What is the crime of assembling a crowd to engage in sexual promiscuity?

I found this discussion in a 2019 blog post "Law and sexual repression in China" by Yinan Shen (Feminist Legal Theory):

According to Article 301 of the Criminal Law of the People's Republic of China, group licentiousness is a crime based on the view that assembling a crowd to engage in sexual promiscuity reflects public contempt for state law and social morality. Specifically, it refers to a gathering of three or more people (men and/or women) engaging in sexual activity and other promiscuous activities.

The activity of the participants must be voluntary. The state views such behavior as violating the public order. Those who gather for promiscuous activities shall experience criminal detention or public surveillance or imprisonment for not more than fives years [sic]. There has been much talk of the law being repealed.

Legal experts argue that there are no victims from voluntary group sex which generally takes place in private and hidden places and does not endanger public order. Why, then, should the law punish such harmless acts?

There are opposing voices say that these group sex acts can’t match the traditional Chinese morality. In my opinion, law is the lowest standard of morality. We can require the public to respect the law and use the standard of law. But we can not ask the public to act following all the traditional morality whatever it is correct or decadent....

Without knowing the facts or the law on rape in China, the fact that it’s China makes me wonder if this is Xi sticking it to Trudeau for that “leak” at the G20. It wouldn’t be the first time China arrested a foreign national (including Canadians) to get leverage in relations with that country.

Legal experts are not likely to make much headway using this argument in China. As the Chinese people and government view the chaotic and decadent culture in the West, defending traditional Chinese morality may seem like a worthy pursuit.

The Soviets were known to turn sexual freedom on and off like a faucet, depending on the needs of the state. I guess the ChiComs have never wanted the faucet open.For one thing, too many babies.

This isn't exactly China arresting John McLumberjack, the actual-not-paper Canadian.

Sick of decades of western media trying to stir up outrage over "our fellow nationals" being arrested overseas, and then nine times out of ten it's a Wu being arrested in East asia or an Abdul being arrested in the middle east etc etc.

Frankly every time our governments grant citizenship to someone who then goes back to his homeland and breaks their laws, the bureaucrat who officiated tying such a person to us ought to be punished.

The truth is hard to discern, but if he is guilty, then 13 years for raping 3 women, some of them underage, is not out of line with Western norms. How long is Harvey Weinstein in for?

I wonder if being convicted and jailed in China for such naughty behavior is more damning in the public mind than just being jailed for counterrevolutionary thought, i.e., opposing the ChiCom regime?

Sort of like Jerry Fallwell being busted as a hooker's John, rather than for fleecing $$$ from the credulous?

When your government has killed tens of millions to maintain Party power, and today imprisons millions for re-education based on ethnicity, what difference does it make what the stated reason is for imprisonment? The message is: "OBEY."

Well consider this is the story the Communist Party allowed out, no more, no less. So what the “reporter” said about what the “court” said is only what the Party is allowing to be said or printed. Note also this is exactly how Biden’s disinformation czar is intended to operate. This is a “how to” feature more than a “news” “story” and might in fact have no verifiable facts at all.

When I look up the French word it threatens to get even more confusing. If one keeps one’s imagination at a distance.

Who knew that there were 60's style "swinger" groups in China? Who knows whether they still exist in the USA. Never indulged myself although I had some acquaintances at the time (late 60s through early 80s) who said they did. Now my friends and I are all well aged out of that sort of nonsense.
