"[W]hy did Flynn lie? People who lie to the FBI generally do so because, if they told the truth, they would be admitting to a crime."

"But the two conversations that Flynn falsely denied having were not criminal. He may have believed they were criminal but, if he did, he was wrong," writes Alan Dershowitz, who explains why the things lied about were not criminal. I understand that.

But I don't think Dershowitz explains why Flynn lied. Maybe Flynn didn't understand that the things he denied were not criminal, or maybe he didn't want to have to fight for the proposition that these things were not criminal. It seemed like the easier path (when he didn't know he'd been wiretapped). Or maybe Flynn wanted to deflect political damage, since anything having to do with the Russians would be exploited as reinforcing arguments that Trump's victory was illegitimate.

Dershowitz jumps to the question why did Mueller only charge Flynn with lying. The idea seems to be that's all Mueller has: a crime unrelated to any "possible crimes committed by current White House incumbents."

ADDED: I thought I'd try watching the Sunday morning talk shows, and the first thing I saw, as I clicked on one of my 5 recordings, was "FLYNN FLIPS." But Flynn got charged with something that is really a crime and he chose to plead guilty. How is that "flipping"? I appreciate the poetry of the double "FL," but you don't know that he's "flipped" unless you know that the guilty plea involved some sort of bargain to testify or gather more evidence against somebody else. But if there's no crime that he's lied about — and he wasn't charged with any crime other than lying — then what's the "flip"? It's a garbage headline. Embarrassing. They're showing that they're slavering over imagined crimes. That's not journalism.

Time to appoint a special prosecutor to investigate the special prosecutor.

Is it a crime to lie to the FBI in the absence of an underlying crime?

The problem with obstruction of justice is that essentially means obstruction of the Deep State. Who gets to define “justice” here? It should be the President, but here, it seems to be a hybrid group of Dem operatives and government bureaucrats. They have been nailing people involved somewhat with Trump on process crimes. No underlying crimes, but rather lying to the FBI. Etc. Perjury traps. But the thing to remember is that Comey, Mueller, etc would likely not fare any better if the tables were turned, if the obstruction trap were set for them. Probably much worse. We know that Comey illegally leaked information to the MSM, and someone on Mueller’s team is doing the same. Those two, plus Rosenstein, McCade, etc, were involved in keeping the Russian involvement in the Uranium One deal away from Congress, and then the same cabal seems to have had some involvement in using the Trump Dossier to get a FISA warrant, which helped snare Manafort, and start the Russian Collaboration scandal meme, and maybe even helped pay for it. The FBI under Comey appears to have helped concoct the fake Dossier, known that it was false, that it was partly, at least coming from the Russians, and that it was the Dems and Crooked Hillary who were funding it, and then had the audacity to go to the FISA Court for a warrant to tap the Trump campaign for Russian involvement based on the Dossier they knew to be false, and helped, maybe, to create. These are the people who appointed the special prosecutor and are, essentially, deciding who to go after with these process crimes and “obstruction of justice”. It stinks to high heaven. None of them were even elected dog catcher, but are seemingly trying to take down a sitting President from within his own administration.

The corruption here is the quasi bureaucracy, the Deep State, using process crimes to try to take down a duly elected President. And misusing their prosecutorial and investigatorial powers to this end. Using knowingly false information to get FISA warrants to essentially investigate the incoming President for falsely manufacturered crimes that they knew his losing opponent had actually committed.

Seem to be generalizing a bit here. Not all of NRO has gone off the deep end with their TDS. McCarthy is one of their people whom I still tend to read, because he is, above all, an excellent attorney with a lot of relevant experience in this area. I still have NRO up as one of my “permanent” tabs - I just don’t link to nearly as many of their articles as I used to, before the election.
