"Charges Dropped In Jussie Smollett Case."

CBS Chicago reports.

ADDED: The Chicago Sun Times reports:
“This is without a doubt a whitewash of justice, and sends a clear message that if you’re in a position of influence and power, you’ll get treated one way, other people will be treated another way,” [Chicago Mayor Rahm] Emanuel said. “There is no accountability in the system. It is wrong, full stop.”

Ed Wodnicki, the 18th District police commander who oversaw the investigation, called the decision to drop the charges “a kick in the gut." He said the $10,000 in bond forfeited by Smollett “doesn’t come close” to covering the cost in resources and manpower to probe the heater case that drew national attention.“I think the citizens of Chicago should be upset about that... We wasted time and effort on a reported serious, serious crime, to get to the point that it’s a lie? I want reimbursement. I’m a citizen in the city of Chicago. I want my money back... We were absolutely prepared to go to trial. We were rock solid. We were excited to have this case prosecuted”....
Can Chicago prosecute anybody for making a false report now?

Well, we see once more that there is a two-tiered justice system in this country. If you're a well-connected leftist/Democrat, your crimes get ignored or, failing that, the authorities decide not to prosecute you. I'm sure a lot of the cops who wasted their time pursuing his false report are pissed off, but the Democratic machine came thru for him in the end.

Yet another lesson in the necessity of "innocent until proven guilty". I wish people would learn this lesson. In Madison, there was the example in the past year of a wrongly accused business owner who allegedly kidnapped and raped a women. Turns out this was an attempted bribery of the business owner. Sometime injustices occur. Until we learn more about why charges were dismissed, I am withholding judgement--as should have been done before this announcement.

Who knows? Maybe it was Nigerian scammers who set him up because he is an insufferable d-bag ;) But until there is a fair hearing and evidence is heard and challenged, we just don't know.

I'm guessing that there are two other factors:

Those two Nigerian brothers were pretty rough around the edges and they couldn't clean them up sufficiently for the witness stand.

Chicago - the likelihood of jury nullification, a la OJ, was immense. Which is to say that getting a completely non-Black jury was of course an impossibility.

Why does he have to forfeit the bond? The bond is his money, after all. If you are going to drop the charges, you have to return the bond.

I realize that there never was going to be a conviction in Chicago- it was a hopeless case to win in Chicago- but, still, if you are going to drop the charges, do so properly by returning the bond. The way it was done basically looks like a $10,000 bribe paid to the City Attorney's office in return for a dismissal with prejudice.

Talk about the Chicago DA's office making a fool of itself. 16 indictments always seemed a bit like charge-happy prosecutors going overboard, but dropping everything weeks later can't help making the office either seem irresponsible in bringing the charges in the first place or making it seem like the DA dropped the case due to political reasons/political pressure.

Here's the thing though, and there's no getting around it: The court of public opinion has ruled that he's a heinous individual. And this exoneration looks extremely bad. This will follow him the rest of his life. He'll never be able to recover his reputaion.

Haven’t read the other comments yet so maybe it’s been said. Apparently the prosecutor dropping the charges is really close to Michele Obama, and the police chief is “livid”.

But regardless, how does this happen? A city police chief gives a press conference showing quite publicly how pissed he is that Smullett wasted so much of the cops’ time and energy. Prosecutors empanel a grand jury. Grand jury issues an indictment including 16 felony counts. And then, lead prosecutor simply drops all charges? 16 felonies? Not even going to try any of those charges? And the judge seals the case?

The proposed anti-lynching law championed in the US Senate by Kamala Harris and Corey Booker would give jurisdiction to the US Federal Government whenever two or more people attacked someone because of racist or anti-homosexual motives.

I suspect that Jussie Smollett's main motive for his hoax was to help justify this proposed law for Senator Harris and Senator Booker.

Since the Democrat Party needs to maximize Black voting in 2020, the Democrat Party cannot back off from the anti-lynching law. Therefore, resolving the prosecution of Smollett was a requirement of national importance for the Democrat Party.

The Democrat Party intends to make a big issue of the anti-lynching law in the 2020 election and cannot afford for the Smollett prosecution to continue into 2020.

It was a solid case, but the Prosecutor can drop any case they choose to (Prosecutor's Discretion). Since Foxx become SA for Cook County, it has become increasingly common for the ASAs to tell the Detectives that they won't approve felony charges because they don't want to give somebody a criminal record. The Police can get an override, but the case won't go anywhere, the ASAs always kill override case in court later on principle.

Smollett has some powerful friends, and many of them are friends with Foxx. There was a lot of interference during the investigation. They had to charge the case because the evidence was so solid and because of the publicity, but they were looking for a way to kill it.

Smollett forfeited his bail of $10,000 (same as a $10,000 fine). The justification is that it saves the cost of a trial.

The worse part of this is that the records are now sealed. Which is a shame because those records show beyond a reasonable doubt that Smollett orchestrated the whole thing.

The cynic in me says this smells of the Obama's touch - since the CBS story indicates a connection to them in the Prosecutor's office. It also fits his mode of operation too - sealed court records to shut down inquiry.

This seems like the perfect foil to the Mueller exoneration of Trump. "Why Jussie was cleared in a Court - why don't you believe that"? So now Trump and Jussie are both innocent or else you are being prejudiced to not "accept" the wisdom of the legal system. And if Jussie is guilty - well why should I believe Mueller?

In the British cop shows, even cold-case murder investigations use dozens of people and copious resources, while their street crime and burglary are rampant. CPD seems to do the reverse, and the city gets all three types.

Jussie registered nolo contendere that's the only reason he forfeited the bond and was credited for community service, though past community service should not have counted. The sealing of the proceedings seems improper and highly suspect, but I suppose enough money was spread around to the right people.

Interestingly, everything Jussie said is technically true. He was attacked by two men he couldn't identify and they yelled racist things, poured a liquid on him put a rope around his neck and said this is MAGA country. Of course he paid them to do it and they wore masks so he couldn't be absolutely sure if they were really the brothers he paid.

The rules are different for the "good" people. Black, gay, rich actors who are vocal Progressives are "good" people. God help anyone who's not good and commits the same crimes!

No mention in the linked report how when the whole Smollett story was falling apart, the Obamas reached out to the Cook Co. State's Attorney (Kim Foxx) via Tina Tchen, Michelle's Chief of Staff as First Lady and before that a senior counselor to the President, to get her to have the investigation moved from Chicago Police to the FBI--for no apparent reason. That didn't happen (no reason for it and no basis for FBI jurisdiction, but the Obamas had made their interest known. When the Obamas reach out and touch a black elected official in Cook County, using a fixer as personally close to them as Tina Tchen, you better believe the message comes through loud and clear.

This stinks to high heaven, but as it's the Obamas acting corruptly, we will never hear another word of it.

A couple of factual points:
1. The judge who unsealed Jack Ryan’s divorce papers was in CA, where the divorce took place.
2. Jussie has already performed the required community service according to the prosecutors. They have not specified what it was but it maybe his past work standing up for marginalized people.
3. One comment above suggested that we reserve judgment until there is a hearing. The whole point of this deal is that there be no hearing. Case closed, record sealed.
4. This is a seriously bad outcome for this town. It should be interesting to hear the mayor and the police chief have to say, but I bet they are going to blame the leakers in the CPD for ruining everything.
5. Smollett’s lawyer said that the brothers confessed so she believes they committed the attack. She said the state mat have evidence as to motive, but of course the record is sealed.
This is a clown show of the first order. I am going to vote now against Toni Preckwinkle, who is Kim Foxx’s political sponsor

The prosecutor has tacitly admitted as much I think by insisting this is not exoneration and there were no problems with the investigation. If there are no legal issues and no exoneration, why then drop charges? Because of who he is. The prosecutor said that too, when he said there is no danger from Smollett.

It is interesting to watch Rahm, Supt. Eddie Johnson, and the CPD get played for suckers by the State's Attorney office. I believe Joseph Magats (who took over when Foxx dropped out of the case) is the guy who got the 16 counts from the grand jury. Now he's saying that this outcome is what would have been obtained from a conviction, so it's actually the efficient administration of justice. He must have had a religious conversion.

A few thoughts:
1. Things like this don't happen here for the efficient administration of justice. They happen because somebody leaned on somebody. Who, why, or how I don't know, but this smells like it came from Hollywood, not from Englewood.

2. Emanuel and Johnson were both hung out to dry. This happened on a hurry-up basis like the best-run McDonalds you have ever been in. Jussie was in and out of court in five minutes. Jussie admitted nothing and gave a press conference saying he was innocent and a victim. Magats said Jussie was guilty and got what was coming to him if he had been convicted. This is preposterous. The point of this up until now is to discourage people from engaging in fake hate crimes, so they want the perp to admit guilt and get a sentence that is at least inconvenient. Jussie lost the ten grand he had already paid and got credit for past community service! Lifetime achievement community service! This is like the Hillary Clinton deal. This is more like a hand massage than a wrist slap.

3. Jussie's lawyer Patricia Brown Holmes was the special prosecutor appointed to chase the cops who covered up for Officer Van Dyke in the Laquan McDonald shooting. In a trial before a judge, the cops she charged were acquitted. She has seen how it goes before a judge and before a jury. She didn't need to take a chance on this one. She very cleverly maneuvered this case outside the judicial system: charges dropped, no hearing, record sealed, case closed.

Don't make no waves, don't back no losers, as they say around here.

Smollett's hoax incited racial fear and hatred. It could easily have resulted in another Ferguson or Baltimore scenario, where outrage over violence against a black man erupts into widespread mayhem and destruction. Even without triggering a riot, he increased the perception of threat that black kids already feel. His crime was an exceptionally wicked one.

I am glad they did not try to send him to jail, as Scott Adams said he was not accused of trying to incite hate he was accused of a clownish attempt to get a bigger salary.

I watched a Wolf Blitzer interview with Kamala Harris. Her answers regarding this case were unintelligible. She had nothing negative to say about Smollet, the State Attorney, or Emanuel but, as noted, her words were mostly gibberish. When it came to Barr and his need to release the Mueller report in its entirety, she spoke with precision and moral clarity.

* No one will ever believe that rich, liberal, and famous don't get the law their way (I wonder if Aunt Becky or William Macy's desperate housewife are taking notes)

The following information is publicly available:
Smollett says that he was attacked late at night during a polar vortex.
Smollett identified the Nigerian brothers as his attackers from surveillance video of the street. He stated that he was 100% certain.
The Nigerian brothers are captured on store surveillance video buying the rope, bleacher, etc.
The clothes used in the attack, bleach, etc. are found in the Nigerian brothers house.
The Nigerian brothers give a full confession that Smollett orchestrated the scheme and paid them for their participation.
Police obtain search warrant for Smollett's phone records showing multiple communications with the brothers around the time of the staged attack.
Smollett pays the brothers with a check for their services.
Smollett is indicted for 18 felonies before a Grand Jury, the Grand Jury determined that all 18 of those charges had merit and that Smollett should be charged.

How exactly was that "well-played" by Smollett? What is a "Smollett-truther"? Why do you think that Foxx dropping the case despite the over-whelming evidence was the correct decision? Do you think that the Rule of Law is a bad thing? What benefit do you think is provided by staging fake hate crimes?

I'm trying to think of an analogous case. For argument's sake, if General Flynn had actually been detected in the act of betraying the country to the Russians (!), had been clapped in irons, and sent to a black site, his real or accused crimes suppressed as is being done in this case, for how long would President Trump have gotten away with that?

Alternatively, is that what they expected, is that the kind of thing that they want to see him do? Would they be happy with him then?
