Does the President have the executive power to order and direct federal government officials and personal aides to assist a foreign government in investigating corruption against an opposition party member and former Vice President's family when the charges of corruption come from another country's Prosecutor General and with supporting evidence present (i.e. the former VP publicly claimed to get the former prosecutor general fired, the former VP's son was involved in an in-country scandal, etc.
If the President has that power, which I would argue he does, then this is a non-issue.
If we are claiming the President does not have the power to encourage foreign country corruption investigations if the subject of the investigation involves an opposition party leader, then what exactly is our executive's role in pursuing the elimination of corruption?

Before his election, Trump’s position in society was roughly equivalent to that of an Earl in feudal England. Back in the day, no reasonable person expected the Earl not to fuck the help or local whores. No reasonable person expected the Earl to know the fuck about anything other than his own property. The ICIG, who accepted this complaint, despite a legal opinion that the President is not subject to ICIG oversight, was previously senior counsel to John Carlin and Mary McCord who were the former heads of the DOJ-NSD in 2016 when the stop Trump operation was underway. Carlin famously resigned at the time that the first Carter Page FISA applications was filed with the FISC - after having approved the underlying paperwork for the application that heavily depended upon the then uncorroborated (now discredited) Steele Dossier. Remember - the defense that Comey is going to use for his verifying the FISA applications he signed was that the paperwork was in order. The people at the top of the stack verifying that the paperwork was in order and accurate were the heads of the DoJ-NSD - Caron and McCord. Their senior attorney was Michael K Atkinson, who is now the ICIG. The DOJ-NSD was also the DoJ side of Crossfire Hurricane (run on the FBI side by Peter Strzok, and somewhat supervised by his boss, Bill Priestap).
The acceptance of the whistleblower complaint was contrary to a DoJ OLC opinion. The ICIG has jurisdiction over the intelligence community (IC). President Trump is not part of the IC, and, thus, the ICIG has no jurisdiction. (The only IC involvement here is supplying the four or five people who transcribe the conversation, and possible illegal recording of it).
This is a major power grab of the deep state, to extend ICIG oversight to include Presidential communications. It should surprise no one that the Lawfare people are involved in it up to their eyeballs.

Does the “foreign campaign contribution” angle sound familiar? It should, because that argument was used in the narrative around the Trump Tower meeting with the Russian Lobbyist Natalia Veselnitskaya. More specifically, just like FARA violations the overused “campaign contribution” narrative belongs to a specific network of characters, Lawfare.
The center of the Lawfare Alliance influence was/is the Department of Justice National Security Division, DOJ-NSD. It was the DOJ-NSD running the Main Justice side of the 2016 operations to support Operation Crossfire Hurricane and FBI agent Peter Strzok. It was also the DOJ-NSD where the sketchy legal theories around FARA violations (Sec. 901) originated.
The Intelligence Community Inspector General (ICIG) is Michael K Atkinson. ICIG Atkinson is the official who accepted the ridiculous premise of a hearsay ‘whistle-blower‘ complaint; an intelligence whistleblower who was “blowing-the-whistle” based on second hand information of a phone call without any direct personal knowledge, ie ‘hearsay‘.

2 issues:
1) Trump accepted the recommendations for many jobs from the GOPe and those guys were perfectly happy to place dem-leaning "Lifelong republicans" in key roles and who ended up supporting the dem removal efforts. There was no way Trump could personally analyze who all these people were. He won the White House with a trusted team of about 10 people only and all were outsiders.
2) The Lawfare crew (including Weissman et al) had already pre-constructed the scenario where every legal action taken by Trump would be melded into their end objective: an obstruction case. The obstruction case was required since all the dems knew from day 1 that the Russian collusion BS was just a pretext.
The dems needed obstruction. For obstruction they needed a "crime" to investigate. To get to a crime without having to follow real procedures and to keep from being stopped and to hide all the nefarious dem activity they needed a "counter-intelligence" "investigation" targeting Trump. To get to Trump they needed a series of other pretexts: hence the laughable Logan Act "concerns" over Flynn and subsequent setup, the BS FISA warrants against Page and the drill down into Manafort/Cohen, etc driven by the hoax dossier which the dems/Ohr/FusionGPS/CIA/DOJ-NSD created out of thin air created out of thin air and supported by Brennan's many spies and provacateurs launched into the Trump campaign (Crossfire Hurricane)
Since all of that failed, this is the exact same script being rolled out with the fake "whistleblower" "report" being used as the hoax dossier replacement.

Too late. Far, far too late.
I read the entire complaint. The core of the issue discussed is Lutsenko (the Ukrainian Attorney General equivalent) was a part of the Poroshenko government- a government basically installed after the US-EU encouraged coup against the elected government of Yanukovych.
You have to know the history here- Yanukovych was elected by winning overwhelming margins in the majority ethnic Russian states in the east of Ukraine (the Donbass and Crimea) and just enough of the rest of Ukraine. After the coup, Poroshenko was installed as the president and the eastern regions broke away in revolt with the full encouragement of Putin- Crimea even had a referendum that voted overwhelmingly to join Russia outright (they were already 75+% Russian beforehand, so such an outcome on a open vote was a sure thing). Lutsenko was Poroshenko's AG, and Poroshenko and his government actively curried favor with their benefactors, the Obama Administration.
Even before Lutsenko's comments this past Spring about the 2016 campaign, which are contained in the Whistleblower complaint, there was abundant evidence that the Poroshenko government was actively aiding the Obama Administration's efforts to investigate Paul Manafort- efforts that started almost to the day Manafort joined Trump's campaign as, first an advisor and then later as campaign chairman. After the election, though, the Ukrainian government has been trying to make nice with the president whose campaign they actively worked against. It is entirely possible that Lutsenko's comments about the evidence he has that the previous government was actively interfering in the 2016 election is just made up as an effort to save his job, but the other evidence available suggests that the evidence is probably valid, and Lutsenko is only now willing to share it because Obama is gone along with Poroshenko.
If Lutsenko's evidence is real, it will probably show that the Obama Administration worked actively with the Ukranian government to interfere with the 2016 election. Poroshenko wanted a continuation of the Obama Administration and was quite willing to help get Hillary Clinton elected. It is this interference that is mentioned as the top line investigation item in the July 25 phone call- this is being investigated by USA Durham at the request of AG William Barr, and this can only be done with the aid of the Ukrainian government- this is why Trump pressed it, and he did so entirely appropriately.

As for Biden, he is on video bragging about getting a Ukrainian prosecutor fired and using US aid as the quid pro quo. Sure, after the fact, the Biden supporters are trying to claim it had nothing to do with his son's employment (for at least 1.5 million dollars over an 18 month period that we know of) by a Ukrainian oligarch, but the prosecutor who was fired has contradicted this directly. Lutsenko claims to have a list of people who could not be investigated as issued by representatives of the Obama Administration, and Joe Biden was Obama's chosen head of the Ukrainian outreach. Biden has already lied about not knowing about his son's connections to Burisma- his own son outed this lie unintentionally. It is entirely appropriate to ask the new Ukrainian president to look into the past example of the US government coercing the Ukrainian government on internal justice issues- indeed, it would be corrupt to simply overlook it. That Biden might be the Democrat nominee is irrelevant- he isn't the nominee yet, and having this stuff brought up now will benefit the Democrats going forward since they can just not choose him as a candidate. What is good for Joe Biden logically what is good for the Democratic Party- a lesson the Democrats should have learned in 2016, but maybe haven't.
Finally, to Giuliani- Giuliani hasn't hidden anything- everything he has done has been open and above board- indeed, the complaint makes this point indirectly since all it does is quote Giuliani's own public statements.
I can see why the DoJ simply referred this back to the IG- there is nothing illegal here, and really nothing improper either.

Now to Crowdstrike:
It wasn't clear from the phone call as to what Trump was referring. At first, I thought Trump was referring to a server that Crowdstrike claimed was involved in hacking the DNC server which was clearly US based. Remember, Crowdstrike claimed the DNC server was hacked from overseas by people connected to Russian intelligence, but the DNC never turned the server over to the FBI or the special counsel, Mueller. Mueller just took Crowdstrike's word for it- if you don't believe me, just see Mueller's reply to Roger Stone's request for the evidence that the Russians hacked the DNC- Mueller's team admitted that they didn't have any to turn over and that they hadn't even seen the full Crowdstrike report.
However, the whistleblower claims that Trump was talking about the DNC server itself, or possibly the mirror of the server as obtained by Crowdstrike. Now Crowdstrike was apparently founded by a Ukrainian by the name of Alperovych, so it is possible that it is the DNC server or its mirror. Getting this evidence should have been a priority for Robert Mueller, but he doesn't appear to have even tried by his own admissions in court documents. That Trump has asked for it is a good thing- it can show definitively that the Russians were responsible for the hack, or disprove it conclusively (what I think it would show). CrowdStrike wouldn’t have had the server itself. That isn’t the way it is done. Rather, the disk, or virtual disk, containing the email hive would likely have been imaged, and the image (or “mirror”) worked on. And, as standard practice, probably duplicated by CrowdStrike before they began. The question then would be whether the original image sent to CrowdStrike, or one of the copies, survives. If I had been their attorney, I would have said “hell no”, and made sure that normal document retention policies were followed, resulting in their destruction. (And, yes, I have been the ogre setting out, and enforcing such policies).
Perhaps Trump's best strategy now is to more explicitly assert his divine right to rule. Half the Dems would have apoplectic seizures, thus denying them the numbers for impeachment. And, Republicans are already on board.

If the Democrats want to keep going down this road, the whistleblower will have to come forward and testify and be cross-examined. This is especially true given the nature of the complaint itself whose main allegations are all hearsay followed by conjecture to intent. The whistleblower will have to come forward and name names if this is going to be used in impeachment- there is no alternative. I find it interesting that no one has leaked the name, which suggests to me that the identity is damning for the Democrats. I mean, this would be prime material for the NYTimes and WaPo- give a face to the accusations against Trump- by keeping it all anonymous undercuts the narrative with most normal human beings.
I had missed this point of the story. Read the transcript: the "favor" he asked for was helping the US people track down what Crowdstrike and Ukraine had done to trigger the Mueller investigation. Biden is mentioned much later, just thrown in.

It is also my understanding that there was no ongoing investigation of Burisma at the time the prosecutor was fired. It is also my understanding that there is no evidence that Hunter did anything wrong. He was not a government employee, he could take a position on the board if he wanted to. He didn't need anyone's consent. If he was picked to be on the board because they thought he would have influence, so what? And of course the fact that the company did something illegal (what did they do that was illegal?) doesn't mean that every board member had knowledge. As for whether Hunter had knowledge about the business, often outside directors are not experienced in that industry. And, as I said, if he was hired as a means of gaining influence with the administration, that is not Hunter's fault, assuming he made no claims that he had such influence (even if he did, I don't know if that was illegal - prob not)
The question is whether Joe took any action as VP with the intent to profit his son. I haven't seen evidence of that. Give me a cite.

There have been multiple links in the past few days' threads demonstrating there is no reason to believe this defense offered by Biden's people. The prosecutor who got fired has contradicted this, as has several other Ukrainians in the position to know.
What isn't proven is that this is the reason that Biden coerced the Ukrainians, but then Biden also lied about not knowing his son worked for Burisma at the time, but Hunter Biden himself contradicted that claim in a news story directly quoting him, and published by journalists otherwise quite friendly to Democrats.

The scandal here is what was done in 2016 by the Obama Administration in aiding the Clinton Campaign. The main thrust of the phone conversation was in getting the Ukraine's cooperation with that investigation, which is a real investigation being run by the Department of Justice- this is the reason Trump mentions the Attorney General again and again- they are running an investigation, and it probably does include looking at graft and influence peddling by people like Hunter and Joe Biden- it has to given that Biden video and his lie about not knowing his son was getting $600,000+ per year from a Ukrainian oligarch who had ties to the Yanukovych government and was being investigated by the Obama backed Poroshenko government. It looks corrupt that such a Yanukovych ally could have transitioned so easily into being a Poroshenko ally, all soon after hiring Hunter Biden for a couple of million dollars over 2 years- sure there is nothing corrupt there at all.

Biden has a long history of reworking events in his head, then talking about them as if he were the hero at the center. You don't have to consider any motive connected to a scheme - it's just something he does.
Mitt Romney’s national security advisor in his 2012 campaign — a career CIA spook who rose to its top levels — sits on the board of directors of Burisma, the Ukrainian gas company that formerly paid Hunter Biden $50k a month despite his complete lack of credentials or qualifications.
And it also an odd coincidence that Mitt has as CNN puts it “been a lone Republican voice expressing concern about President Donald Trump’s July phone call with Volodymyr Zelensky in which Trump asked Ukraine’s President to investigate former Vice President Joe Biden and his family.”
Still more oddly coincidental is the background of Mitt’s adviser deep in the CIA, part of the intelligence community that has “six ways from Sunday” in foiling a mere president who might oppose them, according to Chuck Schumer.
Isn’t it also true that the whistleblower’s attorney work for Chuck “Six Ways from Sunday” Schumer?

Got to give Baquet credit for letting us know that this guy was a CIA analyst who evidently recently returned to the CIA after his gig in the White House. Since there probably aren't that many people who fit that description, his name will likely become known...sooner rather than later. Along with his Leftist political affiliations.
And that's OK, because CIA analysts (unless assigned to the Operations side of the business) usually don't work under cover.

My understanding -- which may be wrong -- is that Biden Sr. wanted the prosecutor removed because he was not investigating corruption cases enough.
It is clearly wrong. There is video of Biden himself admitting it. The prosecutor's own words prove it wrong.
There is no point talking to these people if they refuse to accept the truth and the mountain of evidence out there.
They are making a conscious decision to create an alternate reality.
They are enemies of freedom and enemies of the republic.

Not odd if he thought he was entitled to do it. Bad judgment to brag about it? Yes. But this is a guy who groped the wives and daughters of public officials at public ceremonies without thinking twice. He seems to think he's untouchable (ironic, for a guy known for being handsy).

John Solomon reporting tonight he has 400+ pages of docs that will prove the Ukrainian probe into Hunter Biden was ongoing when Joe Biden called for the firing of Shokin and that the new prosecutor disputed his predecessor was somehow corrupt. Below, Solomon talks about this cache of documents. He says the media is easily spun by Biden's people on this issue because they, get this, haven't bothered doing the most minimal work of actually reading the primary documents available to them.

This all are indications that te whole thing is a (very Likely Lawfare) setup.
Keep this in mind:
- The ICIG has no legal jurisdiction to have accepted the whistle blower complaint in the first place. He has authority over the IC. And that does not include the President, or likely anyone in the White House who wasn’t seconded over there by an IC agency (such as the people transcribing the conversation).
- Congress could not have made the President subject to an IG, if they had wanted to. He is the chief executive, and all Executive power is delegated from his Executive power under the Constitution. Separation of Powers prevents Congress from putting anyone above or second guessing the President. That is why the letter of the relevant statutes do not claim to cover the President.
- This has been confirmed by the DoJ’s Office of Legal Counsel (OLC).
- Even if the ICIG could oversee Presidential communications (he legally can’t, of course), second and third hand hearsay, as here, is insufficient to justify opening an IC investigation. Congress can, of course, listen to anything they want, but the IC tasked with policing lawbreaking in the various departments and agencies, cannot, because the evidence is inadmissible in courts.
- The ICIG has close ties, and worked directly for, as their chief counsel, two people who ran the DOJ NSD, which generated the paperwork used by the acting AG to certify the four Carter Page FISA warrant applications, despite presumed knowledge of the lack of provenance of the Steele Dossier that the warrants depended upon. One of them was John Carlin, who famously retired immediately after apparently approving the paperwork used by DAG Yates to legally justify signing the first FISA warrant application.
This is why I think that Lawfare is involved up to their eyeballs. Someone, outside the DOJ OLC, intentionally misinterpreted the statutes enabling the IC IG, and then intentionally ignored the OLC rulings that the President was not covered by those statutes, and was not subject to IC IG oversight. This smells to me just like the creative lawyering that we saw with the Mueller prosecutors reinterpreting the Obstruction statutes to change them from requiring specific intent, to requiring mere general intent. Which, of course, also ran afoul of OLC statutory interpretations.

Billy Bulger sure rose quickly in the Mass legislature. Couldn’t have had anything to do with the fact that his brother was a well known murderous maniac. He lost his pension, I think, when it was discovered that he was remaining in contact with his brother, the FBI corrupter, Whitey Bulger.
I love how they are ginning up charges of a coverup here, when Trump has already released the information that he is said to be hiding. Most likely, they knew the “whistleblower” was going off the rails and cut off his personal access to information he clearly was going to leak. I don’t know how keeping a renegade spy in the dark is a “coverup.” The world these guys live in. But still the word “coverup” is splashed across the media, as another baseless smear to imply guilt.
This is such a grevious violation of trust between the IC and the White House that it would not surprise me if IC officers are barred from all access to POTUS phone calls with foreign officials.
Why not just shut down the CIA ? 90% of the "officers" spend their days reading foreign language newspapers. The rest plot how to keep Republicans out of power.

I think Trump would be perfectly justified in ending the practice of CIA transcriptions of his phone calls with foreign leaders. They have to be asking themselves overseas what kind of crazy the US is going through now with spies thinking that they are the arbiters of what can and cannot be said, and newspapers deliberately distorting conversations that could easily be leaked.
