Has he sued the DOJ yet? Not that I can see.
As a private citizen, not even a declared candidate at that point and with some doubt about whether he would run, he made an "Administrative claim" to the DOJ under the 1946 Federal Tort Claims Act.
I think he is entitled to make the claim and have it processed. My feeling is that he should get paid some or all of the claim but I really don't know the facts of law of the case so could be wrong.
I also agree that it is not a good look to be making a claim against himself. Perhaps he needs to convert the claim to a lawsuit and kick it to the courts as an independent arbiter.
