If you read Prof. Cassell's analysis on the Volokh blog the other day, you would realize that depending on what the facts are, this case could be one of second degree murder, involuntary manslaugher, voluntary manslaughter or justifiable homicide. To the extent the facts are in dispute (e.g., by credible witnesses offering different stories), then a fact finder will have to sort them out. You seem to have decided what the facts are but you can't even answer the questions I raised in my first post above. Claims about social facts ("black people often face discrimination"), even if true, which is far from obvious, are irrelevant to the guilt or innocence of the policeman in this case.

and this is the problem with both this issue and blacks view of this issue. Whites not working at MSNBC or pushing the lefty worldview want a fact finder to sort out the facts. If the officer shot him in cold blood they have no issue with him going to jail, if Brown bum rushed him it might be justifiable homicide. We want all the facts and want to judge the facts fairly.
