"Facebook Gave Nebraska Cops A Teen's DMs So They Could Prosecute Her For Having An Abortion."


I found that after I noticed that #DeleteFacebook was trending yesterday. I assume that trend gathered momentum before this crucial update: "This story has been updated to note that the Facebook messages were obtained via search warrant." 

Oh! A search warrant! And the story went up the same day as the big search-warrant-authorized raid on Mar-a-Lago, the day Trump-haters were all saying the FBI got a search warrant, and you know what that means! That means he's guilty and hooray for the government agents getting right in there and seizing everything.

The mother and daughter broke the law in obtaining OTC abortion drugs and tried to incinerate the fetus to hide the evidence. Their text messages alone were probably enough to convict but they insisted on leaving lots of corroborating statements on social media. Brilliant! What were the abortion drugs that are illegal? Why are they over the counter if they are illegal?

The abortion was at 22 weeks. That baby was a baby. It was an appalling and barbaric crime, but if you call it an "abortion", for some reason that makes it okay?

Can we mention the fact that the pregnancy was well over 20 weeks, not only was this illegal, but medically very dangerous. The mother is the one who frightens me, who would do this to their child? Life happens, babies happen, you can raise it or put it up for adoption when you are this far along in the pregnancy. Have we all gotten so jaded as to think this is ok?

?? I haven't heard that. What I have heard from Republicans is that the government certainly overreached, and this from people who don't know the underlying facts. Talk about jumping to conclusions. Marco Rubio compared it to what happens in Cuba that people escaped from. Do they have an independent judiciary in Cuba that will only allow a search upon sworn affidavits laying out facts that show probable cause a crime was committed and that evidence will be located at the place being searched? Kind of doubt it.

Consider this remarkable tweet from the Republicans on the House Judiciary Committee: "If they can do it to a former President, imagine what they can do to you."

In other words, what "they can do" should depend on who you are. So much for equal justice under the law. And this from the Judiciary Committee. WTF

You may not be wrong. 10-15 years ago the eula gave Facebook the right to rummage your hard drive and use or sell any photo it found there.

Not just what you had posted, anything on the computer.

I think it has changed but I will still not allow anyone to access Facebook on any device I own.

I had thought the Big Tech companies like Meta aka Facebook had a habit in the United States of resisting the government if their political philosophies are different than the government’s positions. All the while giving in to China on more egregious demands when China is enslaving their own people with those demands. I am guessing that a low level flunkie in legal at Meta actually followed the law instead of fighting it in court and gave the Nebraska law enforcement the data the search warrant asked for. I wonder if that low level attorney still has a future working for Zuck since he is looking for reasons to pare staff based on his comments at the recent “all hands” company meeting?

You are correct. They should have said what "they will do", not what "they can do". Of course, they can serve a BS warrant on a former and future President, searching every room in his house and rummaging through his wife's wardrobe. It's just that they shouldn't, and no previous AG would have even considered it. It seems that Merrick Garland reeeeeeallly wanted to be on the Supreme Court.

I just read that this was a 28 week old fetus. Nebraska law bans abortion after 20 weeks.

Of course the liberal press skips all the relevant details. 28 weeks is a pretty ripe fetus; the beginning of the third trimester. It's pretty much a baby at that point, and premature babies born at 28 weeks can survive.

This is a ghoulish act by the mother and the daughter. Then burn the body? Holy shit. You've got to be pretty out of touch and lazy not to get in prior to 20 weeks. You want your neighbor burning 28 week old babies in their backyard?? Most communities don't even allow you to burn leaves.

Fuck Facebook. But these two women are crazy.

Based on the conduct of the grandmother (the teen's mother, who I would wager was the driving force here - "you're getting rid of it!"), it sounds like there is a good chance that the baby was born alive.

Certainly with using pills, there is no dismemberment in utero, which is the typical method of fetal demise before birth. And they told police that the child was stillborn. I'll bet, however, that the baby was alive and they killed her/him after birth.

Any abortion charge against grandma Jessica will be hard to prove. Although they acquired pills to prematurely expel the baby, the prosecution has to show that the teen actually ingested the pills, as well as proving that the child was not, in fact, stillborn. Merely ordering abortion pills while late in pregnancy is not enough to even prove attempt.

The other charges are another thing.

In early June, the two women were each charged with removing, concealing or abandoning a dead human body, a felony, and a pair of misdemeanors: concealing the death of another person; and false reporting....A month later, Madison County Attorney Joseph Smith added two more felonies to the charges against Jessica Burgess — for performing or attempting an abortion on a pregnancy at more than 20 weeks, and performing an abortion as a non-licensed doctor.

We already have laws against murder.

If you anti-abortionists want to be consistent call it murder and charge them. Admit you want the State to have this power.

Our two girls were both premature one of them not being much older than the baby these people killed and burned.

I personally think the State is going to fuck this up and they should stay out of it.

Getting this girl to church 10 years ago would have helped more than prosecution now.

In the end the progressives are creating monsters that kill s8 week old babies and burn them.

We need to deal with the cultural roots of our society.

Facebook was given a warrant. It is not like the company voluntarily complied with a mere request. Also the pregnancy was 23 or 24 weeks along. The existing Nebraska law bans abortion at 20 weeks. Even pre-Dobbs this wouldn't this have been an illegal act? Why are people pretending this is because of Dobbs? Also the actions of the mother and daughter suggest they knew it was illegal to do. Why were they talking about it on Facebook? Scared 17-year old I can understand doing something like that, but not Mom. Was Mom hoping for something like this? Did Mom want to make her Daughter a political martyr?

Like other classes of murder (i.e. homicide committed in darkness, at the twilight fringe), planned parenthood cannot be prevented, but civilized society has compelling cause to discourage the rites exercised for social, redistributive, clinical, political, and fair weather causes.

That said, the Pro-Choice ethical religion, the wicked solution, denies women and men's dignity and agency, and reduces human life to negotiable commodities has diverse precedents in nominally "secular" societies with democratic/dictatorial (e.g. selective-child/one-child) support.

Agreed. And one way to do that is to pass laws that determine what is legally right and legally wrong, drawing a clear line that doesn't depend on a person's moral sensibility.

And who knows? Based on the people in this story, it's highly likely that prosecuting and jailing these two for this crime will prevent numerous future crimes by them. Their stilted moral sense in this situation indicates a high propensity for other crimes reflecting their devaluation of human life. Child abuse, perhaps. Or even further killing. Hard to pinpoint but not hard to predict.

Murder 1?

It was premeditated. Definitely barbaric. And there were aggravating circumstances. They tried to burn the dead body after killing the baby.

Are we going to plead them down to Murder 2? Manslaughter?

Or are you going to make a special type of law against this sort of thing?

Be specific. State the goals of your State action.

I agree that people should be dissuaded from killing a 28 week old baby and burning the body. My question is why did they wait to kill the baby for 28 weeks?

The problem with making this a State action is that now every election is going to involve whether or not we throw people in jail for this.

People are going to do this regardless. Just like there are going to be murders and theft. The point is to have less of it.

I prefer that we reduce it through creating better citizens. If you are going to punish monsters like this you have to make sure you have overwhelming support because there will be people that support her and think you are monsters and it is a political football.

This means making it so that 90+% of the population views this as murder. The only way this happens is fixing our cultural rot from the bottom.
