The serious allegation is in 2024. It's a really skimpy allegation.

She texted a friend that he assaulted her. She told her boyfriend, who told her to go to the police. She refused to do that.
I mean, maybe he raped her. But that's a really skimpy accusation. With no witness testimony, no police report, no cross examination. The timing is very suspicious. And reporters are already suggesting that Katie Porter is behind this.
Gee, it would be too bad if he didn't do it, but takes the fall anyway.

Convenient? Yes, Uncorroborated? No. One victim contemporaneously told two friends. But she then accused of him raping her while completely inebriated, in his room, twice, several years apart.
As we pretty much all know, getting women drunk is quite popular with men in order to have sex with them. Smart, somewhat chaste, women know this, and don’t let themselves get drunk around men they can’t fully trust. And it isn’t all bad - happened to us 26 years ago. Add to that that sex is pleasurable, for many women (and most men). So, no surprise, when women take one or two more drinks, and end up compromised.
Which is maybe a long way of saying that maybe she didn’t mind the second encounter that much. Yes, she was too drunk to consent or even probably indicate non consent. But that condition was self induced.
But then, my partner knew Bill Cosby decently well, at one point, and drank champagne with him up in his room a number of times. She never did this, esp with stars. But did it with Cosby, because she trusted him, and there was never any indication that that trust was misplaced. But she was always being pestered by female friends to tag along, and their intentions were not so chaste and pure. She resisted their efforts, except in one case, where she later apologized to Cosby for this friend’s increasingly blatant come ons. Which Cosby, a perfect gentleman, completely ignored. Yet, he now stands convicted essentially of rape.

What DC jury is ever going to convict a rape claimant? And their Soros-funded defense would demand extensive discovery, plus putting Kavanaugh on the stand, further extending his process-punishment. CC, JSM

Nobody is near a court. It's not testimony. The whole point of this rape charade is not to send an innocent man to prison. They don't even want him to quit Congress! They're just trying to get him out of the governor's race.
This is oppo research that has gotten way out of hand. As Clarence Thomas called it, "it's a high-tech lynching." Slander is one thing. But calling somebody a rapist in the media, in order to profit from that charge? That ought to be a felony.
The crime I'm proposing is
False rape claim for profit.
You've got two elements of the crime.
1. False rape claim
2. To profit financially
You still have the same problem with the jury pool, the judge ans probably the prosecutor

St Croix, if you tell the false allegation to any official person or body (eg the police, or Congress), that's "somewhere near the court" by my non-term-of-art definition. That gets you into the false statement statutes.
Telling the false allegation completely outside officialdom, like say to the Daily Mail, is a stickier wicket. Could be criminal libel in those jurisdictions that have such statutes. Could also be defrauding the journalists, if they actually believe you. But they're paying these gals to talk, not to say something true. Only Trump gets prosecuted for fraud when the 'victims' say "no, he didn't defraud us! We knew exactly what was happening!"
I dislike a specialized rape-fraud law for the same reason I dislike other hate-ish crimes: the conduct is already covered by other statutes, and it continues to build a world where some victims are more important than others. CC, JSM

All the false accusers or the accusers with very little proof to back their claims for the past 30 years (with the exception of Jussie Smollett) have been women. Isn’t that correct?
Having said that, Monica Lewinsky would have been labeled a false accuser (of infidelity) if she hadn’t saved the blue dress.
Could sue the accusers civilly. Does create the whole discovery problem, which even straight shooters like Kavanaugh, let alone slutty Swalwell, want to avoid. But get a judgment against the accusers, and if they do ride the accusations to fame and fortune, at least you get part of the fortune. CC, JSM

Rape is a serious crime, on par with murder. Journalists accusing a Congressman of rape in a headline ought to treat it like a murder accusation. Treat it with the utmost seriousness. CNN is being sensitive to the girl making the allegation. But these allegations are not serious. I think CNN has opened up themselves to a massive lawsuit.
St Croix: except they've devalued the term 'rape,' and really devalued the term 'sexual assault,' to the point they include all sorts of trivial offenses. At least with 'murder,' which also gets misused in ordinary speech, you need a death; no one would accuse me of murdering you if I ran over your foot on an e-bike, say. But some idiot would probably accuse me of sexually assaulting you. Hey, lots of people are into feet.
