"A secretive letter shared with senators and federal investigators by the senior Democrat on the Senate Judiciary Committee charges that a teenage Brett M. Kavanaugh..."

"... and a male friend trapped a teenage girl in a bedroom during a party and tried to assault her, according to three people familiar with the contents of the letter. The letter says that Mr. Kavanaugh, then a student at Georgetown Preparatory School in suburban Washington and now President Trump’s Supreme Court nominee, had been drinking at a social gathering when he and the male friend took the teenage girl into a bedroom. The door was locked, and she was thrown onto the bed. Mr. Kavanaugh then got on top of the teenager and put a hand over her mouth, as the music was turned up, according to the account. But the young woman was able to extricate herself and leave the room before anything else occurred, the letter says.... She has declined to be publicly identified, and she asked Senator Dianne Feinstein of California, the top Democrat on the Judiciary Committee, not to publicize the letter."

The NYT reports in "Letter Claims Attempted Assault by a Teenage Brett Kavanaugh." Kavanaugh says "I categorically and unequivocally deny this allegation... I did not do this back in high school or at any time." And the male friend says "I never saw anything like what was described." Feinstein had been holding onto the letter since last July, which makes it feel like a last-ditch delay effort.

It seems like holding onto this information for so long would be at least a breach of Senate ethics, if there is such thing anymore. If it’s so important and believable, why wasn’t it given to the FBI right away? They would have had the time to investigate this, and if there was something there she could’ve used it during the confirmation hearing. Did her driver give it to her?

There is no point in surmising what happened. There is no contemporaneous evidence of an attempted assault from 36 years ago and the writer has asked to remain anonymous.

Kavanaugh does not need to defend himself, but I would probably answer the apparent charge as well. The guy has taken a lot of crap and this was the final straw.

A heavily medicated Anita Hill was used to subvert the Thomas nomination. Failing that, she gave cover for liberal racists to derogate the man. This stunt gives Leftists cover for denying Kavanaugh's legitimacy.

There may be a risk of a legal appeal by the FBI if they are ordered to reveal the redacted information. They may be able to obtain a cooperative judge to block it, as we have seen in so many cases of Trumps executive orders. This would go to the SC quickly, but a 4/4 SC is a high risk.

Trump has to work with an executive branch bureaucracy that is, outside the military, fundamentally opposed to his policies.

This is the equivalent of a poison pen letter.

1. This was allegedly in high school 35 years ago. There were lots of highly-charged, meaningless interactions between boys and girls at seventeen in my high school. None of them were criminal. Many are embarrassing in retrospect. They were part of growing up.
2. What does a letter charging bad behavior long ago with a stipulation that the informant will not answer questions and will does not want her name made public sound like? What did she think would happen?
3. How about the way Feinstein handled this? She had it in the summer and dropped it after the hearings. She didn't give the informant's name to the FBI. Did she appear to find this letter credible?
4. Are there any other similar allegations against Kavanaugh? He has been in public life for many years and repeatedly investigated. There is overwhelming evidence of Kavanaugh's good character.
5. This story does not have the ring of truth.
6. For further insight, see David Mamet's play "Oleanna".

This letter is really about Merrick Garland.

I don't think you can conclusively confirm or refute this woman's allegations. One thing that is definitely known is that Kavanaugh has led an exemplary and honorable life since the alleged incident. In the interests of fairness, we should make this woman's name public. Perhaps she, also, has led an exemplary and honorable life or maybe not. We should know something about this woman...... The accusation is unfair on so many different levels: the timing, the anonymity of the accuser, the accusations themselves.......I'd like to think that this will rebound to the detriment of Feinstein, but I doubt it. This will now become part of the legend of Kavanaugh.

It's not clear that the accusation here, even if true, is all that big a deal (even if he was a jerk once, twice, or deeply, in high school, that was a long time ago), and without details, of course he should just deny.

I don't think so. Or, at least it won't work very long. If Trump orders unredaction, then suing to prevent it by the bureaucracy would be rank subordination. They have no Constitutional power except by and through the elected President. They also don't have the power to classify or declassify, except through the President. i should also note that the FBI doesn't have its own prosecutors, or litigation attorneys - it has to do use those working for the DoJ, which means that a US Attorney, AG, DAG, AAG, etc, nominated by the a president and confirmed by the Senate (with the highly suspect inclusion of Mueller - suspect because he is acting as a principal officer, but wasn't nominated or confirmed, as required by the Constitution), must approve and supervise the lawsuit. The basic legal problem is that no one has standing here, because they cannot sue in the name of the government, because Trump is the government, or at least the Executive branch. So, who would be the named plaintiff(s)? As individuals, they wouldn't have standing (to sue the primary declassifier for declassifying documents), since any power that they might have to declassify would be as a result of their employment, and, thus be derivative of Trump's Article II, Section 1, Paragraph 1, Clause 1 Executive power.

You are correct that there is a chance at a 4-4 split, if this happens before Kavenaugh is confirmed - but that just means that no Republican Senator would dare vote against the confirmation, and the vote would be expedited even more. Or, both houses of Congress are recess for a weekend, and Kavenaugh given a recess appointment. Besides, they are unlikely to get all 4 Dem votes, likely losing both Justices Breyer and Kagen.

In general, the Left degenerates have outlawed common decency and 'bourgeois values' but when it suits them they act as if they are more puritanical than the Puritans.

In particular, accusing someone for something which is supposed to have happened +30 years ago without telling who the 'victim' is and without any proof that anything happened at all, let alone that a crime was committed, seems to me to undermine every rule of justice.
And asking the FBI 'to investigate', even if were true, is
a) outside their purview
b) outside statute of limitations
c) involves minors on both sides
d) and to recap, is BS as accusation
It is simply vile.
I can understand why a moral zero like Feinstein did it. "How can anyone under 'investigation' be confirmed?" Good that the FBI put a stop to that at least by deciding at once to refuse to hold a scam investigation.

I don't think they will get Kavenaugh's scalp. But how many people will want to submit themselves to this circus?
The only thing to do is for the Republicans, and the decent Democrats (if any are left) to see that there are consequences, to systematically ostracize the perpetrators and to stop being tolerant of the Left and its 'values', to stop being gutless waste in other words.

Agreed, but I am guessing that the above is true. My son went to a sex-segregated Catholic private school in the Philadelphia area, and there was an automatic linking of the all-girls Catholic schools with the all-boys Catholic schools. School dances, school activities, school plays, and private parties too. In fact, there would usually be one particular girl's school that would be most commonly associated with one particular boy's school. Kavanaugh may well have been in the same vicinity of this particular woman on any number of occasions---along with hundreds of other girls from the same school. Doesn't mean he sexually assaulted her.

Well the 'victim' has now gone on the record with a newspaper in CA. She says she remembered the events while in couples therapy in 2012. She says the vents devastated her for four or five years at the time.

Color me skeptical. The events occurred in high school 35 years ago. She can't even be certain of the exact details of where, when, etc. - but she definitely remembers being groped - with her clothes on. I think if the events really happened, she would have told someone then - not in 2012.

I think this is all a very well done hit job on the Kavanaugh confirmation process. It will probably work, unfortunately.
