That comment presupposes that Trump will again assume the presidency (after being the lone survivor of the Republican primaries) and not have any legal problems as he will pardon himself.

2024 is going to be lit! I'm pretty sure the GOPe will figure out a way to disqualify Trump. If not, let's hope he can give his nomination speech from prison.

So...Biden's supporters fully denied or ignored the Hunter laptop story just before the 2020 election. Press Secretary KJP has adopted the persona of "Baghdad Bob" from the first Iraq War in denying the obvious about Hunter and Biden and bribery.

I suppose the Republicans will also simply ignore the grenades thrown at Trump until the election. Unless...Trump and/or Biden pass away from old age or from drinking poisoned wine.

Maybe, just maybe a judge would be concerned about the appearance of a political prosecution, in keeping with developing countries traditions. For one, It would make the fight for the hearts and minds of the next invaded, a hell of a lot tougher when precious political capital at home is spent attempting to send main political rivals up the river.

There are threshold legal and constitutional questions that will have to be resolved before a trial can even begin. Some or all of those questions may require decisions by the US Supreme Court, not the most speedy of institutions. The May 20, 2024 deadline takes none of that into account. In addition, the DOJ has a rule discouraging trials that may affect an election from starting within the 90 days before such an election. All of that does strongly suggest that the Trump documents trial won't begin until well after the 2024 presidential election has already been decided. This probably will also be the case for any trial relating to the events of January 6th.

We know the evidence. You just ignore it. Like the comment about what is above the fold in the NYT, or on the View, in another thread today. Besides, attorneys have no obligation to bring out the other side’s evidence, or make the other side’s arguments, in court.

The plan is to eventually bring charges against Trump for J6. They will then try and disqualify him from being able to run under the 14th Amendment Section 3. I'm sure Karl Rove and Paul Ryan are in on this. Sadly, this seems to be what DeSantis is banking on.

The rest of the GOP field (Christie, Pence) are just in the race to throw darts at Trump during the debates.

The civil case by E. Jean Carroll was exceptionally weak and that special statute of limitations violated due process.

Trump was a dope for walking into that January 6 mess. He was set up by the Dems. He should have known better. As to the documents case, another case of Trump being stupid. That being said, it's not against the law to be stupid as otherwise you'd be in prison right now. LOL.

I will vote for Trump if he is the nominee although I prefer Vivek.

It is unlikely that this is an accurate account of Dave's position, since there is no reason to believe Jim understands the legal nuances involved. E.g., Trump may have defenses available that Biden does not.

The big "no surprise" here is that Jim, like most lefties, is evidently a fan of discriminatory prosecution that furthers the causes he supports. One of those causes being the selective targeting of QuidProJoe's opponent in the upcoming election. Trump's first impeachment was all about that, was it not?

As always, leftist hypocrisy is palpable.

I think do care about the evidence found on Hunter Biden's laptop. You know, the evidence that has been verified as being Hunter Biden's despite the Biden campaign convince members of the intelligence community to sign a document lying that it was Russian Propaganda. Isn't fraud the crime being pinned on those electors? Why not prosecute the people that signed the false statement presented to the American people that Hunter Biden's laptop story was Russian disinformation. There is evidence they colluded to commit the fraud.

The evidence on the laptop is corroborated by IRS agents that investigated the Biden's receiving money from foreign agents. These agents attempted to question the Biden's on the failure to report this income and other irregularities but were blocked by members of the DOJ. Other people have corroborated attempts to block the prosecution of Hunter Biden.

And this is before we get to the fact that Joe Biden had illegally retained dozens of classified documents from his time as Vice President in various unsecured places across the United States including a Chinese funded office and his garage.

With the normal procedural delays likely to come by Spring of next year, all of the primaries will be over before the trial begins. This was a clever solution by the judge for the main problem of interfering with the political process. By the time of the trial's beginning, we will certainly know who won the nomination as determined by the primary voters themselves.

The Babylon Bee had a headline a few days ago that Trump was just one more indictment away from sewing up the nomination. Almost close to being true.

The prosecution deserves this. It is a purely political prosecution, that they wanted done before election year, to harm Trump. But then they started fucking with the defense, not allowing them to see a lot of important stuff because it was classified, or national defense information, etc. Remember, the deputy special prosecutor, controlling the prosecution, from the very beginning, long before Smith was appointed, is Jay Bratt, whose other hat is as the branch chief of the Counterintelligence and Export Brach of the FBI, sister organization to the FBI’s Counterintelligence Division, where Strzok, Clinesmith, Priestap, etc worked, the ones who didn’t investigate Crooked Hillary, but did catch Gen Flynn in a bogus perjury trap, initiated Crossfire Hurricane, knew that Steele’s primary subsource had made up his Dossier around a bar in Georgetown, but used those dossiers anyway to file 4 fraudulent FISA warrant applications on Carter Page, presumably to be able to electronically surveil Trump and his inner circle. Brat’s branch signed off on each and every one of those warrant applications. And the real target of the MAL raid was very likely the binder of classified documents implicating those two organizations that Trump ordered declassified. Yes, it was Bratt who was giving orders to the Archives, who refused to give Trump’s attorneys time to respond, or allow rolling discovery, then used their failure to comply to justify the search warrant for the MAL raid, that he personally signed. IT was his lawyers who cobbled up the entire LawFare prosecution (as they did earlier with Flynn, etc), felonizing stuff that hadn't ever been a crime before. And importantly, those two organizations control much of the classified information in the DOJ/FBI.

The prosecution has a big problem now. The case is likely to be delayed a bit here and there, pushing trial into the fall. With someone with middle class decorum, this might not be that bad for the prosecution, but we are talking Trump here. Every misstep and overstep by the prosecution will be trumpeted by him to his audiences in rallies around the country. The prosecution will likely ask the court to muzzle him. Not going to happen - not in the runnup to a Presidential election. Remember, they are the ones demanding trial before the election (rationally fearing a pardon his first day in office, as well as a mass firing of all involved). Every misstep by the prosecution is going to cost the Dem nominee votes. Probably a lot of votes. And they probably can’t force the judge to accelerate the trial. It’s her docket, and it’s her discretion how to handle it. This is fairly sacrosanct with judges. About their only hope now is to force her off the case, so expect that to be their big push now, and then get a compliant, Dem nominated, judge to replace her. Not going to be easy, and that too will be used by Trump to show corruption in the judicial system.

Yes, Trump nominated the judge to the bench. But she seems to see through a lot of esp Bratt’s nefarious maneuvering. He got himself in this mess by exploiting his position controlling much of the classified information in the DOJ/FBI. It was his decision to set this up, and then hinder the defense by fighting them for access to the documents and other information they need for a fair trial.

It is clearly not written by a lawyer; at least, it's not lawyer-language or lawyer-thinking.

If anyone really wanted an interesting quote on the upshot of the trial date, I'd look to Andrew Weissmann, who has followed the case as closely as anyone who isn't counsel of record, and who probably knows more about the relevant law and procedure than any of Trump's counsel of record.

Except that it is a “don’t throw me in the briar patch” type of splitting the difference. In my view, a trial in late summer or fall of 2024 is probably the best thing that could happen to Trump’s election campaign. He could, and no doubt would, trumpet the corruption in the FJB DOJ and prosecution in every speech. Then, quite possibly, he could take time out from campaigning to attend trial. He would breeze in with his entourage of Secret Service, family, and campaign aids, then, leaving taking the opportunity to again push the corruption to the awaiting press.

The loads of evidence against the "big guy" There is a thing called an indictment. Is there a draft/proposed Biden indictment floating around somewhere that someone could point me to, so I can examine the alleged evidence for myself? Remember, evidence not conclusions. What will he be charged with? What is the key evidence as to each element of the offense? Anyone have such a document I can look at?

There is an intent requirement. There is also a criminal investigation by special counsel. If the prosecutor determines the evidence shows that Biden knew he possessed confidential information and did not return it, go ahead and prosecute the guy. He should be prosecuted.

As for Trump - he knew he had the records, he refused to return them upon multiple requests, he lied and said he didn't have any more records when he did, he tried to get his attorneys to lie for him, he casually showed top secret records to those w/o clearance, he hid records from his own lawyers. And on.

These things do not appear to me to be the same. But as I said, let's see what comes out of the investigation of Biden.

It’s good for Trump but I think this is also good for the prosecution, as they need room on the calendar for the J6 trial to go first. The judge will hold this trial in May or June if she is the Trump lackey she is suspected of being. That gives her control - through jury instructions and directed verdicts if need be - without Trump having to pardon himself. The problems for a re-elected Trump with a self-pardon are that he can’t be sure he’ll win the 2024 election (50/50 at best), he’ll likely be impeached for granting a self-pardon, it would become a cudgel to use against Republicans in the 2026 election (if Trump allows us to have one), and he can’t be sure the Supreme Court won’t throw out his self-pardon.

I did quite a bit of federal civil work, but dealt with enough baddies that I sometimes bumped up against the quiddities of federal criminal trial setting. What the judge has done is set the table for the April 2024 hearing on the motion to continue. The world may look different in 8 months. We can only hope.

Maybe the trial won't go in May, but the defense will have to prepare as if it will. Makes a huge difference when they can't brush it off as something that will happen after the election, if at all. The April motion that makes the most sense is that the defendant at that point is not fit to stand trial.
