Said Alan Dershowitz, on his podcast last night.
"[Combs] was acquitted of anything involving violence, anything involving racketeering, anything involving, you know, sexual trafficking, all of that. He was acquitted!... People don't go to jail for transactional sex for voluntary consensual sex based on the hope of getting an advantage. There is no such law.... Adult women should not be treated like children. If they consented, that's the end of the matter. They consented! I don't care if they consented to help themselves.... They can refuse it.... The law should have nothing to do with consensual transactional sex of the kind that he was convicted of.... Remember what he was convicted of was transporting. I don't know what that means. Transporting. I took my wife to New Jersey several times from New York. Actually, she drove. So maybe she transported me for improper purposes. But who thinks that taking somebody from New Jersey to New York, New York to New Jersey for purposes of having consensual, voluntary sex should be a federal crime? I don't care if you're a liberal or conservative, if you're a man or a woman, if you're a feminist or a sexist. That's just not an appropriate subject for the courts. It's just not an appropriate subject for the courts. The judge disagrees with that. And so the judge denies bail. Now, the statute says that you're entitled to bail if you have reasonable arguments on appeal. And there are some very strong arguments on appeal. I think I could win this appeal...."

I haven’t been following this case, even here, but I was surprised that the Judge would do that.
Dershowitz : Y'all think no bail is fine?. No. No, this verdict is not for me. It's for the judge! See, see, Diddy’s gonna be all right. He’s straight. He’s got villas in Brazil, Tahiti, East Hampton, Westhampton. The one on Star Island is right by my house. Diddy gonna be fine! Fuck the verdict. Diddy owns 20 Koo Koo Roos!
Kali: Twenty-one, sir.
Dershowitz: Diddy owns 21 Koo Koo Roos. He isn’t going anywhere. The judge doesn’t own one Koo Koo Roo. Not one. Not one.
why - rich celebs above the law?
Dershowitz: "[The judge is] going to come up with some pretense (to put Combs in jail)...."
That pretense, of course, being that Combs was found guilty. Interstate transportation to engage in prostitution. It's a violation of 18 USC 2421 (known as the Mann Act) and it's a felony, punishable by up to 10 years in prison. This anti-slavery law was passed in 1910 specifically to outlaw the behavior that Combs is guilty of. It bans human trafficking.
So, the judge can sentence Combs to 10 years, consecutively served on each count. So 20 years.
And that's exactly what he should do. Fuck Alan Dershowitz. He should be next in the dock.
Combs is a pimp. Sexually abusing these women. Put him in prison.
Yet another bizzare bad take from him.
No Puffy fan, but hasn't he already served 7 months in jail? Do common folk get 7 months jail time for prostitution related convictions?
Frankly I haven't followed this and I don't give a crap about some guy named 'Diddy' any more today than I have at any time in my life. I could not tell you a thing about him. But...I have seen a video of him beating up one of his girlfriends (or his wife?). Pretty brutal. Extremely violent. Dershowitz points out that he was acquitted of anything involving violence. So my question would be...just what was the jury doing during the trial?
No bail = the only hint of punishment possible for wealthy people. See Jeffrey Epstein's first conviction. See Michael Vick's dogfighting conviction.
The image of him chasing his gf down the hall while she was attempting to escape ...then dragging her away.. That was only a tiny captured moment.
puffy was king of his freak-off kingdom and he used his money/power to abuse and control people.
He needs some time to cool off, imo.
Have people forgotten what an Israeli-first dirtbag "Dersh" is? He was up to his neck in Epstein Island. In fact, he pressured the Palm Beach DA and Federal Attorney into that ridiculous plea bargin for Epstein when this scandal first came to light.
Talking about "Hey it was just from NJ to NY, whats the big whoop" is absurd. Interstate is Interstate whether you go from NH to Vermont or from NH to Oregon.
The purpose is to put sex trafficers in Jail. But Libtards love sex trafficing, at least when its bringing sex slaves over the border from Mexico.
Dersh of course was also a supporter of Harvey Weinstein. Basically, he wants powerful rich men to be able to prey on young women without any contraints. "After all, what's the big whoop? No one had a gun to their head, did they?"
"Yet another bizarre bad take from him."
Understandable, though. Dershowitz is grooming his jury pool for his upcoming Epstein pedophilia case. He wants people to believe that "transactional" sex doesn't hurt anybody and as long as you have consent, that should be legal.
But it isn't legal. If you engage in consensual sex with an underage child, you're guilty and we are going to get you.
Alan knows this.
News flash. Judges do what they want to do, more or less, within the strictures of the law.
I lost an appeal on proximate cause and I’m still unhappy about that. I had a case on all fours and the Court of Appeals cited it, but I still lost.
My lawyer friend “lost” a real estate partition case when the judge didn’t order an immediate sale and give her statutory attorney fees.
Dershowitz should know that the law can be somewhat arbitrary. Different judge can mean a different result,
" But...I have seen a video of him beating up one of his girlfriends (or his wife?). Pretty brutal. Extremely violent. Dershowitz points out that he was acquitted of anything involving violence. So my question would be...just what was the jury doing during the trial?"
He was not charged for that behavior. This was a federal prosecution and that was not a federal crime. His lawyer repeatedly stated that Combs would plead guilty to that crime if it were charged. What the jury was doing, apparently, was following the instructions to look at the specific crimes charged and to determine if the prosecution proved each element of those crimes beyond a reasonable doubt.
The prosecutor, by the way, is James Comey's daughter.
If Combs is given a sentence beyond the time he's already served because he's been denied bail during the trial and before the sentencing, I would not be surprised to see Trump commute the sentence.
https://www.wsj.com/us-news/law/who-is-diddy-lawyer-marc-agnifilo-66d845a2?st=x6GAMf&reflink=desktopwebshare_permalink. WSJ article about Diddy's lawyer who also happens to represent Brian Thompson's killer. The judge based his bail decision on the defense's "ownership"of domestic violence.
And any faith in the impartiality of judges sinks lower into the toilet. Trump should do it, the brothas would like it and you would have democrats screaming lock up the black man. Heh
Personally, I'd have been more impressed with Dersh's comments if he'd rapped them while throwing gang signs.
should the system be more harsh because someone is weird or fucked up or unpopular or committed other crimes we’re not asked to judge…a Monster?
"Mann, oh Mann" - Chuck Berry's ghost.
"The Mann Act, also known as the White-Slave Traffic Act, is a United States federal law enacted in 1910. It prohibits the transportation of women and girls across state lines for the purpose of prostitution or other immoral activities. While initially aimed at combating human trafficking and prostitution, its broad language about "immoral purposes" has been used in various contexts, including cases involving consensual sexual behavior." - some AI or another
Maybe the judge knows (already decided) that he is going to give Diddy some jail time, and thinks that he might as well stay in jail for now and serve some of it.
Seems odd. Not even R Kelly got the same treatment, and he was peeing on people.
"He was not charged for that behavior. This was a federal prosecution and that was not a federal crime. "
But Ann, it showed his character... he is a violent man and thus he could not be trusted to stay put... keep him locked up for as long as possible.. maybe as he grows old the fire will leave him (but I doubt it.)
After Diddy does his two or three year prison sentence, maybe he can be kept in prison some more? Civil commitment will involve a detailed evaluation of Diddy to determine whether he meets the sexual violent predator criteria, including a history of offenses (check), a diagnosed mental disorder (probably) and a likelihood of reoffending (definitely check).
..."If Combs is given a sentence beyond the time he's already served because he's been denied bail during the trial and before the sentencing, I would not be surprised to see Trump commute the sentence. ..."
It's a trap. I'd be surprised and also disappointed if he did.
Unfortunately I have been listening to Megyn Kelly's podcast, and she has spent way too much time on the baby-oiled lifestyle of this thug and his consequent legal troubles. Combs was overcharged to make a federal case, and the jury paid attention to the instructions. The man is a disgusting degenerate, but that isn't necessarily illegal.
On the other hand, the judge gets to weigh in, too, and Dersh is right: the judge didn't like the verdict.

This is true, and I found it sometimes disturbing in my career as a criminal prosecutor. I distinctly remember two felony embezzlement cases where the female stole tens of thousands of dollars from their employer. The one who embezzled money from a very important and politically connected businessman in town, who testified against her at her trial and her sentencing, was sentenced to 10 years in prison. Another woman, who was a "nobody", and whose case was almost identical to the other woman's case, was granted a deferred judgment, where she was put on probation for 2 years and her criminal record was expunged. This is one reason I am glad that I am now retired.
I thought it was long ago established that a person could withdraw consent. The defense lawyer made a big deal over the consenting adults theme. That video looks like no consent to me. This looked like a compromised verdict in order to get home in time for fireworks.
I have more sympathy for him than most. Likely because, at my age, my Rap name is Pee Drizzly.
The great black heavyweight boxer Jack Johnson was convicted of Mann Act violations. A useful tool?
Althouse: "The prosecutor, by the way, is James Comey's daughter."
You buried the lede quite deeply
So he could have avoided these charges if he hired local instead of out of state hookers. Valuable lesson there.
And don’t pay for cabs.
Combs is not a good guy.
Immoral=/=Illegal. Uma Thurman was worried that if she didn't put out for Harvey Weinstein, she wouldn't get to star in Kill Bill, but that doesn't make it rape. Coercion, sure, and that's terrible, but it is not illegal. Likewise with Diddy buggering rappers on his label. It's disgusting that they were put in that position, but they could have walked away at any time and did not.
Maybe the law should change, but then you run into the problem that all sex is transactional to some degree, and where is the line drawn?
" Adult women should not be treated like children."
Nor livestock.
I don't understand him getting away with forcing people into sexual conduct under threat of violence or professional destruction. I seem to remember witnesses testifying to that. Was he not charged with any such crime?
People seem to forget what happened to defendants from Jan 6th. Years of confinement (often solitary) and abuse, without trial, and many for simply being in the area that day. My heart does not bleed for Puffy.
The Judge got a letter from one of the girlfriends lawyer asking Combs not be granted presentence bail. The inference appears to be that they fear retribution. Combs has that kind of reputation.
JAORE at 857 - wins the internet today. Bravo.
Yeah trump will let him out, and this guy too like the other j'6er he just signed up for the DOJ duty. SICK....J6 rioter pardoned by Trump gets life sentence for plotting assassinations
A Jan. 6 rioter pardoned by President Donald Trump has been sentenced to life in prison after he was later convicted of plotting to assassinate FBI agents and other law enforcement officials.
Federal prosecutors sought a life sentence for Edward Kelley, 36, of Tennessee, last month in a sentencing memo. In November, Kelly was convicted of conspiring to murder agents from the FBI and officers with multiple Tennessee law enforcement agencies after they investigated his role in the Capitol attack.
Kelley had argued that Trump’s sweeping pardon — issued immediately after he returned to the Oval Office for rioters like himself — should also cover his other conviction. Prosecutors disagreed. Trump will over ride that nonsense ,this perp is a perfect fit for the Bondi (IM A LOYALIST) DOJ spot. REALITY is now a delusion. Beaucoup Dinky Dau
People do go to jail for different sorts of "consensual transactional sex" all the time (if they're caught). Maybe this trial is the one that influences opinion and narrows the window of permissible "consensual transactional sex."
If Puffy has been convicted, is the government going to confiscate and put up for auction all that baby oil? Asking for a friend.
RCOCEAN: ‘Have people forgotten what an Israeli-first dirtbag "Dersh" is?’ Ocean’s virulent antisemitism is like Trump Derangement Syndrome. It overpowers reason. Dershowitz’s pro-Israel stance doesn’t make him a dirtbag nor does it have anything to do with his opinion on Combs.
if one were to arrest every dirt bag in the film or music business, we would have a small industry,
Yeah—I never understood why the feds charged Diddy for hosting consensual sex parties. Not my cup of tea but not illegal. Same with that cult where the women consented to being branded—Keith Rainiere (?) was convicted and sent to prison. The women consented to being branded! How was that a crime?
and they had the same lawyer, miss agnafilo, smarter jury,
"Not even R Kelly got the same treatment, and he was peeing on people."
R. Kelly was peeing on 14-year-old girls.
Trump should stay out of it.
Ann Said...
"The prosecutor, by the way, is James Comey's daughter. "
oh wow.
Don't care if his abuse was not a federal crime. It he spends a bit of time in jail - boo freaking hoo.
I too care more about the Jan 6th folks - most did nothing wrong.
Not that he's wrong but maybe Alan "Jeffrey Epstein's lawyer and (alleged) friend" Dershowitz should sit this one out.
Enigma's right - the confinement is the only punishment possible for someone this wealthy and influential. Possible witness retaliation is irrelevant: Combs could easily reach out from behind bars. If he's that sort, he probably already has some kind of self-executing agreement with some heavies where in the event of a conviction they go after the witnesses, and then get crypto or heavily-laundered real money. And another agreement with a different set of heavies to go after the first set if they try to get the money without doing the job.
And there's always the possibility that other factions of the Combs empire are pissed enough at the derailing of their gravity train that they go after the witnesses sua sponte.
RR
JSM
arg, that should be gravy train, not gravity train.
JSM
The judge did get to see ALL the evidence against Puffy, including stuff that didn’t, that wasn’t admitted. So the judge was in the best position to make that call. And he did.
Doesn’t matter. Puff Daddy is getting 5 years. Might as well keep serving it.
The prosecution spent $10 million dollars on this case. That it is Comey's daughter who was in charge of the SDNY office prosecuting him is quite satisfying. The acorn doesn't fall far from the tree.
