I believe under Sharia a woman needs 4 male witnesses to corroborate rape (not that this is Sharia we're talking about, but that's the mindset here)

Actually, partition was a scam. There Hindus in Pakistan and Moslems in India.
If a Moslem presence means endless turmoil, maybe we ought to let the Indians off the reservations and put the Moslems there.

Not a good idea, given the high percentage of false accusations of rape.

The whole thing just seems like cultural differences to me. They have a different morality than us. Excuse me while I go do a wikipedia search and India's constitution, and bill of rights.

That wasn't meant sarcastically, btw. With false claims distrubingly high and the consequences to the victim high, the penalies should be harsh and swift.
Kill the rapist murderer, but I think that rapists should be castrated rather than killed.

The problem, really with a death penalty for rape is that it turns into blaming the victim... making it not be rape, somehow. Not rape-rape.
Note how this is exactly the suggestions... make sex illegal, stop co-education... kill rapists. So if the victim was 'having sex' she's at fault and if she's where she wasn't supposed to be, she's at fault.
And yes, there really should be proof and not just an accusation. Which is why three witnesses are required in the middle east, because it means the death penalty.
But making sex itself illegal means that someone caught having sex is highly motivated to say (to avoid being stoned for adultery, for example) that it was rape.
Is this before or after they stone the victim?
