Kimmel still has X and social media, he can start his own podcast or instagram. He can publish on any website that will host him. He is free to work for any company that hires him. Congress has not passed any law to restrict his free speech.

Carr and the FTC should have left this action to cancel Kimmel appear to be solely business related--driven by affiliates reacting to the anger of viewers. By making it appears as a response to government pressure, it unnecessarily brings in First Amendment issues, and makes much of the politically middle uncomfortable. A political foot-fault-- it didn't need to happen this way.

Mollie Hemingway points out today that FCC licenses explicitly prohibit "broadcasting knowingly false information and hoaxes" but the real pain point was station owners, who are just tired of broadcasting the shit that Corporate Disney shovels out through their pipeline. The affiliates have all the right in the world to say NO to any programming from ABC other than emergency broadcasts.

The parallels to threatening people’s employers and demanding they be “called out” are unmistakable.

What makes this particularly dangerous is the speed and brazenness of it all. We’re watching an administration openly abandon constitutional principles while wrapping themselves in the flag of freedom. History shows us exactly where this leads, and it’s never anywhere good.

Maybe you should read their charter then. As someone who had an FCC license I am well aware that there is a LONG list of dos and don'ts to follow. They range from prohibiting drug and alcohol use by on-air talent to life and death issues.

While I agree that there is a a possibility that ABC pulled Kimmel due to pressure and worry about FCC action, there is also a very real possibility that ABC is just reacting to normal market forces. Nexstar owns various ABC broadcast stations across the country. They are in hundreds of markets. Outside of a few, fairly blue markets, Jimmy Kimmel has dwindling appeal because of his far left tilt. Nexstar makes money on selling ads. If they can't get as many viewers they can't sell ads for as much as they could have otherwise. It is also worth noting that ABC is now promoting a new Tim Allen show, (from Home Improvement in the 90's). The fact that promos are running for it now means it has probably been in production for over a year at least. This seems like an effort to attract viewers with programming that isn't overtly Left wing. And since it's likely been in production for a while it shows ABC has been concerned about political tilt on it's programming for some time.

Here is a clip where Carr was talking to Benny Johnson. Carr. This to me at least sounds like a threat of FCC action. If this was the actual motivation for ABC, I don't know. As I mentioned above there are real market justifications for ABC to take the action it did.

The current chair saying the FCC "might" have a say in the matter is not a threat. It is true according to their charter, and he specifically mentioned "hoaxes" as written in the law. However, "If you do business with gun sellers your bank may be categorized as a 'risky' entity by the Fed" truly is a threat and Obama carried through on the threats.

Try not to freak out over an administrator stating the lawful parameters of his agency. More of them should be required to speak like this so we know that THEY know what the hell they are doing.

I'm not blaming Carr. I've read your other comments upthread and I take your point about the FCC's aegis generally, but there's also the matter of narrative. Nexstar pulling the plug on Kimmel is business and smart business; my belief is it wasn't necessary for Carr to weigh in on this, even he was asked the question on a podcast. Why give your opponents any talking points? Nexstar's move was already likely to doom Kimmel anyway.

I think the criticism of Carr is apt and appropriate. I’m saw what Kimmel did and thought it was disgusting considering the news was already out countering his claims. I have no doubt that Carr can lawfully pressure ABC for Kimmel’s conduct, as I am certain the Bondi could elevate charges based on “Hate”. That doesn’t mean I agree with them doing so.

That is, unless there is another game being played (which I doubt is being played). That game would be the Trump Administration purposely using these tools to have them struck down as unconstitutional, so that these laws and regulations are permanently removed as a political weapon.

While I do think Carr's statement sounds like an implied threat of action, it doesn't mean the action taken would be illegal or improper.

This is all the consequence of allowing massive media consolidation. Those media behemoths will need approvals from the federal government one day, and with a petty, corrupt government, pressure can be easily applied to stiffle dissent.

Nexstar's statement should have read “it strongly objects to recent comments made by Mr Kimmel concerning the killing of Charlie Kirk, since we know President Trump doesn't like Kimmel and we need FCC approval for a merger”.

Presumably ABC has been looking to can Kimmel for the same reason that CBS canned Colbert--it's a ratings loser that is sucking money. Kimmel's moronic comments (something new and different!-sarc) gave ABC that opportunity.

Trump has been arguing that a broadcast license is not carte blanche to make billions and spew political propaganda--it's supposed to promote the good of the USA (really!). In the age of cable and streaming, there is no longer the strong First Amendment claim to entitlement to a broadcast license regardless of what you put out there.
ABC is in a box--cut Kimmel and look like you are doing Trump's bidding, or take a "stand" for Jimmy Kimmel and continue to lose millions. 80/20.

You have a limited understanding of social contracts.

If people get Rights without corresponding Responsibilities then the social contract will fail.

If we extend First Amendment protections to people whose only goal is to use that freedom to take our freedom and kill us then the First Amendment means nothing.

You can only apply the First Amendment to people who will apply it to you in return.

Kimmel is like idiot who yells "fire!" in a crowded theatre; he wants to stir-up rancor and dissent. He's also promulgating obvious fake information, with intent to inflame his few remaining viewers - preaching to the choir, as it's known. That said, Kimmel's not funny nor entertaining. He has exhausted his comedic material. His show's declining ratings compels Disney to make business decision to cut a failing show. Now he can become a podcaster, like Don Lemon...

Leland: That is, unless there is another game being played (which I doubt is being played). That game would be the Trump Administration purposely using these tools to have them struck down as unconstitutional, so that these laws and regulations are permanently removed as a political weapon.

I also have my doubts that this is the intention of the Trump administration. But as long as it is the result, I don't care.
