My point, which flew right over your head, is that if you have probable cause to believe somebody is a rapist, you ought to be calling for his arrest and indictment. But if you think he's probably innocent, or you have no idea, then it's ridiculous to call on him to resign. (And it's just as bad for Republicans to do this as Democrats).
Here are the original allegations.
What jumps out at me is how much of this is just mud-slinging. Sex with the boss. Not a crime. (At least, I don't think it's a crime, maybe Congress has a rule on that). Sex with an older man. Not a crime. Drunk sex. Also not a crime. She uses the word "relationship" to describe what happened in 2019.
The serious allegation is in 2024. It's a really skimpy allegation.

The woman texted a friend three days later that she was “sexually assaulted” by Swalwell. She wrote in a series of messages reviewed by the Chronicle that she had “blacked out” but “woke up once during it and even told him to stop at one point.”
She texted a friend that he assaulted her. She told her boyfriend, who told her to go to the police. She refused to do that.
I mean, maybe he raped her. But that's a really skimpy accusation. With no witness testimony, no police report, no cross examination. The timing is very suspicious. And reporters are already suggesting that Katie Porter is behind this.
Gee, it would be too bad if he didn't do it, but takes the fall anyway.

St Croix, if you tell the false allegation to any official person or body (eg the police, or Congress), that's "somewhere near the court" by my non-term-of-art definition. That gets you into the false statement statutes.
Telling the false allegation completely outside officialdom, like say to the Daily Mail, is a stickier wicket. Could be criminal libel in those jurisdictions that have such statutes. Could also be defrauding the journalists, if they actually believe you. But they're paying these gals to talk, not to say something true. Only Trump gets prosecuted for fraud when the 'victims' say "no, he didn't defraud us! We knew exactly what was happening!"
