"And no rule of civility demands the confirmation of justices who would leave an abusive president unchecked and use raw judicial power to roll back a century’s worth of social progress."

"There is nothing civil about rushing a nominee to replace Kennedy before the midterm elections."

Well, that's the perfect embodiment of what I mean by my tag "civility bullshit."

It's from E.J. Dionne Jr., "Don’t want a right-wing Supreme Court? Do everything you can to stop it" (WaPo). Everything?!
All the recent talk about civility should not stop opponents of a right-wing court from doing everything in their power to keep the judiciary from being packed with ideologues who behave as partisans.
It seems to me Trump won the election and he has the appointment power. He made Supreme Court appointments an issue and was strikingly clear about who he would appoint. I understand the motivation to oppose and obstruct him, but I don't think opposing him or going down without a fight has anything to do with civility. If those who want Trump's nominee confirmed are talking about civility, then they are the one's doing civility bullshit, and Dionne is just calling them on it.

But Dionne is doing a little something more: "There is nothing civil about rushing... no rule of civility demands confirmation...." He's gesturing (weakly) at the idea that there is something uncivil about rushing and that there is a rule of civility that demands that the Senate wait. The thing gestured at is hard to defend, so why not dribble out statements about what is not and avoid the trouble of making the difficult point? I'll say that too is a kind of civility bullshit.

But most of Dionne's civility bullshit is out and proud: He doesn't care about civility when it holds his side back. Because the other side is so awful it doesn't deserve the niceties that developed in the mythical past when good people amicably jousted over differences.

I still can't get over how lucky we are. It defies all logic and reason.

1. If the Dems run Joseph Biden, not Hillary, her e-mail problems quietly go away, and Dems probably win.

2. Even with Hillary, most people believed she'd win. I don't recall anyone predicting that Trump would get Wis, Mich, and Penn.

3. If Hillary wins, Comey is given an Ambassadorship or Judgeship, McCabe is made Director of the FBI, the "collusion" and FISA issues go away, and the Supreme Court is about to be a 6-3 liberal majority.

4. All border enforcement ceases; California politics begins to spread eastward.

I could go on and on.

So, at bottom, I feel a deep sense of gratitude at what we have, not a sense of confrontation against the Left who'd like to take it away.

I think one of the fundamental differences I have with a lot of the more adamant conservatives is that I think someone can be left, left-leaning, "liberal," or what have you, and not be a constant threat.

This mistakes the nature of the threat. The constancy doesn't come from an individual, it comes from the the cumulative impact of their political force. The primary drivers are institutions which are so controlled by the far left the reasonable left you identify (Althouse for example) is considered not left by anyone in position to meaningfully influence policy.

So despite the existence of left leaners who recognize corrupting Title IX into gender driven witch hunts is wrong we still have them because left institutions (mainly academia, media, and their allied NGOs) push these insanities.

That's the goal. If they can force non-leftists into the closet it's so much easier to demonize them.

I wonder where they learned that?

Absolutely. American conservatives are classical liberals tempered by Judeo-Christian religious/moral philosophy. Liberalism is divergent, but in degrees. Leftism is a bias for single, central, monolithic solutions, and can be a rational choice, the right choice. Ideology, character, people are a constellation, not linear, not merely multi-dimensional, and not monotonic.

There is no "bar". There is only a vague and high level constitutional constraints on the senate. The above simple majority requirements are few and specific. Besides, the Obamacare structure is weak because they changed the Senate bar by weaseling around the money rule.

How many times in the past 200 years has a VP or former VP been elected to the presidency?

There's Bush and Nixon. Then you have to go back 175 years to Van Buren.

VP is a disqualification for the presidency.

I think if Biden had replaced Hillary, enough Clinton supporters would have soured on her "getting a bad deal," to hurt Biden's chances. If he'd legitimately won the primary, I think he'd be in a stronger position to win. Replacing Clinton mid-campaign was going to kneecap the Democrats, much like primarying a sitting president is almost guaranteed to do.

But, I bet Republicans will do that anyway.

Bay Area Guy said...

Total speculation, but my gut is that Hillary had tremendous baggage over the deleted e-mails and FBI investigation and that Trump successfully hammered at both.

With Biden, that line of attack is gone. And, more so, Biden does have a bit of street cred in Pennsylvania.

No argument from me, just gut speculation.

One of fundamental differences I have with scarlet R's like Sablan is that I think that someone should be able to disagree with progs and Democrats without being subject to assault, termination, and social alienation. People can disagree without shooting guys playing softball, or without chasing a family with elderly folks and children out of a restaurant and across the street into a different restaurant and have a mob incited to terrorize them. People can disagree without wanting to kill everyone else. Progs and Democrat party members are unable to manage this apparently, but the internet....

I've been saying that Democrat leaders like Obama and Hillary would be Stalin if they could, and those who support them are communists, and that they need to be stopped, my entire adult life.

Problem is, lefties don't really think those are insults. And conservatives of the NeverTrump variety always, always, always step up to be the first in line to defend them, screaming and hurling invectives at anyone who calls liberals out as communists or communist tools, because they bought the literally-Stalinist narrative about Joe McCarthy hook, line and sinker. Well, that, or they're paid operatives infiltrating the GOP just like the left has infiltrated every other institution in the last 60 years... or in other words, McCarthy was talking about them, and once again he was right. I actually suspect the latter is more likely.

Mick predicted a landslide and generally 400ish EV's for Trump.

I predicted a Trump win among legal voters and only illegal votes in Nevada and Virginia would give Hillary the win if she won those states. The democrats were prepared and illegal votes did turn those states but Pennsylvania and Michigan were a nice surprise.

If the Democrats knew about Pennsylvania and Michigan they would have turned out a few more illegal voters in Detroit and Philadelphia.

Trump would have won the popular vote if California didn't have voting booths in Mexico.
