, hideous as they are and as much of a tragedy as that is? Did you know there is a third world? Did you know there are children suffering identical maladies right this minute not at the border and always have been? And what is the number of people we can absorb? Five million? Ten million? You want to foster a kid or three, that is great and my hat is off to you for putting your money where your mouth is but can you take ten kids? Fifteen? What is the long term plan for these children? What if their families cannot be located or are dead back in Nicaragua or the children were trafficked into this country? Then what? I know it is so sad to see that photo of the little dead toddler and I am a total ghoul for asking logistical questions about the border with a photo of a dead toddler circulating, but you know that toddler could have drowned in a river in Honduras and you’d never know or care about it and does that make you a ghoul too? Are you a ghoul because you shared that photo and then went back to shopping for cute flats from Zappos? Are you a ghoul because you aren’t all riled up about the children who are being abused by their parents literally right now in your own town?

Hardin gets on my last damn nerve but he is correct that women often cannot think in systems as is evident by how my friends are approaching this (summarized as: ‘give me those kids and I will cuddle them’) but not all women can’t think in systems or extrapolate out knee-jerk emotional responses to things. We’re just ostracized by our sex if we do.

Man, Drago, you are really upset by my mommy facebook friends. Note: I write nothing political on facebook. That includes this subject. I stay out of it.

I will say, I note when my carefully cultivated facebook feed becomes political in any way.

As for E. Jean Carroll. I've got a right to my own opinion. You know I am against divorce and unmarried sex. How d'you expect me to react to a story in view of Trump's three marriages and his constant adultery? What did you expect my reaction to be? Don't be shocked that a woman who is against ALL divorce and ALL sex outside of marriage is unimpressed with Trump's sexual history. I don't harp on my views about divorce and adultery but you should not be surprised at my reaction. This guy went on Howard Stern to talk about his sexual escapades. I knew what I thought of him, as a man, before he ran for office. I view his sort of behaviour as part of a trend that causes abortion, pain, and busted up families.

Now, you've got a right to see Trump as a upright moral guy who would never cheat or never do anything like that. That's fine. I can' see that reasonable people can have different opinions. Anyways almost everyone agrees with you on this blog that Trump never met her and she's a liar. So be content that 99.9% of all of your fellow commenters agree with you.

I’m pretty sure she’s not the kind of mom who would drop everything to go foster in Mexico. But I accept that you have different friends.

I dislike commercial banks in general, Bank of America in particular. Commercial banks in general because of the 1980s. While interest rates for Americans trying to buy a house were over 15% commercial banks were lending money to South American dictators at 4-5%. BofA, of course, was one of them.

BofA in particular because when the military first started requiring direct deposit- BofA, alone among banking institutions, put a 5 day hold on everyone's paycheck sent directly to them by THE FEDERAL GOVERNMENT. And bounced everyone's checks who thought their money was in their accounts, and then charged bounced check fees.... They did this for 2 or 3 paydays before the feds told them point blank- you WILL deposit the money in accounts on payday or we're no longer using BofA for any government business, and we're not authorizing any direct deposits of allotments to BofA for any reason. They reluctantly started depositing the money onto servicemember's accounts- at 2359 payday. My one credit union puts it in at 0001; I just transferred money from today's deposit into my checking to a loan account. My other credit union puts government checks in when they get them. Usually the day before payday. Sometimes a few days before.

The funniest part, to me, of the Roberts opinion in the census question case was the mention of the utterly shocking information that the secretary seemed to want to add the question from the moment he took office--that he started working on accomplishing that only a few weeks after he started.

Oh wow, what a smoking gun! A political appointee came into office already having an idea of something they want to do and once in office found a method to accomplish that thing using the proper methods!? This has to be the first time something like that has ever happened--I'm glad Roberts was able to highlight such a rare and unusual occurrence.
