"The cops involved in the shooting of Jacob Blake... were attempting to arrest him for violating a restraining order stemming from an alleged sexual assault..."

The NY Post reports.
Blake, 29, was forbidden from going to the Kenosha home of his alleged victim from the May 3 incident, and police were dispatched Sunday following a 911 call saying he was there.
I can't tell whether the woman is black. Does it matter?
The responding officers were aware he had an open warrant for felony sexual assault, according to dispatch records and the Kenosha Professional Police Association, which released a statement on the incident on Friday.

That police union statement also claimed that Blake was armed with a knife at the time of the shooting — and had put one cop in a headlock and shrugged off two Taser attempts while resisting arrest....

Kenosha Professional Police Association Releases Details on Blake Shooting

The statement's main points:

The officers were dispatched to the location due to a complaint that Mr. Blake was attempting to steal the caller’s keys/vehicle.

Officers were aware of Mr. Blake’s open warrant for felony sexual assault (3rd degree) before they arrived on scene.

Mr. Blake was not breaking up a fight between two females when officers arrived on scene.

The silver SUV seen in the widely circulated video was not Mr. Blake’s vehicle.

Mr. Blake was not unarmed. He was armed with a knife. The officers did not see the knife initially. The officers first saw him holding the knife while they were on the passenger side of the vehicle. The “main” video circulating on the internet shows Mr. Blake with the knife in his left hand when he rounds the front of the car. The officers issued repeated commands for Mr. Blake to drop the knife. He did not comply.

The officers initially tried to speak with Mr. Blake, but he was uncooperative.

The officers then began issuing verbal commands to Mr. Blake, but he was non-complaint.

The officers next went “hands-on” with Mr. Blake, so as to gain compliance and control.

Mr. Blake actively resisted the officers’ attempt to gain compliance.

The officers then disengaged and drew their tasers, issuing commands to Mr. Blake that he would be tased if he did not comply.

Based on his non-compliance, one officer tased Mr. Blake. The taser did not incapacitate Mr. Blake.

The officers once more went “hands-on” with Mr. Blake; again, trying to gain control of the escalating situation.

Mr. Blake forcefully fought with the officers, including putting one of the officers in a headlock.

A second taser (from a different officer than had deployed the initial taser) was then deployed on Mr. Blake. It did not appear to have any impact on him.

Based on the inability to gain compliance and control after using verbal, physical and less-lethal means, the officers drew their firearms.

Mr. Blake continued to ignore the officers’ commands, even with the threat of lethal force now present.

No, it does not seem to matter, except when it involves an officer shooting someone that they are taking into custody.

Don't know "who is who" in this situation, maybe there are several victims in the mix, but according to child support cases on WI-CCAP, the mother of several of his children is African American.

And she has put herself forward as his "fiancee"

I assume that is to give standing in any potential civil liability cases that might arise.

How would one tell? By looking at the color of her skin? If you could tell, does it change how the officers should have protected her? If the genders were reversed, and the woman was previously abusive and had a restraining order against her; should the cops treat her differently than Jacob?

Are you saying, MS, that he had the knife on him the entire time? Even when being tased and struggling and putting an officer in a head lock?

Seems that the latter would lead to his dropping the knife.

I keep seeing that Jacob raped a 14 year old, but it looks like it’s not true? But the sexual assault charge that people think was against a 14 year old was actually this one in May against his ex-girlfriend. Can anyone confirm that?

Regardless, if that’s the case, Why has he been a free man since May? And why on earth were the three children with him and not the girlfriend/mother? If he was too dangerous to be around his girlfriend, and I think there was a restraining order, then he was too dangerous to be around those boys.

Lucien said...

What about the kids in the car? Blake deliberately put them in harm’s way, but was he attempting to kidnap them in a stolen vehicle, or were they in his custody? If one of them had accidentally been shot dead would Blake be culpable under the felony murder rule?

The fundamental issue in this situation was that a Black did not want to be arrested by police officers.

If a Black does not consent to be arrested, then the police officers may not arrest him.

Mark, that's what the cops thought, too. Wrongly, it turns out. They thought that tasing him twice would do it as well. That didn't work either.
The police ordered him to drop the knife. That's when Jacob ignored them and their drawn weapons and decided to reach under the car's seat. A curved, sharp-pointed knife is clearly in his hand as he was rounding the silver SUV.

I think he was trying suicide by cop.

Hauptfrau said...

Well. Restraining order. Wondered about that. So, assuming the then Ex- GF (now fiancé) had custody of the kids, how was it ok for the kids to end up in the car? Did ex really give him the kids voluntarily after she’d called 911? Could it have been a noncustodial parent kidnapping situation? Or at least Reasonably appeared that way to the cops? Anyone think that scenario could be dangerous for the kids, if Blake drove off with them, in the midst of a nasty domestic dispute? Might the cops reasonably think so?

With Blake, considering the outstanding warrant and new violation of restraining order, certainly realizing that if the cops successfully arrested him, he was immediately going to jail. I‘m guessing he didn’t want to go to jail. Sometimes suspects do stupid, desperate crap to avoid going to jail. (Observation as a Former Defense counsel.)

Admittedly lots of inferences and some assumptions here, but if there’s a flaw in my logic, please tell me. Willing to listen.

Just so we're clear for those who didn't look, that was no boxcutter, no Swiss Army knife, no paring knife or carpet knife. That was a knife designed for one thing: killing human beings.

It looks like the Spyderco Harpy or Civilian that Hannibal Lecter used in the sequel. The wielder of such a knife, assuming he chose it and knows it and did not get it from a box of Cracker Jack, is a very dangerous man.

How do we solve a conflict like this? Live down to those low expectations? Force stupids to comply with the same laws as everyone else? No matter how stupid, someone's got to comply with the cops in an extreme, such as tasers and guns.

It's hard for white people to comprehend what was going on -- she filed restraining orders against Blake for rape and assault but he was there for a BBQ, and then the kids were in her car but he was stealing the keys. The ex-GF, now fiancé, called the police but now is outraged that the police discharged his gun in front of the children. Why did she call the police? For the kids or for the car? Why didn't she get the kids out of the car before calling the police? She claims she was screaming about the kids but all I heard was someone screaming at the woman to get away from the scene. So much screaming I doubt the police had any idea there were children in the ca and the kids weren't mentioned in her call.

I can understand why the GF wants in on the cash settlement but what does Blake get out of this new arrangement? I know in some Muslim countries if the rapist marries the woman all is forgiven. Maybe this is a similar situation so she'll drop the charges?. Still, does he need to marry her, or is it just a permanent fiancé/financial arrangement? I need someone from the Black community to explain all this.

I too await the toxicology report.

Yeah I believe she's his fiancée.

I see two perspectives.

1. Many single black women with children call the father, fiancee. I provides a bit of social cover to the relationship or lack there of

2. When the victim tries a civil suit of damages, the sexual assault victim wants to be able to cash in. her pain, lack of consortium, etc. you can make those claims as a wife or fiancee, not as the gal who called the cops

Partially the spousal privilege. Without her testimony, how do they make much of a case against him? Which gives them both an incentive to marry. He reduces his chances significantly of being convicted of the felony, since she can’t testify against him (and wouldn’t want to) and that increases the chance of a significant settlement. And of course, if she marries him, she can expect a significant portion of the settlement, made larger by her not testifying against him. Moreover, with him partially paralyzed, he probably won’t have a chance to rape her again, but will likely be dependent on her. Win/Win.

Another possible aspect to the situation, re: the restraining order. Hopefully someone can enlighten me regarding WI law on the matter.

I'm from Texas, and in Texas, violation of a protective order is a SHALL ARREST offense for peace officers. This means that if the cops fail to take the violator into custody, they are actually breaking the law.

So, if the same applies under WI law, as soon as those officers identified Blake (the enjoined party) and his ex-GF/fiancee/baby mama (the protected party), they would have been required by law to arrest Blake. Which would make everything else going on with kids, car keys, and warrants irrelevant.

Now, like I said, that's Texas law, so if anyone can enlighten me on WI law, I'd appreciate it.

(Aside: I'll lay odds that the felony warrant for sexual assault was vacated because the victim, who now claims to be his fiancee, told them she wanted to drop the charges. The prospect of Blake receiving a large $$$ payout may or may not have influenced that decision.)

Hauptfrau said...

Kai: you are probably correct. Thanks. I think I remember reading that the caller later became somewhat uncooperative.

Rosalyn: also good points. Note, it was about the car; call was about the keys. See Mike Sylvester‘s summary.

I know that family members frequently lie, but quite blatant here (Blake didn‘t have a knife; he was just a Good Samaritan trying to break up a fight; he was shot 7 or 8 times—Not 4 like his attorney said, etc). But disappointing that the MSM and the Evers administration uncritically parrot the version of people with an obvious motivation to lie.

Jacob Blake's family to lead Kenosha rally against police violence

Event organizers said the demonstration would include a march to the Kenosha County Courthouse and speeches by members of Blake's family, Lt. Gov. Mandela Barnes, U.S. Rep. Gwen Moore and other community leaders.

“We are heartbroken and enraged, but we are steadfast in our demand for justice,” Tanya Mclean, a Blake family friend who helped organize the event, said in a statement. She said Blake's shooting is not an isolated incident, but part of a “brutal, racist system.”

“We’re here to demand an end to police violence and systemic racism in Kenosha,” Mclean said. “No more piecemeal reforms and useless committees. No more Band-Aid solutions over the bullet wounds. The time for transformational change is now.”

I can easily justify pretty much anything that's done to you, once you've decided to start teh violence.

Which is what Blake did

JAORE said...

"You can't justify shooting a guy seven times in the back with anything."

Wrong again Crack. Shootings are justified if the cop has reason to believe he, or others may be in danger. We may disagree on this, but, to me, a felon who has just fought with the cops, shrugged off two tasers and is reaching into a car and has a knife.... As I say we'll likely disagree.

Now, if for just a minute, you can imagine the guy was a deadly menace, shooting is justified. And if shooting is justified he needs shot until the cop(s) are damn sure the danger is past. You can't seriously think the cops should say, "I shot once. Now I need to assess his mental state and physical ability to keep fighting". Ooops, he's now turning towards me with the knife. Bang. Time to reassess. Dang, I got a knife in my ribs.

Apparently he was hit four times. Yet he did not die. That demonstrates the stupidity of the SEVEN TIMES outrage. If it took seven shot/four hits before he was no danger, seven shots was the correct number. If it took seventeen shots, then seventeen would have been the correct number.

It also really makes the Biden statement about if the perp is unarmed, like with a knife, shoot him in the leg one of the dumbest things I've ever heard.

Apparently Mr. Blake had Black Privilege (i.e., the right to completely ignore the police) and was able to shrug off the officers and ignore a taser (probably a misfire). As he went to his car, the cops should have done what Crack?

Self defense experts say to keep shooting until the attacker stops moving or you run out of ammunition, which ever comes first. The fact that he has turned his back doesn't make any difference, he could be reaching for a gun--keep shooting.
