If Comey is indicted on something, you can be Goddamn sure he committed a crime. Whether it will be possible to get a conviction with Leftwing juries and Leftwing judges, remains to be seen. Even if this is true. We'll need more reliable sources than the NYTs.

Something that neither side is explaining fully: There is a DOJ policy that US Attorneys will not seek an indictment unless they believe they can prove the case beyond a reasonable doubt at trial.

But that's all it is: a policy. Not a statute or case law. Even the Model Rules for Professional Conduct just require a prosecutor to have a prima-facie case.

And many states, especially in the South, actually obligate a prosecutor to seek an indictment if she has probable cause. Period. Part of the removal of discretion from every link in the criminal-justice chain, which was supposed to help achieve equality, but has turned out to subject even more minorities to the criminal-justice system than back in the Jim Crow days.

But anyway, as part of Trump's treat-everything-like-a-contract approach, he doesn't care about a DOJ policy. He cares about what happens to him and his if he gets a flimsy indictment of Comey. And the answer was "well, not really much after the acquittal, sir." And he knows from personal experience that the process is the punishment.

Also, lefties will weep about the loss of DOJ independence. To that, I say, show me where in the Constitution it even mentions an Attorney General. It doesn't. The President is the Executive. Not only can the AG be the President's wingman - the President can fly without wings if he wants. CC, JSM

They have now unsealed the indictment. The grand jury rejected a third count. The indictment is so short and opaque it is impossible to figure out what is actually alleged. Be interesting to see if the US Attorney, who signed it, holds a press conference and can explain stuff.

But convicting Comey, a guy with a clean 70-year record, for a nonviolent crime, is not that massive tit. He's not going to be languishing in Marion with a floor-length beard as a constant reminder to would-be malefactors. He's probably not going to do any time at all. And the twists and turns of the trial process will just be a distraction. Better to state the facts in one speech and tell him to FOAD.

Nevertheless, it must be done.

1) Game-theory tit for tat. The Democrats have gotten mighty comfortable with treating the civil service as their brownshirt bully boys. It's time they knew the days of supine RINOs more concerned about collegiality and the Georgetown cocktail parties are gone forever, and they can expect vigorous payback for partisan misuse of the powers of government.

2) Pour encourager les autres. The process is the punishment, and no one on a civil servant's salary is going to want to put his family and life's savings through this wringer ever again.

3) Discovery and testimony that cannot be ignored by the press and may lead to the incrimination of many other Democrat bigfoots, perhaps even some ongoing scams and plots that need to be taken down.

4) The pressure to turn state's evidence. Comey can be reasonably sure that his punishment will be light if he sings like a canary about Hillary Clinton and the Russia dossier, or conspiracy by the likes of James Brennan and Merrick Garland, or the misdeeds of shadowy power mongers and puppeteers like George Soros, Marc Elias or Norm Eisen.

I’ve read the indictment. Donald Trump needs Andrew McCabe to testify against James Comey to prove the false testimony allegation. I can’t imagine McCabe will be a friendly witness for the prosecution.

There is this oddity. The indictment refers to Person 1 (presumably Donald Trump) and Person 3 (presumably Andrew McCabe) but does not make any mention of a Person 2. Why skip from Person 1 to Person 3? If there is a Person 2, who is it?

Maybe Person 2 is Hillary Clinton and she is going to be the surprise witness against James Comey. Or Person 1 is Hillary Clinton and Trump wrote himself (Person 2) out of the case.

Is DOJ‘s theory in the two counts of the indictment is that Comey lied to Congress when he said he had not “authorized someone else in the FBI to be an anonymous source in news reports” about the Russia investigation of Trump, when in fact he authorized McCabe to do it?

That’s a very hard case.

First, it’s a swearing contest between Comey and McCabe about whether Comey authorized it. Hard to get beyond a reasonable doubt with that.

Harder because DOJ concluded McCabe 'lied about leaks' during the investigation in which McCabe claimed Comey authorized him.

Harder still: ”anonymous source“ is subject to interpretation. Yes, the media generally uses it to mean “source whose identity we are not disclosing.” But another way to take it literally is to say Comey did not tell McCabe he could anonymously leak information, which would be true.

That sounds a bit contrived but caselaw establishes that you’ve got to show that the statement is literally false. Which is a problem.

But the problem of McCabe being seen by DOJ as a liar, only to become the star witness, is a bigger one.

Of course, the case isn’t being brought with an expectation of winning. It’s illegitimately brought to punish an enemy by a dishonest totalitarian regime. The process is the punishment.

McCabe has two options- either testify that he lied in the OIG investigation, which is a crime, or repeat his sworn statement that Comey authorized the leak. If called, McCabe will most likely affirm his previous statement and it doesn't matter whether he is happy about it or not.

Yes, with a Dem judge. But surviving an appeal is a different thing. If the judge dismisses based on Trump’s statements, they are going into the problems caused that he has plenary Article II Executive power, that includes the decision whether or not to prosecute.

Finally, this discussion of DOJ Policy reminds me of Sessions. We all know Barr was back-stabbing Bushie, probably planted in the DOJ by the Republican Establishment.

But Sessions was supposed to be some sort of Rebel who broke ranks and endorsed Trump when no one was supposed to. As a result, Trump gave him the DOJ. But he was really a Trump supporter? Or was a double agent? Because he not only recused himself and handed over the Russiagate to Rosenstein, he constantly refused to do what Trump wanted by quoting "DOJ Policy". I've come to the conclusion, his real goal was to sabotage Trump and then return to the Senate.

Wait, why isn't COMEY being gagged by the federal judge in his case like I was? In fact, why is he being allowed to turn himself in? Why isn't he subjected to a 6 AM raid on his home by 29 heavily armed FBI agents ?

Comey was indicated in Alexandria, VA. Per a search, they filed in the eastern district of VA because Comey testified from his home in deep blue McLean VA (where 66% voted for Kamala). Alexandria is a DC suburb and also extremely blue (78% voted for Kamala).

I expect a hung jury or acquittal if this goes to trial. The Republicans wouldn't have a better chance downstate in Richmond, as that urban area is also blue (82% Kamala).

Team Blue owns the DC metro area, and that crowd loves the Deep State.

I’m not sure if McCabe isn’t the prime target. Latest news is actually the FBI did have plain clothes agents embedded in the Jan. 6th crowd. Sunshine coming to the biggest scandals of Trump’s first term, and it is going to show a conspiracy against the will of the people.
