Howard said...: Another uplifting sunset swim at our local pond. Saw an eagle fly right over me then he circled two other swimmers before flying back to his perch. While we were hanging out at the meadow half waypoint, another bigger eagle raid a crows nest. Had to swim back to the beach into a strong headwind. The high altitude clouds got blown out into mare's tails made for a spectacular opalescent sky after the sun dropped below the horizon.

Fitten asked for NARA to release the tapes to the Clinton Library from whence they could be accessed. But neither NARA nor the Clinton Library had the tapes, So Judge Amy Berman Jackson's hands were tied by the plaintiff's request.

Thus, because the Court was unable to provide the remedy that Judicial Watch sought by ordering that defendant “assume custody and control” over the audiotapes, the Court was unable to redress the plaintiff’s claim. Accordingly, the Court granted the defendant’s motion to dismiss for lack of standing because Judicial Watch's lack of access did no harm. Fitten thought that the ruling meant that under the PRA, Presidents get to declare which records went to NARA.
