"A Columbus man has been charged with impregnating a 10-year-old Ohio girl, whose travel to Indiana to seek an abortion led to international attention..."

"... following the Supreme Court's decision to overturn Roe v Wade and activation of Ohio's abortion law. Gershon Fuentes, 27, whose last known address was an apartment on Columbus' Northwest Side, was arrested Tuesday after police say he confessed to raping the child on at least two occasions. He's since been charged with rape, a felony of the first degree in Ohio.Columbus police were made aware of the girl's pregnancy through a referral by Franklin County Children Services that was made by her mother on June 22, Det. Jeffrey Huhn testified Wednesday morning at Fuentes arraignment."

There had been some doubts cast on this story. A few days ago, I wrote:
Yes, I have been waiting to hear the name of the rapist and news of his arrest or details about a rape by an unknown man who has eluded arrest.... [W]e should all be demanding to see that the rapist of this 10-year-old girl be brought to justice. But perhaps the story was made up, and that's the reason we don't know the name and the fate of the rapist: There is no such person. Why would 6 weeks pass without medical attention when a 10-year-old child is raped? Here is an incident that should be immediately reported to the police. If it was not, then it must be that some man — perhaps a family member — was coercing the child to protect him. Is the child still dominated by this man? We should know a lot more about what happened. The need to make the trip from Cincinnati to Indiana is the least of it. 

Now we see that a report was made on June 22.

Has a doctor come forward to report a rape, which apparently wasn't previously reported?

Has Columbus PD found a report that it had been sitting on?

The story as presented at the time was bullshit. Parts still are. Why didn’t the doctor report the crime? She’s a mandatory reporter. And, the child could have had the abortion in Ohio because it fell within the statute. She didn’t need to travel to Indiana, so the main element of the original story remains bullshit.

Yes, because there was no corroboration until now. Extraordinary claims require extraordinary proof, as they say. The "doctor" shut up after the first article. But to clarify, we didn't the story of the young girl, we doubted the activist who has been cited for failing to report similar things in the past, and we doubted her precisely because if what she said was true she owes it to the girl and the people of Indiana to come clean. I don't know what you are celebrating for! It's a horrific story that has taken far too long to be resolved, and it would have been better for all involved (except "the doctor") if the story was fake.

Rape and incest occur when pregnancy deletes the baby so there is no evidence. Since this girl WAS raped, then why did the Ohio AG say he never heard of this story?? Why wasn't it reported to him in HIS state?? He also said this "Ohio’s heartbeat law has a medical emergency exception, broader than just the life of the mother. She — this young girl, if she exists and if this horrible thing actually happened to her, it breaks my heart to think about it — she did not have to leave Ohio to find treatment.”

So who is at fault for this, and was it used to attack the Ruling from the Supreme court??

There was another ten year old who got an abortion in indiana, though it's not clear when. The abortion doctor testified about it in a hearing before he lost his license.

He didn't report it and left it to the parents, who declined to press charges. Though legally I think it's not up to them!

Well, I think the abortionists were supposed to report under-age pregnancies even when Roe was the law of the land. Are you trying to suggest that a patchwork of differing State abortion laws is a good idea, because it encourages psycho baby-killers to report psycho baby-rapers to news organizations? I have to admit, I'm not sure I always follow the intricacies of feminist thought. Does it matter whether the baby who was killed was female? I think we can posit that the 10-year-old who was raped was female. Unless some doctors had started her on testosterone pills, but then I guess she wouldn't have gotten pregnant, would she. Not sure I follow. The crime came to light because the girl became pregnant. And presumably the parents reported it to the authorities. The parents would be less likely to report the crime if she could get the abortion in her home state? Why?

I don't know Ohio law, but I have read in connection with this story that some Ohio official says a 10-year-old rape victim could have legally obtained an abortion in Ohio. If that's true, then the obverse question arises -- was the abortion obtained in another state in some (perhaps misguided) effort to keep information about the underlying crime from Ohio law enforcement?

And I agree with Harun's observation above.

I don't know I find it more disturbing the thought of a young girl victimized twice having to go through the rape and then having to go through an abortion and then living with that for the rest of her life. But...My first thought was that had this not been an illegal immigrant, would there have been a person named sooner? If not for the pressure built up to let everyone know that This Was Not A Hoax. An analysis of Columbus police reports filed since May 9 found 50 reports of rape or sexual abuse involving a person 15 years or younger. That number of reports may also be underreported because of restrictions on public records related to reports initiated by mandated reporters. The report involving the 10-year-old girl falls into that category.

50+ reports of girls being raped in Columbus in the last two months?! Our problems in this country run far deeper than abortion.

The child did not have bodily integrity, and she did not gain it by being forced by her abuser to get an abortion. A Fox News regular on Outnumbered remarked that her background was criminal law and there are more "monsters" out there than is generally known.

I suppose part of it is that there's a privacy issue for kids. And if there are a lot, then there's a familiarity issue so that it's not worth reporting...another one.

I have heard that Planned Parenthood is routinely accused of failing to report. The doctor(s) in this case are mandatory reporters. Did they report? Is failing to report a crime?

Heard that Ohio has exceptions for rape, incest, life of the mother and a "heartbeat" requirement. So why Indiana?

As soon as this supposed rumor came out, why did the police detective in charge of the case not inform the State DA so that eh could avoid getting egg on his face? As soon as the DA announced that he does not know of any case, the detective should have been on the phone. Then there would not have been the follow-up messaging:

Yost doubled down on that in an interview with the USA TODAY Network Ohio bureau on Tuesday, saying that the more time passed before confirmation made it "more likely that this is a fabrication."

He based his assessment on the lack of confirmation by police authorities. It was a reasonable thing to do given that there was an effort made to confirm the rumor and no confirmation was forthcoming.

There is a reporter at PJ Media who had been covering this story and just a few days ago declared she felt people should regard the story as a hoax. This is the danger when reporters report conclusions and not just the facts. All that being said, this development is still odd when compared with the public statements of the Ohio Attorney General just a few days ago.

It did seem too good to be true. An abortion in this case would not have been illegal in Ohio in this situation, so having to go to Indiana was unnecessary. The abortionist is a well known activist who has been known to "exaggerate" in the past. Finally, if this occurred the abortionist was required by law to report it as it almost certainly would have been the result of sexual abuse, and no such report was made. The abortionist then refused to talk to the press.

So the argument is it was either a hoax or the abortionist was breaking the law. Assuming this is the same girl the abortionist is talking about, then apparently the abortionist was breaking the law. So there you go. Tentatively, it is not a hoax, but the abortionist is a criminal. That's marginally better, I suppose.

No apologies forthcoming, Inga. The abortionist is still a terrible person.

I will doubt any story that does not have corroborating evidence. Originally, the story given was unsupported by any evidence at a time of great controversy over abortion access. Apparently, the rape crime was not reported to police at the time of the rape as the girl was 9 years old when she was raped. The abortion had already taken place before police were notified. Police can only act upon activity of which they are aware. If the rape was only made public to protest abortion bans and not for the crime, then the reporting doctor and the abuse counselor need at least an investigation. Currently, the Ohio AG says the abortion could have been legally performed in Ohio without any need to travel to Indiana.

I am wondering that someone might have been covering covering up this case because the alleged rapist is an illegal immigrant. For the past two decades, illegal immigrants have been protected in many instances in this country for breaking the law, especially in “ sanctuary cities”. It seems in those cases that their being in this country illegally trumps most any crime that they commit and that the illegal immigrant must be protected at all costs. I hope that is not the case with the alleged rapist in this case but I wouldn’t be surprised. Whoever protected this alleged rapist, whether it’s the doctor who first diagnosed the pregnancy, the abortionist who directed the child to an out of state clinic, Franklin County Children’s Services, or anyone else with knowledge of the rape of a 10 year old girl needs to be charged with covering up this rape, particularly if they were protecting the illegal immigrant who allegedly raped this girl.

There are more girls 10-14 who have babies than have abortions, sad to say. And in most states, statutory rape is a crime if the girl is 14 or under. Has anyone investigated how many cases of incest/rape involving girls under 14 are prosecuted and whether prosecution is more likely if the girl has become pregnant and, if so, if she has an abortion or if she continues the pregnancy? It may be that the police do not do an adequate job of investigation these crimes even when 10 and 11 years olds give birth.

This is such a confusing story. Apparently, the girl was impregnated on or before May 12th. We don't know when her birthday was but apparently Ohio law prevents abortions after 6 weeks with no exceptions, but we don't know whether she was 9 or 10. This is unclear. And Roe was overturned on June 24th, 2 days after the FCCS was notified of this situation. Why wasn't an abortion scheduled between June 22-24th? Why was there no time period after overturning Roe for the "new laws" taking effect? How accurate are these estimations of date of pregnancy? We don't know if she was 9 or 10 but we do know that she was passed the Ohio law for abortions? It is seriously 6 weeks and not one minute longer than some guessed at date. Did the abortion doctor do her due diligence and report this to Indiana authorities as apparently required? Or was she more concerned about abortion rights than rapists running loose?

I can't find it right now, but I believe Ohio Attorney General David Yost stated in an interview on Fox News last night that the young girl would have been permitted to have an abortion in Ohio under the state's medical exception rules.

So whether her guardians were not aware of that fact or there were some other factors at play here seems to be unknown at this point. I also saw a report that she may have been "forced" to go to Indiana, but this also is unclear.

Anyway, I'm glad to see this scumbag was identified and arrested. Here's hoping some Soros DA doesn't let him out.

I stayed away from commenting on the possible hoax because there were just too many questions. There could have been a kernel of truth in the reporting and one doesn't like to look stupid any more than is necessary or unavoidable.

Then I saw that Megan Fox at PJ Media was taking the lead on busting the hoax and I decided that it just might be a true story because I figured out a few years ago that Megan Fox at PJ Media is a vigorous self-promoter and a serial liar who has a platform she does not deserve.

Local clinics are also mandatory reporters. Doc knew that a mandatory report from a local clinic would raise questions as to why she didn't report.

Then she made a big deal out of it, but it didn't occur to her in time that she was now risking her license. Oops.

Well, it's not clear which side the Patriarchy (TM) is on here. The Patriarchy(TM) does like to have its way with women, but it also sees women as tools, to be used to produce additional humans, so it opposes abortion. I think we can be fairly sure that the Patriarchy (TM) will infallibly take the side that Althouse disfavors, just as soon as she has had time to decide which side that is. Unless, of course, she changes her mind. We may not be able to say with certainty what a woman is, but we know one when we see one, and we know that she has certain rights. When Glenn Kessler at WaPo said wrote that there was no corroborating evidence for this incident, at that point was it too soon to suggest that it was probably all nonsense? That's a start. Here's some more:
The abortion claim hit the news 7/1, 9 days after the rape was supposedly reported to Child Protective Services. Dr. Caitlin Bernard supposedly got called about the case 6/27, which would be 5 days after the report, and 3 days after Dobbs was released. Her claim was the girl had to come to Indiana because Ohio banned abortions after 6 weeks, and she was 3 days too late

1: So, she got the call 3 days after Dobbs. Was it "3 days too late" because the pregnancy was well along, obviously illegal under Ohio law once Dobbs came out 3 days ago?

Ohio has a "heartbeat" law, not a "6 week limit". So there's no "three days too late", unless they were monitoring every day for a heartbeat, and just happened to get one on the day Dobbs was released. That makes no sense unless it's "three days too late" because 3 days after Dobbs, NOT 3 days after a heartbeat was detected

6 weeks is 42 days. Add 3 for the "three days too late" (I'm pretending here that the reporting was honest), and we're up to 45 days before 6/27. Subtract 14 because the "42 days" is measured from the start of her last period, not the day she got pregnant. Which puts the rape back around May 27.

2: Why was the rape not reported until ~25 days after it happened? Were her parents covering up her rape until she got pregnant?

3: Esxacly how many time WAS she raped by this guy before he was finally arrested?

Nothing was done about the crime until public pressure was brought. 20 days between when it was reported to CPS (2 days before Dobbs came out), and when the illegal alien rapist was arrested in Sanctuary city Columbus Ohio.

Who was the doctor they took her to in Indiana? Why, one who's previously been accused to covering up underage abortions.

I noticed this thread after returning from vacation. It had a very personal meaning for me.

I grew up with a childhood friend S whose extended family I was close to. They seemed to be a very normal second generation Mexican-American family of entrepreneurs (And gasp, Republicans!).

We dated when in our early 20's and she told me that her father started raping her when she was 11 years old. The same thing happened to her (equally gorgeous) younger sister.

The younger sister became pregnant at 15 and had an abortion. She later became a crack addict and had kids from different men before she died in her 20's. By that time S had found peace as a lesbian (amazing how many sexually abused girls become lesbians) and adopted her sisters two kids.

I am not sure how relevant this is to the thread, but it is clear to me that very young girls are sexually abused and that abortion is (in my mind) an appropriate response. However, it doesn't solve the problems leading to the destruction of these kids. IOW, abortion is not the only response, although it is very convenient for all the adults involved.

I have had some experience with this. In Burbank CA I was asked to see a 12 year old for possible appendicitis. When I reported to the GP, I mentioned that I had done a rectal on her because of her age. He said, "Don't worry about it. She has had an abortion." Middle class family in 1972.

In 1967, I saw a 9 year old who had had appendicitis 6 months before and had surgery in Sacramento, CA. The pediatric residents (female by the way) convinced themselves that she must have PID, an acronym for venereal disease, and had therefore been raped by an uncle who lived with the family. I called the hospital in Sacramento (a pet peeve with the EHR) and learned that she had had an appendiceal abscess drained. Her appendix was still present and had flared up again. That is common with a prior perforated appy. I took out her appendix and solved the problem, for her and the poor uncle.

I hate the EHR because hospital no longer keep medical records, even when legally required to.

He ordered an investigation much earlier. And the answer came back that NO local cops told him they were investigating a rape of a 10 year old, and no one had sent any rape kits in from 10 year olds.

I wonder if this child has a legal guardian or parent here. The news story is very vague. We have a real problem with trafficking in Ohio. So much so, the state requires I watch a video about it every time I renew my license so I can better recognize trafficked persons. They bring minors in from South America and Mexico and make them work in the agricultural industry in terrible conditions. There was a case of an egg farm bringing in a bunch of minors and housing them in a trailer park and forcing them to work long hours. Could easily see rape happening to kids in these circumstances and it would take a while for it to be sorted out once a pregnancy was recognized.

Yes, edge case aside, this was a criminal action that should have been reported, the rapist apprehended to mitigate progress in the general population, and affirmative action taken long before six weeks expire, long before the girl's life would be placed at risk with planned parenthood. The precedent for social progress to be pushed through human exploitation and sacrifice did not begin or end with Roe's regrets, but has diverse precedents in civil and human rights violations throughout the 20th and 21s centuries. I second gilbar's suggestion. When will the rapist be executed? The baby has already been killed. His/her DNA will prove who was the rapist. There's no question a crime occurred here, since the girl is 10. No he said/she said to sort through in the rape. Since the sentence of death has already been carried out on the baby, the rapist (who has provided his DNA) should be next. Since this was a reported crime according to the doctors, surely they kept the DNA evidence to convict.

Excellent point: there seems to be no legal reason why she could not have undergone the procedure in her home state of Ohio. So why did she have to go to Indiana?

Qui bono? Well, unfortunately there is a time honored tradition for parents and family who want to keep things quiet and out of view of the local authorities to just get the pregnant kid out of town and take care of business discreetly elsewhere.

As a physician who was an ER doc early on, if I saw a 10 year old who was pregnant, I would be an idiot not to consider that there was a realistic chance that she had been sexually abused, and I would be legally required to report it to the authorities. Looks like the abortion doc involved didn't do that.

This whole story stinks. Sounds like a lot of grown ups made a bunch of crappy decisions, and the poor 10 year old was the least of their concerns.

Hospital lawyers are very cautious. The Ohio law does not specifically permit abortions for girls who are ten years old. Young girls have survived childbirth, so there is no proof that the pregnancy would have threatened her life. A prosecutor could prosecute any doctor who participated in the abortion in Ohio.

Questions like "Why would 6 weeks pass without medical attention..?" is without merit. Do you know 6 weeks have passed without medical attention paid to the victim? Perhaps it was ommitted in the report because the reporter did not know just like you do not. Maybe all the proper steps were taken, but were not made news nationally. Abortion being the talk of the town, abortion-related part of the story is being sensationalized - I suppose you can blame the media for that, but in the country of 300 million people a lot of heinous crimes are unreported on a daily basis. If you want to know of every one of them I suggest you start looking at police database.

You seem to worry that availability of abortion is silencing victims of abuse, which I grant is a reasonable worry. But it is also true that rape has become a more serious crime in our sensitivity since women acquired more robust citizenship and equality with men, of which reproductive freedom has been indispensable. In the bad olden days rape was a crime against property of men (father or husband), punishment was much less severe. A visceral hostility against sexual abuse against child in our society is also a recent development (post-Roe).

The Doctor was asked by multiple reporters "did you report this to the police? What city did it happen in?" She repeatedly refused to answer
One source: It's probably the journalist lying. Multiple, it's the doctor

The Ohio State AG stated on the record that he asked every city if they had that case, and got uniformly negative replies. So either he lied, or the Columbus PD lied to him.
Since the Columbus PD has not announced "that's not true, we told the AG on ...", I'm going with they lived to him. So now we can reasonably suspect that they would never have arrested the illegal alien rapist if not for the press pressure on the story
The parents reported the rape on Wednesday 6/22, "after they discovered she was pregnant". Dobbs did not come down until 6/24, but was expected to come down Thursday or Friday. So they had at least two days to get her an abortion after discovering she was pregnant, and knew they faced a deadline.

One effect of overturning Roe is that we will now know more about what type of young, often underaged girls get nearly all second and third trimester abortions; how many statutory rape victims are aborted without the abortion staff (required reporters) contacting police, and we can shape policies to offer them more support.

Nobody is happy about this case, one way or the other. But maybe a 10 year old has now escaped her pimp or molester.

My illegal immigrant next door neighbor's first daughter gave birth at 11. Nobody did a damn thing. I would have but didn't live here yet. Then he got caught raping his second 11 year old daughter.

I had a case where a man had supervised visitation with his five year old daughter. He figured out where the camera were and took her to a secluded corner and bit and molested her. He had 12 other kids, now at least 13.
