I wonder about the timing of the NYT piece and the Giffords shooting. I recall watching the whole "Palin-is-to-blame-meme" unfolding in the Althouse comments <a href="https://althouse.blogspot.com/2011/01/us-congresswoman-gabrielle-giffords.html>link</a> in real time. Within hours (minutes?), commenters here started circulating the connection between Palin and the shootings. I cannot speak to the legal term of art being used to judge this case, but I can state that the commenters behind the nastiest ones in the Althouse link were malicious and not based on truth. They were written by individuals who had show over the course of a few years to have suffered from what might be called Palin derangement syndrome. Certainly, the NYT was infected by the same PDS at the time. That is my recollection at least. I hope Palin's attorneys can meet the standard.

For a variety of reasons, I sincerely hope she wins this case. The media has had a free pass for far too long. Just listening to that editor’s defense of his writing was sickening. It shouldn’t be that easy to publish awful things about people and get away with it. The media has long since forfeited its right to claim a moral high ground.

I hope the Times gets the book throw at them. Palin’s right, the Times has every bit of resources at its disposal to fact check so it’s not as if someone couldn’t do a basic google search here. It was straight up maliciousness to link her to a mass shooting. This isn’t a celebrity getting upset that a magazine ran a gossip column about her dating life. The Times straight up claimed Palin influenced the nut job shooter in AZ. Wrong, wrong. Eat crow Times and hefty fine to boot.

Read that the judge dismissed claim for punitive damages on ground evidence too weak (higher standard of proof). Also Palin testified no medical expenses associated with her mental health injury. Pain and suffering damages tend to have a relationship with out of pocket medical expenses. Testimony over. Judge needs to finalize and give jury instructions.
I'd vote for her again.
(Unless she was running with someone akin to McCain.)

HuffPo/Daily Beast/Slate are all sneering at her testimony. They wouldn't do that if they were confident the NYT will win.
I always liked Palin. Her RNC acceptance speech was amazing. She said Obama "palled around with terrorists," something her running mate wouldn't have had the guts to say ever. And that's the best part about Palin: she exposed McCain for the pussy that he was.
Also since I don't think anyone above said it, Palin was the true beginning of today's populist movement and she paved the way for The Donald.

NYTs punishment should be to run an editorial listing everything they have lied about over the last 20 years.
Mich--what the times did was worse. They maliciously accused her of encouraging and incentivizing the nutcase to shoot Gabby Giffords, then were forced to admit they were wrong.
Then they did it again several years later. Because they could.
