However, Trump should have folded his hand when no disputed state would submit a second slate of electors since without that happening there is nothing for the VP or Congress to rule on.
I mentioned before this has implications for the implementation of the National Popular Vote. This is a potential confounder of the NPV Compact since in the situation where the candidate winning the popular vote in the state is not the NPV winner a state legislature could potentially decide to submit a slate of electors representing the winner of that vote in opposition to the actions of other Electors. The NPV, and other schemes to manipulate the Electoral Vote, only work if there is absolutely no way to review the casting of Electoral Votes.

The federal lawsuit follows a Wisconsin Supreme Court ruling that prohibits absentee ballot drop boxes and only the voter can return their absentee ballot in person to a clerk's office or a designated site.
