Someone shouldn't be killed without absolute proof. So they aren't going to kill a man with less than three witnesses. So instead, seeing how she just confessed to being a slut, the woman is punished.
My uncle, who was a county deputy sheriff said the same was true of any law that seemed too harsh. If nothing else the cops would ignore it if they could.
And so we've got this lady who *probably* had no other real options. And if she is convicted of murder at least her children won't carry the stigmatism of having a mother who was a whore.
The dead guy who made the mistake of forcing her to continue an affair by blackmail (however "voluntary" the first encounter) learned an important lesson.
If he's shaming her into continuing because she's trying to protect her public honor and her children's reputation from what he's threatening to reveal to the world... getting her pregnant is a terminally bad idea.
This reminds me of an old law review article I read in Con Law. The author was making a comparison between torture and plea bargaining.
Because medieval law required two witnesses to convict a criminal OR a confession, and because there were never two witnesses, torture became a common way to extract a confession and resolve the case.
Our criminal justice system has so many safeguards that it's unworkable so plea bargaining has become the real system, not the jury trial.
Make a system unworkable and people work around it.

For rape to be restored to its historical status as a capital crime, we're going to need more justices like Alito, Roberts, Scalia, and Thomas. And Obama isn't going to appoint them.
Firearms even up the physical balance of power between men and women. NOW should be a big ally of the NRA. Given the decades that NOW has has to figure this out I am mystified that it is not.
