The NYT calls the "birther" issue "a baseless attack with heavy racial undertones."

The editors want to make sure you see the issue as racial:
[T]he birther question was never really about citizenship; it was simply a proxy for those who never accepted the president’s legitimacy, for a toxic mix of reasons involving ideology, deep political anger and, most insidious of all, race....

It is inconceivable that this campaign to portray Mr. Obama as the insidious “other” would have been conducted against a white president.
Inconceivable? Really?
There was a price to the party for keeping the issue alive; inevitably, it was picked up by a cartoon candidate, Donald Trump, who rode birtherism directly to the prime-time promontories of cable TV. The Republican establishment began to wince as it became increasingly tied to Mr. Trump’s flirtations with racial provocation, and Karl Rove told him to knock it off.
Oh! The evil Karl Rove is back... seemingly as a measure of how much more evil the birthers are.

So the Democrats "could" raise the issue against a white candidate for president (Goldwater 64, born in a US Territory (Arizona), and McCain 2008, born in a US Territory (Panama)), but to do the same to a Black Presidental candidate (cuz it has been festering since 2007) is racist.

Is anyone else still amazed that the first black (sort of) president would wind up being so open to questions about his Americanism (if not by birth, and I've never questioned that, but in his upbringing). I mean, of all of the thousands of black men who are smart, capable acheivers and who unquestionably have generations of American ties, why did this one wind up being the president?

I don't know what that means. Probably nothing at all. It's just extremely weird to me. I wish it hadn't happened like this.

Nowhere in the opinion does the Times mention the polls.
The polls showed Obama had to release his birth certificate.

For this president, the NYT has chosen to stand for obfuscation and something less than transparency.

They don't want to look and they don't want anybody else to look.

The fact checkers at the paper of record must have a different version that has papa's signature on it, unless they are asserting that the Doc who delivered is also the parent. what a way to start a new theory :)

The "birther" issue has always been the right-wing equivalent of the controversy over George Bush's National Guard experience. In both cases there was never any "there" there, but because the events happened in the distant past and not all the facts could be immediately reconstructed in a crystal clear fashion, the political opponents of Obama and Bush respectively tried to concoct a silver bullet-type of issue that would destroy a despised politician without having to deal with the substance of his policies. In both cases, too, the facts eventually did come out, and bite the conspiracy theorists in the ass (much more embarrassingly in the Guard case). The only difference is that the National Guard fiasco was embraced by the upper echelons of America's media establishment; birther-ism was the lonely cause of a few political drifters on the fringes of American politics (and yes, this describes Trump).

Larry, while I agree with most of your post, I think you need to distinguish that there were ultimately two issues:

1. the basic birther question, e.g. was he a citizen...., and

2. the secondary infection that started growing, even among democrats, e.g. what is he trying to hide? If he won't release it, is there something else on the certificate?

It was ultimately the second item that forced them to call off the trap.

Trying to paint this episode as racism is a pathetic attempt to shift the focus from Obama's blatant lack of promised transparency and tin ear to the real questions of his legitimacy to be POTUS. His legitimacy is indeed questionable given his lack of leadership on the economy, jobs, oil drilling, ballooning deficit, rule by czars, defunding the military in the face of an incomprehensible foreign policy, and vacuum of leadership that empowers our enemies at the expense of our National Security.

This is not a problem of racism which, by the way, only exists in the eyes of the clueless water carriers for Obama and the DNC, it is a cynical and corrupt obfuscation of the failure of the ideology of the progressives.

Fortunately for this nation, the Republican party was formed to fight this insidious notion. It was formed with belief, and with the willingness to fight for it, that each person should be given their own voice, their own rights, never using a category to diminish their dignity as a person.

Unfortunately, the Democrats fought this, arguing that a person was simply a category to be used. These categories were something to be established and fought for, and that to violate such categorization, to think that people were more than a color or a class, was a sign of stupidity, naivety, or deceptive attempts to gain power.

The Republicans argued that all were Americans, no matter their race. Race shouldn't be a factor in someone's ability to participate in this great country of ours.

But for some all they see is race, all they know is race, and all they can do is limit someone to race -- not accepting they have human strengths and human weaknesses, worthy of acclaim or critique on their own merits. They de-humanize people in some quest for rhetorical victory, their own power, their own gain.

It gives off the veneer of concern, but it's still really about putting people in a place where they serve rather than where they can be free.

Fortunately, for this nation, the Republicans won that fight in the 1860s. Unfortunately, the bitterness of this win lingered for a very long while, and once again real people were used as pawns in the service of this bitterness.

Bitterness remains, and while the weapon isn't the obvious racism of the past, it is the use of racism as a tool, a malicious charge. It speaks of the intent to keep people down, to diminish them so they are only the color of their skin, all for the service of some political advantage. It gives off the aroma of real concern, but it's still that same pernicious smell of decay that treats people like objects rather than like people.

Let's take this piece by piece

1) Where does it say that birth to 1 US Citizen makes one a natural born Citizen, eligible to be POTUS, especially when Congress agreed that McCain was a natural born Citizen because he was born of 2 US Citizens.

2) Granted. But there is no "right" to be POTUS. One must be eligible by A2S1C5. Do you think it also discriminates against 34 year olds? And I won't even go into Obama's character.

3)This is totally false. If the BC he just released is a fake he could be impeached. If the real issue of Obama's British Citizenship at birth is discussed, he can be undone by Quo Warranto in the DC District, as stipulated in the 25th Amendment.

4)True, he is a Marxist, but that doesn't mean we should let him Usurp the Presidency. The precedent of one born w/ foreign allegiance allowed to be POTUS is a huge victory for the NWO against the security and sovreignty of We the People. Everything he signed and all appointments (including the Communist SCOTUS appointments) would be null and VOID if he is ousted, So what are you talking about?

If the well known REASON for the natural born Citizen requirement was to prevent foreign influence, how is it possible that one born a British Subject (due to birth to a British Subject father) be eligible?

I think there's actually a kernel of truth to what the Fishwrap says: I agree that the birth issue "was simply a proxy for those who never accepted the president’s legitimacy…." It didn't, for the vast majority of people, have anything to do with race (one can't say that none of Obama's critics are racists, even though no one wants to concede this for fear that it will be blown out of proportion by Obama supporters). Rather, the eligibility question was a proxy for deep-seated but amorphous concerns about the President's seeming other-ness, his apparent disconnection from America, amplified by passionate political disagreement with his program. There is something alien about Obama's deportment, and there's definitely something alien about Obama's politics, and so it's readily understandable that these would subconsciously spark into a fear taht Obama is himself an alien. It might have remained a small fire, but Obama's own actions—I think deliberately—fanned the flames while it seemed politically useful. Now the fire is out of control, and nothing Obama can do will put it out; if yesterday revealed anything, it is that the birther mentality is hermetically sealed. Nothing will ever satisfy them, and all new evidence will be taken as proving just how far the conspiracy goes. All we can do is throw the bum out of office and hope the issue goes away.

Many birthers simply assume that if Obama was ineligible, all those appointments and laws are void as fruit of the poisoned tree, but that's not so. I know of know case that holds any such thing, and as I've pointed out before, analagous situations suggest that the answer must be "no." Take an analogy to corporate law: suppose a board votes on a merger, and the margin of victory is supplied by board members whose appointments are later found invalid under section 101 of SarbOx. Does the court find the merger invalid and order a breakup? Nope. Or, come to think of it, What happens if the person who signed your birth certificate wasn't eligible to do so? Do you have no birth certificate? Are you void? Or suppose your attorney turns out to be unlicensed; is the judgment in your favor that he won thus invalidated? (Not only is the answer no, but in one case, the attorney even collected fees!)

Nor is it hard to see why, if we examine the text carefully. Now as in 1788, "the prevailing definition of 'eligible' is 'qualified to be chosen.'" Utah Public Employees Ass'n v. Utah, 131 P.3d 208 ¶74 (Ut. 2006) (Parrish, J., concurring). Founding-era dictionaries like Johnson’s Dictionary of the English Language (1768), Ash’s New and Complete Dictionary of the English Language (1775), Sheridan’s Complete Dictionary of the English Language (2d ed. 1789) and the Improved Dictionary of the English Language (3d ed. 1798), and Johnson’s Dictionary of the English Language (9th ed. 1805) uniformly define eligible as “fit to be chosen” and eligibility “worthiness to be chosen.” The focus is on a threshold condition: certain kinds of person may not be chosen. It is to call out and bracket speech by that character as too absurd, hyperbolic, egregious, repugnant, and in any case *fraudulent* (because it doesn't actually represent someone's opinion but a false flag operation) to waste time seriously critiquing or refuting it.
