With the agency already proving that it tried to hide documents directly related to a FOIA request, how much nonsense will Walton put up with? So far the patience of the "right wing" free speech advocates has been remarkable. The plaintiff makes a good argument in the defamation claims of falseness, based on a Christian group that preaches love being considered a hate group. Weakness, I think, is showing that it was a statement of fact, and not opinion. The SPLC is dead meat here if this ever gets to the Alabama jury - so it very likely won't.
The trademark claim is maybe stronger. The SPLC uses the trademarked name to accuse a religious group that preaches love to be a hate group. Surely disparagement. Problem though is maybe fair use.
Civil Rights Act religious discrimination claim against Amazon is interesting. The SPLC/Google argument seems to be that they are a hate group because the oppose same sex marriage. Scripture is cited to show the religious basis for that opposition. As a result of the SPLC determination, Amazon has denied the plaintiff participation in a program that allows charities to benefit when people designate them when shopping Amazon. The interesting twist is the argument that Amazon is a public accommodation based on its selling and streaming of movies. Obviously, the law envisioned movie houses, which this sort of providing movies essentially made obsolete.
And, with this case pointing out that Amazon uses the SPLC bogus "hate group" list to actively discriminate against Christian ministries on the basis of their religious beliefs, I am not going to utilize Ann's Amazon portal, a program somewhat similar to the one denied to the Christian group on religious grounds. making this probably worse, it is very likely that anti-gay Muslim groups are not similarly discriminated against.
