This is the message they are trying to send: If we can do this to the Boy Scout Brett Kavanaugh, we can do it to anyone. the more ridiculous the better. . .
If we can accuse Brett Kavanaugh, one of the most respected lawyers and judges in America, of gang rape, we can accuse anyone of anything! ! !
That is the Democratic Party’s message. And we have learned from the Christine Ford fiasco that accusations don’t require corroborating evidence. . .

Seems to sum it up well.

I am not a bit fan of the Republicans, but I lean R because for all their faults they serve one useful purpose: the stop the Democrats. This shit show has convinced me all the more firmly that the GOP must win this election. My preferences are a bad guide to politics but I have noticed over the years my initial emotional reaction to things is quite a good guide. I am disgusted with Feinstein and the Dems here. If the GOP doesn’t blow it I think they win big on this issue. Will it be enough to win November? Don’t know yet.

I think the Dems and Miss Ann will learn that lesson in November.

It won't be"cruel neutrality", but cruel reality.

Seems to me Miss Ann is trying intellectually to emulate "Shroedinger's Cat" thought experiment, where one can't know the outcome until he opens up the box.

But some things are manifestly true or false, at least according to the legal standards that Miss Ann MUST know apply. "Beyond a reasonable doubt", for example.

I guess there's a convenient exception: "Believe the woman". In all cases.

Conservative Treehouse

The highly predictable strategy by Democrats, far-left activists and compliant ideological media to smear/destroy Judge Brett Kavanaugh is solidly in phase three:

√ Phase 1 – Activate last minute delay chaos (prior “Me Too” investment).
√ Phase 2 – Use sex assault claims to demand investigation, further delay. Use republicans, not democrats, to establish/frame the delay.
√ Phase 3 – Use investigation to frame validity narrative; further delay. Use republican fear (leverage Jeff Flake) not democrats, to continue the delay. Manipulate FBI. Shift investigation goalposts. <=WE ARE HERE
Phase 4 – Use “deeply flawed investigation” narrative (witnesses ignored); to isolate Murkowski/Collins and keep Flake in position. Drum mid-term “Let the voters decide”.
Phase 5 – The mid-term election.

So far, the DC UniParty is executing this flawlessly. The shift to Phase 4 should be anticipated for Thursday’s media-cycle. On/Around October 15th the mid-term gravitational field will take over

Even the GOPe is learning, though slowly. Threatening a witness is a federal crime.

I think it's entirely possible that some people did threaten her with death. If so, they should be investigated by the FBI.

I also think it's possible that these death threats were manufactured in-house to create sympathy for Ford.

Either way, that should be part of the FBI's investigation this week. It's highly relevant. Check her computers and track down those death threats.

A good column today about what is really going on.

Among other things, it follows that Donald Trump’s tenure is, for these people, existentially illegitimate. And from that conviction it follows that a policy of resistance, obstruction, and illegality is (in the minds of these people) sanctioned. It is OK, for example, for a Justice Department official to boast that he is conducting a guerrilla war of “resistance” behind the scenes. It is OK to stalk Senator Ted Cruz (R-Texas) and his wife to their favorite restaurant and scream at them until they are forced to leave. Why? Because Cruz supports Kavanaugh. And so on. (Wouldn’t you like to know what Deputy Attorney General Rod Rosenstein said to the spineless GOP Senator Jeff Flake the other day just before Flake announced that he would allow Kavanaugh’s confirmation to proceed to the Senate floor only if there were another FBI investigation authorized into his behavior in high school?)

Here is my thought. The scurrilous attempt at character assassination directed at Brett Kavanaugh is part of a larger war: the war to demonstrate that Donald Trump, though duly elected in a free, open, and democratic process, is fundamentally illegitimate.

That's the bottom line.

gilbar said...

Donald Trump, though duly elected in a free, open, and democratic process, is fundamentally illegitimate

It's True! Our living constitution explicitly states that to be qualified to be President, one person Must Be approved by the special set of people that run our country.
Those people were uniformly opposed to Trump. Trump had the audacity to think that just because 'the people' voted for him, that that meant he was President.

OldManRick said...

A blatant and very public lie from the Christine Ford camp. Someone should be thrown under the bus. Who will it be?

That lie is the fear of flying lie. It may not have been under oath but it was sent to the Judiciary Committee and they responded with the offer to fly to Christine Ford. So it was a lie to the Committee. It was a lie for what Ford’s camp perceived as an advantage, delaying her testimony. It was a lie that undermines the credibility of someone or everyone in Ford’s camp. And since it was used to deceive the committee, it could well be a lie that is actionable. Let’s look at the possibilities.

1. Only the Lawyers lied, they made it up out of whole cloth. They should have known it was a lie because she flew to Washington for her grandmother’s funeral and took the polygraph test. But for this to be true, it means they never checked with her. This weighs heavily against their ethics and competence as lawyers as they would open up their client to charges of lying.

2. Christine Ford lied to her lawyers and they unwittingly passed it on. When it came to sworn testimony, she couldn’t maintain that lie without obviously perjuring herself so she had to drop it. But this could cast doubt on the rest of her story. She knew the risk of perjury here, so she crafted other “facts” – only one drink, 100% sure it was Kavanagh – that could not possibly be confirmed one way or the other. She avoided facts, - where, when, how she got home – that could be used to show perjury. In any case, from item 1, the lawyers should have known it was a lie and stopped her from passing it on.

3. Christine Ford and her lawyers conspired to tell this lie. Both knew it was a lie but told the committee anyway. They didn’t expect the committee’s response of “we’ll fly to you” so they were stuck with it. They were doing it to get delays so they could “practice” her testimony. They were doing it to adapt her testimony to facts and responses to her allegation that would come out in response. At least one “new” fact came out when it was revealed that Kavanaugh had detailed schedule books. Ford responded that the party was an ad hoc event, not a scheduled event. Another aspect of this lie was that it was in conjunction with all the Democrat calls for delay. Her lawyers may have been more interested in helping the Senate Democrats than their client. After all, they are Democrat activist lawyers.

This brings us to the second aspect of the “fear of flying” lie. The testimony that she never knew about the Judiciary Committee’s offer to fly out and take her testimony, in private, to spare her the flight and the exposure that she claimed she didn’t want. We can look at the same three possibilities for that issue.

1. The Lawyers didn’t tell her. This one is simple. The lawyers were behaving unethically on behalf of the democrats rather than their client.

2. Christine Ford lied in her testimony. This one is interesting. By saying she never heard about the offer, she avoided any questioning about why she refused. She has portrayed herself as a reluctant witness who did not want to come out publically. The judiciary made an offer to maximize her privacy. She would have a hard time explaining why she refused this offer, so she reactively threw her lawyers under the bus.

3. Christine Ford and her lawyers conspired to ignore the offer. Delays were what the democrats wanted and what she wanted. Delays allowed MSM pile on; delays allowed the other accusations to come out to build momentum. The grand plan all along was to pressure Kavanaugh to withdraw or the republicans to bail on him. If that didn’t work, we were going to see the almost weepy testimony that we saw on Thursday. She and her lawyers didn’t have sense enough to prepare a good answer to why she refused the offer, so she panicked when asked.

Conclusions in next post

OldManRick said...

So who gets thrown under the bus?

I’m trying to look at this logically, not emotionally. The fear of flying lie, while not under oath, was made directly in her dealings with the committee, was made very publicly, and has been shown to be a blatant lie. It was made to deceive the committee. It was made to get the self perceived advantage of delaying her testimony. It should undercut credibility of a witness when they lie about something publicly and then recant that lie under oath knowing that they cannot sustain it. When I combine both issues, the logical answer is number 3.

By the way, if I look at this emotionally, someone tried to feed me a lie. I don't care if it was under oath or not. I don’t know when and where they stopped lying.

On stage Tuesday morning, Coons and Flake both expressed dismay about the partisan brawling over Supreme Court nominees. Coons called for “reduc[ing] the frequency with which we describe judges as wearing red or blue jerseys.” He argued that senators need to commit to reviving the practice of confirming nominees based on their qualifications, not ideology.

Now that Kavanaugh's been nominated, RGB will go soon, and Trump is likely President for the next six years, it's time for civility and nonpartisanship on the Supreme Court.

Civility bullshit, once again.

The problem is there are always R's who fall for it. Calls for civility when the D's are in the minority are rarely heard from them once they regain control.
