Aggravating factors.

"Donald Trump’s retention of documents marked classified at his Mar-a-Lago resort has aggravating factors that might support his criminal prosecution unlike the discovery of some documents also marked classified stored at Joe Biden’s former institute from his time as vice-president, legal experts said."

I'm reading "In the case of the classified documents, it’s more serious for Trump than Biden" — in The Guardian —  and laughing.

The aggravating factor in the case of Donald Trump is that he's Donald Trump.

It is not the aggravating factor that as President he had authority to declassify the documents as he claimed, because that would mean the story is over.

Of course the local news this AM emphasized that, although this is a serious matter (see Trump), the Biden Administration is cooperating - no, fully cooperating - with the investigation.

Nothing to see, just move along ... except for how Trump can be dragged into this too, if only for comparison purposes.

One of the two had the right to declassify documents when they were taken, and one did not. And that is certainly aggravating to those that wish to prosecute (or should I say persecute) him.

This is crazy. Neither Trump nor Biden ever lost their security clearance. What they know in their heads from just being President is a far greater security risk bs classified document. If they wanted to commit espionage or treason they dont need dome over stamped memo to do it.

Add to the fact that Biden is POTUS and has access to whatever he wants. He can order copies sent to his current office of whatever they found at his old office.

These incidents prove that the inmates run the asylum. No fan of either man but the hysteria over Trump and the whataboutism over Biden should be ridiculed.

Every time I see the phrase “documents marked classified,” I picture the Ministry of Magic, where the markings might magically disappear if the documents are unclassified. As though “marked classified” is synonymous with “classified.”

Why don’t they just say “classified”? Oh, right. Because they don’t know if they are classified, so they just dishonestly impute it. Make it their readers’ fault if the documents turn out not to be classified.

"Whataboutism" is a lefty shibboleth, it's a tell that you have taken sides. Joe Biden did not have the almost absolute right of declassification when he purloined the documents, which incidentally, had to do with Ukraine, where, as we all know, though some of us refuse to admit, he was up to his neck in graft.

There is zero evidence that any documents found at Mar a Lago had anything to do with proven graft.

I worked for years with "classified" materials in the military. Here's a little secret about such things: The amount of sheer useless crap that qualifies as "classified" is mind-numbing.

Say, for example, that I use the classified side of the military computer network. Which is kept under lock and key, and treated like the high holy font of all knowledge. Wanna know something "interesting" about that? There's a ton of stuff on that network, which is automatically "classified", which is open-source and available over on the other, unclassified part of the network. It's there for convenience, while you're doing research. Yet, any work product from that research remains classified until someone who is authorized declassifies it.

And, some of the most useless crap imaginable gets classified. Say someone asks me to verify clearances for a list of people... I go into my vault, produce that document on one of the classified computers on the classified network inside that vault, and then I'm screwed 'cos that list is now, by virtue of where I did the work, classified. You can't take that file off the network and then put it into an unclassified computer to print. You often wind up having to air-gap the whole thing and have two computers working, one where you're producing the unclassified document and then another classified one where the information is that you're verifying.

The rules are arcane, an entirely nuts, from some perspective. The volume of essentially meaningless information that winds up classified because of those rules is insane, which in turn leads to a lot of problems with "leakage" because that mass alone becomes a reason people don't pay attention to the rules.

We're not even getting into cases where they classify documents in order to keep them out of the public eye. There's stuff that I've seen that was produced from entirely unclassified open sources like newspapers and so forth, but the resultant document had "secret" slapped on it. The only possible reason I could imagine them doing that was because they didn't want people knowing that the questions had been asked in the first place. Either that, or there was some flim-flammery going on with regards to copyright...

So, when you hear these idiots railing about "classified documents were found", be aware that said classified document could represent something as inane as a digest of news reports from the New York Times that was produced because some idjit asked an intel analyst "Hey, what does the New York Times publish and editorialize on this issue?"

I had three-four filing cabinets full of "classified documents" when I ran a brigade-level intel shop. Out of all that mass of paper, I'd honestly have to say that only a tiny fraction was really worth classifying, things like the current Operations Order for whatever our deployed sub-units were doing in Afghanistan or Iraq. The rest was just stuff I had to keep on hand and retain for set periods of time. Huge time-waster; you had to screen everything and then dispose of it on set schedules.

I have to say that the biggest disappointment of having that job was the sheer boring waste of time that the classified documents represented. Most of those file cabinets and hard drives could have been shredded without any repercussion, whatsoever, but because they'd once been classified, they were always classified. Declassifying documents is a bloody nightmare to get done, and you're really better off keeping them all on hand, and then shredding them when the "freshness date" on the retention requirements passes.

Now, even the Washington Post is saying it’s not true!

When Mueller came up empty-handed in 2019, disappointed Democrats still insisted that Russia had used trolls or bots on social media to steer the election toward Trump. Yet, the Washington Post’s Tim Starks reported on Monday (emphasis added), “Russian influence operations on Twitter in the 2016 presidential election reached relatively few users, most of whom were highly partisan Republicans, and the Russian accounts had no measurable impact in changing minds or influencing voter behavior, according to a study out this morning.”

I'm still stuck on the Penn Biden Center. Who knew a 'think tank' could be named after someone known for his lack of intellect?

Anyway- now we know the Penn Biden Center has been well funded, to the tune of millions of dollars by the Chinese, who told Biden way back when...that they could be like the Clinton Foundation, but without the fundraising needs. (the Chinese could bankroll the entire thing). Good to have friends in China. And Ukraine. And Iran??

It's interesting that the classified docs are regarding China, Iran, and Ukraine. Also interesting that Biden spent his last days as Veep flying over to Ukraine. No one does that. Especially then. Ukraine was nothing. A corrupt government with nothing of interest to the US...except for Joe, Hunter, and Jim Biden. They had an interest in a gas company there. And Joe went there, as his last act as Veep, to get the prosecutor investigating Hunter, removed via threats from the US. He was misrepresenting the USA and threatening Ukraine with loss of funding (back then) if they didn't remove that prosecutor. And we've all seen his pompous recount of that visit.

NO ONE as Veep visits a low priority country in their last weeks. Even the Ukrainian press was confused by all the attention they were getting.

And now we've sent BILLIONS of dollars and arms to that corrupt government, telling ourselves that we're weakening Russia by doing it. Really? I suspect we're paying back Ukraine for Biden's grift on that gas company. And who gets weakened by this? Russia was already weak. They are in the last throes of an aging oligarchy. A drunk and aging nation where the young clamor to leave. We weakened ourselves with all of this. Spent billions that we do not have, and now another generation further down the road is in hock before they are born. We seriously depleted our own weapon stocks. No problem for Lockheed Martin, Raytheon, Boeing, Northrop Grumman, General Dynamics, etc. and the politicians they pay. And as the war we have paid for continues to drag on, there are the unforeseen circumstances that await us.

We don't know what Trump may have taken. But we do know there is so much staring at all of us from Biden's corrupt recent past and present. And all of the 'everybody does it' I'm now hearing from the press is glaringly short of answering the questions. That the Biden team suddenly decided to open this locked cabinet and- Voila!- found these docs, just after the House turned Republican, smells of trying to diffuse what they hoped would never come out.

It's out now. Let's all have a look, shall we?

Broadly, the Department of Justice has typically pursued prosecutions when cases have involved a combination of four factors: wilful mishandling of classified information, vast quantities of classified information to support an inference of misconduct, disloyalty to the United States and obstruction. The criminal investigation into Trump touches on at least two of those elements – obstruction, where a person conceals documents with an intent to impede a government agency, and the volume of classified materials at Mar-a-Lago – unlike the Biden case, which appears to touch on none.

The Justice Department has stated it believes Trump kept the documents as mementos and not for disloyal purposes. The volume of documents Trump kept is unlikely to trigger prosecution because as president he had access to a wide range of classified material. That leaves obstruction as the sole avenue for criminal prosecution.

I'm with Michael K on this. No one should trust anything that we are hearing from the Security State on Ukraine. It might be true, but it also might be false. We can be sure that it supports the Security State agenda, which usually does not include peace.

Is it really in the interests of you and me to spend billions to bleed Russia white? It is not the USSR any more. What about the Europeans? Where are they? The Ukraine is their front yard. They are rich, too. Why don't they step up further?

Our power structures yearn for the days of the Cold War. But that was settled in the 1980s. What has happened since is the product a failure by successive US administrations and the Europeans to integrate Russia into Europe. Ukraine is a plaything for both Russia and the US. Obama was a captive of the the three-letter agencies because of his inexperience (see JFK and the Bay of Pigs invasion). Trump was a fool to stumble into Ukraine with that telephone call when he knew nothing about what was going on there. The Bidens are bought and paid-for. The Iraq War/Afghanistan was a revelation. Twenty years of futility with no goals.

Hillary Clinton had classified information in her possession on a private server, I understand there are normally classified documents among Obama's 11 million document library. Neither Hillary Clinton nor Biden had that power.

Assuming you are correct, is that a justification for Russia's invasion? Is that a reason for us to do nothing now? The stability of Europe is critical for the U.S. interests economic and otherwise. I recall that the last two World Wars started in Europe. A stable Europe means we can focus more of our attention on China. And if we allow Russia to eat up Ukraine and take control of its vast resources, do you really think they will stop there? Russia is the biggest country in the world but for them it is never enough for them.

I also had a Top Secret/Special Access Program clearance for several projects. In some projects, we could downgrade documents to unclassified status as long as two subject matter experts agreed and filled out the proper forms. We could write CDs with the documents, but the documents had to be plain text or jpgs. No Word, Excel or Powerpoint files because text could be hidden with the proper formatting.

For other programs, downgrading was forbidden and no CDs could be written. Anything electronic content brought into the program spaces could never be removed.

Cell phones were forbidden, even turned off phones because of the possibility that the microphones could be turned on without the owner ever knowing that. Lockers were provided to store the phones while we were in the program areas. Even so, sometimes people would forget, and bring phones in. Bring a phone in could either be an infraction if there was no data spill or a violation if there was a data spill.

Hillary Clinton had an obligation to protect classified information. She didn't give a damn. It's unclear if she ever attended the training for handling classified information. She deliberately spilled classified data, which at minimum is gross negligence and is prosecutable, despite what James Comey said. She didn't directly hand over data to our adversaries, but her carelessness had the same effect. You can bet the Chinese and Russians had malware on her homebrew server. A server deliberately setup to evade the public records act.

So he sent his lawyers out to find some classified documents in his own possession from his previous stint as Vice President. What a clever way to release the pressure.

The Dems need Trump to run because he cannot win in 2024. That's why they pulled off the Biden classified documents caper. It is to give Trump a better chance of running because DeSantis scares them.

THere's a double standard in DC and everyone knows it. DC Juries will hang any republican and let any Democrat go for the slightest of reasons. The Federal Judges are stacked with partisan Demcorats. The DoJ, except for a thin layer at the top during an R Presidental adminsitration is 90 percent Democrat. We assumed the FBI was "Conservative" until TRump came along, now we know its like the rest of the DOJ.

So, Garland doesn't have send down orders to go after Republicans and leave the D's alone. The lower level DOJ/FBI does that on their own. Plus, the Republican Senators are complete wussies interested only in pleasing the big Donors. They never fight back or say anything. Or if they do, its a feeble effort that goes nowhere.

"Penn has received more than $50 million from anonymous Chinese donors...Were those donors peering at the classified documents, the national secrets, that Joe Biden had been stashing at the fake think tank that Penn set up for him?" - Tucker Carlson

Just to be clear, there is a request memorialized on Hunter's laptop to cut a set of keys for a Chinese "businessman" to have access to the office where the documents, containing classified information relating to China was kept.

I agree with everything takirks said about classification. However, sometimes looking at seemingly unrelated open information can reveal a very hidden piece of TS/SCI information. Requires connecting dots, abd requires realizing the dots can connected.

I had a theory about something, and found myself nect to an colonel who had a TS/SCI clearance. Explained my theory to him. He didn't even acknowledge hearing it. Just continued talking about our previous subject of conversation as if I had never said anything. After a sudden eye blink and visble head jerk. Confirmed I was right. I was retired from active duty by then, and my theory was based on dates and dot connections, all in newspapers, magazines, and on the internet.

The dullard weighs in:

Trump still needs people who will still see him as a lovable nutter. Don’t know if that is accurate in Althouse’s case, but it does seem to dismiss any seriousness of Trump’s misconduct.

Trump's "misconduct" seems to be defeating Hillary and withstanding all the left's attempts to find something illegal in his life. He was a good president in spite of all you ankle biters. Now you got your senile Potemkin President and the country is going to shit, rapidly.
