"Bret Weinstein, the Evergreen State College professor who was driven from campus by a mob of students earlier this year, is preparing to file a $3.8 million claim against the public institution."

Its like suing the people who drop dollars in hobos mugs, should said hobos menace a social worker.

Why it's like the administration at Evergreen State has created--or at least allowed the existence of--a "hostile environment".

Allowing the existence of a "hostile environment" for women, gays, racial or ethnic minorities of one flavor or another has caused many a private employer to be found liable for discrimination and hit with a hefty jury verdict.

Now if this was Evergreen Widget Manufacturing Company, no one would blink an eye when the old Widgeteers got hit with a $3.8 million jury award.

The guilty parties, that is the administrators and the board supposedly in charge of that asylum, will not suffer from this. They have impunity, its not their money.

Washington state, especially western Washington, is the culprit. The eastern 2/3 of the state wanted to secede 50 years ago.

I don't blame him. He will probably be unemployable as a professor, given the enormous biases he will face from hiring committees.
He will be ostracized if he remains at Evergreen.

The state doesn't have to fund this. The smart reaction would be both a funding and tuition freeze so the school administration has to decide how to make up the difference.

No one, no one in the MSM anyway, ever says of big judgments agains police or schools: "wait, let's don't do that, it's other people's money." Nor does anyone, well, hardly anyone, ever say, wait, let's not expand Medicaid to people making $80K, it's other people's money. At least in Weinstein's case we might get a message and some entertainment out of it.

Yes. He was saying, in essence, "Never sue the government. Let gov't employees get away with anything." The responsible people won't suffer as much as they should, but they'll suffer a bit, and there should be some deterrent effect to the institutions.

The university system is just a slush fund paying for grievance majors to run around and deprive people of freedom and civil rights.

It's always disappointing to see a case that really ought to be about free speech end in a lawsuit. Instead of everybody joining together and learning a valuable lesson, everybody's going to troop down to the courthouse and somebody's going to get ordered to comply.

Not taking sides on the lawsuit, by the way. It's quite plausible to me that the level of vilification and intimidation the guy was subjected to rises to the level of a tort. I'm just disappointed that the better angels of our nature didn't win out.

The difference is Mizzou is a blue dot in a red state. Oregon is liberal.

It's going to get paid by the E & O policy of the university. If the plaintiff lawyer is smart he will pile on civil RICO counts. The plaintiff is going to need to net at least $2.mm after legal and taxes. I figure that is what he is going to need since after being a " trouble maker" in prog world he is now permanently unemployable in his profession. Between a job at wherever non university placement he can get and the income the $2.mm would net invested he will sort of be revenue wise where he was at with the university. Of course insurance companies will watch with great interest and make the appropriate language changes in their policies. For the next time.

Cubanbob. WRT E&O. These policies have a deductible. And the renewal premium will go up, particularly if the guys who did this stuff--which is to say the admin and their immediate stooges, I mean subordinates, remain in their current jobs. That would mean they're ready to do it again. It would be like a commercial insurer, after having paid for a fire at a factory, inspects the place for the renewal and discovers open containers of flammable liquid around.
At best, the same company will renew at much higher rates and those are likely to be the rule for years.

So,could not the settlement include finding individuals also responsible?

Can't a settlement include individuals being removed from their positions, even if rules require giving them a position of equal pay but no authority in areas like that of their screw ups?

A million or four here or there gets a bit of press and may sting a bit. But a few of the loonies losing positions of authority sends a MUCH bigger message.
