Republicans keep counting on the Rule of Law to save them, oblivious that the Rule of Law is dead. It's like playing into a rigged poker game to win your rent money back. They will let you win a few bets to keep you on the hook and cool the Mark so you don't werewolf. But it's a no win scenario.

Republicans promised we would only use violence as a last resort. And now as they cross off civil remedies and approach the end of the list, they search for any alternative, no matter how implausible, to avoid using violence as a last resort

I have studied and written a lot about RussiaGate.

I think that some officials in the FBI Counter-Intelligence Division began investigating Donald Trump in the late 1990s about his relations with Russian Intelligence and/or organized crime.

This investigation got a new impetus in 2012 when Trump made a stink about President Obama's birth certificate. Supposedly, he did so at the prompting of Russian Intelligence.

The investigation got yet another impetus after he declared his candidacy for the US Presidency in June 2015.

Some FBI Counter-Intelligence officials -- most notoriously Peter Stzok -- believed sincerely that Trump was compromised by and was colluding with Russian Intelligence.

In principle, such FBI officials were just doing their job. Some FBI officials do have the job of investigating evidence that Americans are secret agents of foreign intelligence agencies.

However, those counter-intelligence officials should be controlled by the FBI Director. Unfortunately, James Comey did not control them wisely. Apparently, he thought the suspicions about Trump were at least plausible -- probably even true.

This became a messy situation, because various other actors -- e.g. Hillary Clinton, Fusion GPS, a group of computer experts investigating Trump Tower and Alfa Bank -- conducted their own investigations. There were a lot of entanglements.

John Durham should not focus on indicting people. Rather, he should focus on explaining to the public what happened.

Many people sincerely believed that Trump was colluding with Russian Intelligence. Their belief was not fundamentally criminal. Rather, their belief was merely mistaken or foolish or reckless.

Perhaps their zealotry motivated them to violate some rules. However, such violations were not the major problem in this situation. Rather, Trump and some of his supporters were treated very unfairly.

FBI Counter-Intelligence indeed could investigate Trump on suspicion of colluding with Russian Intelligence. However, the very existence of such an investigation was supposed to remain secret.

Who revealed that investigation to the public? For a long time, I thought the culprit was Senator Harry Reid, but eventually I realized I was wrong about that. Reid himself apparently did not know that such an investigation existed, although he received special briefings from the FBI. Reid even wrote a public letter to the FBI demanding that such an investigation be initiated.

I have come to think that FBI Director James Comey himself decided to leak the existence of the investigation. I suspect that Comey accomplished the leak through James Wolfe, the Director of Security for the United States Senate Select Committee on Intelligence (SSCI).

Permitted by Comey, Wolfe leaked to journalist Louise Mensch that the FBI had obtained a FISA warrant against Trump on suspicion of colluding with Russian Intelligence. Mensch reported that story on her Heat Street website on November 7, 2016 -- the day before Election Day.

I suspect that Comey permitted this leak because he really did believe that a secret agent of Russian Intelligence might become the US President. If not for Comey, I suspect, the FBI investigation might have remained secret -- as it was supposed to remain.

Durham should investigate and report how the existence of the FBI's FISA investigation of Trump was leaked to Mensch and thus revealed to the public.

I'll be honest. I was never exactly a Q true-believer, but I did sincerely expect that Durham, Huber, etc. were going to expose the corruption in the FBI and other agencies. I even believed there were aspects of the Mueller investigation that were a sting operation. I was looking forward to many FBI agents and federal govt employees being indicted. I thought that Russiagate was going to backfire. Peter Strzok would have his grin wiped off his face. The public would learn the truth about Hillary's campaign, and the Steele dossier. Huber, Durham and similar investigators were working slowly, methodically...

Nope. Nothing. Nada. What a disappointment. What a farce.

I really should have learned my lesson by now. I need to become more cynical.

What we did predict is precisely what has occurred: Barr, who desperately wants to salvage the institutions of the DOJ and FBI but "knows" the "excesses" need to be "cleaned up", shut down the completely corrupted Weissman/Mueller/Hillary "investigation" and set Durham to task to expose a bit more of the corruption but to bury the rest.

Dunham was always a fake. Appointed by AG Barr to fool Trump and MAGA into thinking he was doing something to investigate Hillary and FBI lies and crimes in pushing TrumpRussiaGate.

Barr appointed him Special Counsel because he was afraid Trump would declassify a lot of Mueller/FBI documents and release them. Now, Dunham has done his job. Played out the string and covered it all up.

"Last Refuge" has tons of stuff on what a phoney Dunham was from the word go. But you only have to look at AG Barr attacking Trump for wanting a "Master" to review the FBI seized Trump documents, to know Dunham/Barr were working for the establishment. And part of "get trump".

If Durham directly accused high officials of the FBI and Justice Department with misconduct, he would have been destroyed by the same tactics used against Trump and the people surrounding him. The best Durham could do was to lay out a roadmap for how high officials colluded with Democratic officials and Russians to attempt to overthrow Trump’s election. Durham did the work that journalists refused to do because they were a party to the collusion, and he did it far more effectively because he had the power of subpoena.

The only explanation needed is found in an article The Hill published in 2016. They found that 97% of DOJ employee political donations went to Hillary. The FBI is under the umbrella of the DOJ so that number includes them. You can't obtain that level of partisanship without corrupt partisan hiring practices. The DOJ/FBI are the enforcement arm of the Democrat party. They aren't the "bravest and the finest" but are well-armed amoral terrorists who engage in violence on behalf of their political masters. Saying that the corruption is limited to leadership is a bad joke. The rank and file demonstrate their lack of integrity or principles by their failure to stand up to the leadership.

If Republicans obtain a majority in both houses then they must be deny the DOJ funding until Dems come to the table and agree to the dismantling of both the DOJ and the FBI and creation of a new law enforcement apparatus with checks on hiring practices and against corruption.

I fear we have lost the Republic and are subject to totalitarianism.

So why is Durham putting this out now? Why not wait until after the election, when--if it is a "winding down" without big criminal charges--it pisses some people off but it goes away.

Perhaps the raid on Mar-A-lago and the appointment of the Special Master accelerated things. "We're all done here--time to move on. People did some stuff that was not good, but no big deal. Pay no attention to all that sordid stuff that the stupid raid exposed

Who the hell knows? I gave up on Durham a long time ago--I'm inclined to believe that his whole purpose was to keep Trump from going public with what he has. But I will readily admit that I am just spitballing.

I am old enough to remember the Scooter Libby trial, where the prosecution said he lied to the FBI. An interview of the jury foreman after the verdict documented that "we could not convict Bush, so we did the next best thing."

Dunham's trial of Sussman showed he was guilty but DC partisan jurors let him go anyway because they have an agenda. When all government trials have DC juries the deep government wins.

Dunham's job was to record everything, in the face of opposition and adversity. It is obvious that the deep state will not allow conviction, Clinesmith who lied on the FISA submittal is now practicing law unencumbered by his falsehood. A corporal who did the same would be in Leavenworth.

Dunham's job was to record all the crimes of Comey, Strozhole, McCabe, and the CIA. They may not go to court but if Dunham does his job they will live in infamy in his records.

Perhaps Dunham will do nothing.

But now, as Trump moves on to other ploys, the Durham probe has served its purpose, even though it has produced no major convictions or epiphanies [with only three cases investigated and two actually tried over three years].

From the start, the probe was a red herring. The public already knew that the FBI had investigated the Trump campaign’s contacts with Russian agents, and the reasons for suspicion were not mysterious. Campaign manager Paul Manafort was notoriously tied to the Kremlin and passed information to a . . . Russian agent . . . .


Taxpayer cash was doled out to the tune of approximately $6 million with no results of any consequence.

Durham’s first big problem is that the statute of limitations has run on most of RussiaGate. The bureaucracy has able to protect itself long enough to run out the clock on most of their perfidy and malfeasance. With the exception of Clinesmith, they walk almost up to the line, without personally crossing it, and with all of them doing that, they were able to protect themselves as a group, which protected them individually. Until Barr became AG, they were able to utilize the LawFareGroup’s misinterpretation of the Obstruction statute to prevent themselves from being investigated - since any investigation of them would be obstructing their investigation of Trump and all of his closest allys. What they needed then was a RICO investigation of the FBI’s Counterintelligence Division (CD), DOJ’s National Security Division, and the parts of the CIA that worked with them. If Durham had gotten going early enough, that was in his skill set. But they needed the OIG report, based on their investigation, that had been held up by the Mueller investigation (finally terminated by Barr becoming AG), etc. so, what I think that Durham is doing is exposing the shenanigans that the bureaucrats in these organizations utilized to delay and obstruct accountability. Not enough. But all we are going to get.

As a first aside, as most here know, it turns out that Igor Danchenko, Christopher Steele’s primary subsource was hired by the FBI as a Confidential Human Source a month after Steele was fired by the FBI. That was fall of 2016. He was kept paid by them (FBI CD) for roughly 3 1/2 years, being terminated right before the 2020 election. Relevant here, that probably means that Durham couldn’t interview him until then. Neither could OIG. Interestingly, he was being investigated (by FBI CD) for trying to obtain classified documents and sell them to Russian Intelligence, from 2009 to 2011. They (CD) terminated the investigation, when they thought that he had left the country. He was back, by June 2016, when he sat around vodka bottles with Russian friends, in Georgetown, making up the stories that went into the Steele Dossier. It turns out though that he had worked for the Brookings Institute during the time that he was trying to obtain classified information to sell to Russian Intelligence. Steele, too, worked for Brookings at some point, and was hired through Clinton attorneys at Elias to create the Steele Dossier. Brookings was run, during the 2016 election by Strob Talbots and Clinton stalwart Cody Shearer. Why is this relevant here? One reason is that Brookings funds the LawFare Group, which, among other things, developed the radical misinterpretation of the Obstruction statute that was used against Trump, Gen Flynn, etc, and to keep the Mueller investigation open and untouched (and Danchenko uninterviewed). Turns out that the DOJ is again using LawFare to create novel legal theories by grossly misinterpreting statutes, in the MAL raid, and it’s head, Benjamin Whitte, is again an author on the LawFare document explaining their creative lawyering, as he had for the Obstruction misinterpretation used in RussiaGate/Mueller investigations.

John Durham apparently views his role primarily as indicting various people -- non-FBI people -- for various process crimes. For example, they allegedly lied to the FBI about some details.

The fundamental problem, however, was that some FBI officials made bad decisions that eventually caused enormous political trouble.

Their attitude toward Donald Trump was very different than their attitude toward Hillary Clinton. They welcomed any evidence that he was compromised by Russian Intelligence; they rejected any evidence that she was compromised.

They kept "beating their dead horse" that Trump might be a secret agent of Russian Intelligence. They never obtained convincing evidence, but they never gave up trying -- even after he was elected to become the US President.

Even after Trump actually did become the US President, they continued.

They were like Ahab trying to catch the White Whale.

The entire FBI Counter-Intelligence staff should have been re-assigned and replaced. In particular, all the Trump-haters should have been re-assigned elsewhere, and at least a few Trump-supporters should have been placed into that Counter-Intelligence staff.

That is of course their story, and slick DC operators, such as they, know the term “plausible deniability” by heart, but that story strains credulity, especially given the pattern of behavior at these agencies, where they relentlessly forged ahead despite the patent falsity of the collusion claims, and in the face of these claims being proved wrong, and discovered as sourced from a fabricated farrago of nonsense concocted by an opposing campaign, etc.

But regardless of whether Brennan, Comey, Ohr, McCabe, et al are indicted and put in prison where they belong, the scales, as it were, have fallen from the eyes of many people—those who used to believe that we lived in an orderly Constitutional republic, governed by reliable and clear laws, impartially applied by apolitical bureaucrats. Many people now realize that the persecution of Trump and anyone associated with him—the criminalization of dissent, the purges, the two minute hate, the party line—is like a cross between Lavrenty Beria and Moon over Parador. And sadly for our country, which made it two and a half centuries before it had the misfortune to run into Joseph Robinette Biden (and his crime family) and the establishment of the first national religion of the woke gospel, there’s probably no going back to the halcyon days before woke zealots, a la Lenin, seized all levers of power. It was a good run—a great run—but it’s over. A nation cannot be well led by a class that hates it and its citizens, and it cannot long survive one half attempting to outlaw the other. One might suspect that the the great and good of the woke gentry class would realize the consequences of their constant escalation and ratcheting, but one would not have been paying attention: the Dem-media-[quasi]academia-activist-nonprofit complex is much worse than the Bourbons: they’ve learned nothing, but never knew anything to forget.

That was eloquently and even beautifully put. I've come to the same, sad conclusions. There may be some residuals worth saving, and small blessings to be grateful for. These will probably be local and under the radar (to the degree we can avoid "being made to care"). But the Republic as we once knew it is truly over. It had a good run. There is no going back to an earlier, golden era. I've finally begun to accept that. Hopefully this country can prove me wrong, but I'm not expecting anything. And I've even started considering what country to move to if things become unbearable.

The basic problem is that prosecutors and investigators need a lot of discretion to do their jobs. Just making a mistake, investigating rumors that turn out to be false, is not a crime. There’s only a crime if the investigation was conducted in pure bad faith, knowing that it had no legitimate basis, and solely for improper purposes. Proving that beyond a reasonable doubt is very hard, especially when the alternative explanations of incompetence and bureaucratic inertia are readily available.

Probably the real answer is that a conspiracy to manipulate the FBI and the DOJ against the President, with leaders in both agencies trying to help, is not any crime. You may be able to get this one or that one for lying in a deposition, but that's it.
Perhaps his report will provide some clarity, which is maybe all we could hope for. Perhaps not.

I suspect that Comey permitted this leak because he really did believe that a secret agent of Russian Intelligence might become the US President. If not for Comey, I suspect, the FBI investigation might have remained secret -- as it was supposed to remain.

The issue under that theory then is why didn't Comey brief the Gang of 8? He kept mum on investigation.

The obvious answer is that he feared Republicans would defend Trump. That sort of thinking leads you to treat one entire political party as the enemy.
It leads you to target allies of the your target as targets (i.e. Flynn).

That's how banana republics form.

After learning that a DC jury will not convict a Democrat of anything illegal done to get rid of Trump, what would be the point in additional indictments? If the report details what was done and who did it that may me sufficient. That could serve as a guide for whom to fire and what departments to dismantle when a, hopefully, Republican, administration takes over in 2025.

Democrats in DC have established the same justice system they used in the Jim Crow south. Justice is what they say it is. Unfortunately, their is no equivalent of the federal system to overcome them since they are the federal system. It may require action by the Supreme Court.

Durham's investigation served to demonstrate that, with the exception of a rump faction actually committed to equal justice under law, the DOJ, FBI, and intelligence services of our country are permeated with Machiavellian seekers after power at any price, and their accomplices.
That's a pretty good ROI for $6M. And a tragedy.

Perhaps not Russian intelligence, but oligarchs. When Trump supported investigation of collusion and corruption of Biden, Kiev oligarchs, and their Russian counterparts, surely aided and abetted the pre-coup EU-certified government in Kiev, which secured the lives and welfare of all Ukrainians, and consequently normalized a stable environment for industry and energy transport.
