Lawyers for Bannon dismissed Vaughn’s characterization, saying their client was still negotiating with the House Jan. 6 committee when he was accused of a crime. “No one ignored the subpoena,” said defense lawyer M. Evan Corcoran. “It’s called negotiation, it’s called accommodation.”...
After Tuesday’s trial testimony ended, Bannon erupted outside the courthouse, blasting the head of the Jan. 6 committee, Rep. Bennie G. Thompson (D-Miss.) and repeating false claims that Trump, not Biden, was the true winner of the 2020 election.“They’re charging me with a crime?” Bannon fumed. “Have the guts and the courage to show up here and say exactly why it’s a crime.”
It is highly unusual for a defendant to speak publicly outside court in the middle of his own trial, let alone criticize decisions about which witnesses appear.
Bannon also predicted that Republicans would win back the House in November and create a new Jan. 6 committee that will function far differently than the existing panel, which he derided as a “show trial.” ...
Here's the description of how Bannon looked in court: "Wearing one dark button-down shirt over another, a black suit jacket and a black mask, Bannon, 68, leaned forward at the defense table and listened intently." He's "pugilistic," we're told.
The defense attorney urged jurors to question the motivation behind testimony or evidence presented by prosecutors. “My single request for you is to think about it and ask yourself: Is this piece of evidence affected by politics?” he said....
The two misdemeanor contempt charges Bannon faces are each punishable by at least 30 days and up to one year in jail.
But criminal trials over contempt of Congress are exceedingly rare, and serving time in jail for a conviction is even rarer. It has been about seven decades since someone went to jail for that offense — a seminal case in U.S. political and legal history involving the First Amendment, the Cold War and political efforts to publicly shame suspected communists.
In 1947, 10 movie directors and screenwriters refused to answer questions from the House Un-American Activities Committee about their alleged ties to communists. The Hollywood Ten, as they were known, were convicted, and the Supreme Court ultimately rejected their appeals, sending them to jail in the early 1950s, in what many historians now consider one of the worst instances of red-baiting during the Cold War era.
In 1957, the Supreme Court sought to rein in what it had come to view as the excesses of the red-hunting days, ruling in favor of an Illinois labor official, John Watkins, who agreed to answer some questions about people he knew who were communists, but refused to answer questions about people whose communist associations or activities were in the past.
Through the Watkins case and other decisions, the high court discouraged the Justice Department from pursuing more contempt of Congress cases.....

That's so rich it's wealthy. LMAO.
now do eric holder, who covered up the smuggling of automatic weapons to cartels,
Bannon just followed the precedent of the previous Attorney General under Obama.
In the last 24 hours we have Bannon and AOC each breaking the law for political reasons. I think neither's actions pose a threat to the Republic and neither should be prosecuted. Of course, only one will be prosecuted as he has the "wrong" politics, which results in him being pursued by the politicized Justice Department in support of a show trial. Certainly, this is a case for jury nullification.
The article spells out quite nicely how the trial is inherently political. I bet they didn't mean to do that.
People who call themselves progressives, exactly like HUAC in the 50s, and imitating the worst excesses of HUAC. Who would have thought? Has Trump literally driven them to derangement or madness? Or do they coolly and ruthlessly think now is their chance to establish their ideas with more permanence, more of an "establishment" behind them, regardless of things like free speech, evidence, and rational deliberation?
Thanks, narciso.
Undermine the Idiocracy! Don’t let these pricks even think they fool anyone.

Red-baiting exchanged for MAGA-baiting. Still a stupid waste of time and in derision of Congress’s authority. I hold the J6 committee in contempt.
as I see it bannon was basically a spectator, like john reed reporting on events,
I do every day, it's like holding otter for looting of the food court,
Thumbed his nose at the law? Kinda like the Colbert 9 did?
you may be more right than you know, raskin pere was the head of a soviet front group, thompson supported the new afrika party, the local panther affiliate in mississippi!

That's different!
He was a 'wingman.'
'now do eric holder, who covered up the smuggling of automatic weapons to cartels,'
Now do Hunter Biden who recorded himself perpetrating numerous felonies.
Someone upthread gave the typical republican response. We shouldn't prosecute anyone. Well, that's nice. except the democrats want to prosecute Republicans and don't want to prosecute their side.
So, the whole gosh, we should be even-handed and follow precedent doesn't work. It Does.Not.Work. You want even-handed justice? Retaliate. Once the D's know they'll be harmed when they are NOT in power, they will think twice of doing it in the future.
Will McCarthy and McConnell do that? Of course not. Both of them have already said "off mic" that "The Democrats should take care of Trump (and his supporters)". And they have no guts anyway. As shown by how they acted in 2015 and 2016.
The judge has already ruled that any Bannon defense is inadmissible. Then issue of the validity of the "committee" for example. Was the subpoena legal ? Nope. Can't question that. Plus, of course, a DC jury that acquitted Sussmann a few weeks ago.
Since when do citizens have to obey government orders?
The Congress is NOT a court.
I was a big fan of his Dad, Race Bannon.
I'm sure Steve, like his father, can kick-ass out of this situation.
"Or do they coolly and ruthlessly think now is their chance to establish their ideas with more permanence, more of an "establishment" behind them, regardless of things like free speech, evidence, and rational deliberation?"
Lyoyd--are you just figuring this out now? (Or--more likely--your question was rhetorical). ;^)
"It is highly unusual for a defendant to speak publicly outside court in the middle of his own trial, let alone criticize decisions about which witnesses appear."
Wah, wah, wah!" As Althouse points out, pure political show trials also are "highly unusual" in our once-proud republic. You WaPo folks are going to have to get over your qualms about the traditional niceties.
The defendant decided he was above the law
Ripping a page from the Biden Family playbook. And the Clinton Family playbook. And the Pelosi Family playbook....
Two-tiered justice system- had Bannon been a Democrat and did the exact same thing, no charges at all would have been brought, as the article more or less concedes since the vast majority of referrals for contempt of Congress have been brought by Republicans over the last 40 years, and all of them were ignored by the DoJ. Add to that that all these trials take place in a jurisdiction where the Democrats are 95% of the population, and it is true, authentic due process violation on its face.
But Ray Epps is having a hard time with it. Boo freaking hoo.
I can't wait for the wailing and gnashing of teeth when these same rules and standards are applied to the Democrats. Assuming the GOPe ever manages to borrow back their testicles from wherever they've been kept lo these many years.
The Democrats only do this because they are certain they can get away with it, consequence-free. If they thought the GOPe had any interest in returning the favor, they would refrain.
I don't think too many of us out here in flyover land have much patience for this farce. When the Democrats go bye-bye, the GOPe is going to be thrown out of office in exactly the same way.
Let us not forget that the Committee is illegally constituted, and its existence and all of its activities are contrary to law.
The judge, Carl Nichols, nominated by the previous president and appointed by Congress has basically said "SLOPPY STEVE'S" (previous presidents' term of endearment for the Bannon fellow) the Bannon team has no case. The penalty for conviction of the 2 charges of misdemeanor are up to 1 year on each charge. I am seeing about 2 months on each charge 4 months total and the Bannon fellow will use that as martyrdom for his podcast and his bloviating to present to his followers. I wager on many events(sporting) and issues and laying the odds at 3-1 for the judgment. My ROI has been below average with my losses on Breeders Cup, Kentucky Derby and some political wagers. I will look to see decision at trials end (probably Friday this week)
Vaughn has her pronouns wrong (for shame!)
Lois Lehrner identifies as "she/her."
Bannon is Alger Hiss.
Liz Cheney let the cat out of the bag when she said DJT must never be president again. If this is a trial, Cheney convicted DJT before all the evidence *gag me* is in. Everyone can see that, excepting of course, members of the political party who are so deceived they can't tell you what a woman is. Or what a baby is. Or what a crime is.
It wasn't Red-baiting: they caught the fish. Read Romerstein or Stan Evans. Once the Venona records were exposed, it turned out unambiguously that McCarthy was on the right track --- while the FBI was for some reason at the very least throwing up smokescreens. At least the DOJ was credible back then. Anyway, just a quibble.
Bannon has little to answer to this perniciously selective prosecution: all he has is that it is selective, which I think is enough.
But he has a hell of a lot to answer to for telling conservatives to stay home from the senatorial elections in Georgia. Daily, for months, using pretend "different concerned citizens," many of whose voices sounded suspiciously like that grifter, Jenny Beth Martin, when she didn't openly appear on his show, he urged voters in Georgia to not let anyone steal their votes again - by staying home and not voting. He has a lot to answer to the people who worked hard to get Trump elected in Georgia. He sold us out for a Hong Kong billionaire and we lost ourselves the Senate. Why?
Now there's a question nobody's asking. And I used to like Bannon. He's been right about a lot of things. He uncovered the lab story and stuck with it while so-called professional journalists zipped their lips or opened them only to mock him. He was reporting on the virus daily long before any news outlet began to report at all, let alone craft their narratives.
So why did he then go on to throw the Senate? I get the money part. He was living very large, and people who knew him began to distrust him. He needed his billionaire, who wanted his audience. But why did his money people want to put the scare into conservatives in Georgia? We know who was snookered, but who was crooked?
Someone, in HUAC days, if I recall, said something "to the effect of" "Of course I hold these people in contempt." I think she was of the lefty persuasion...one of the few times I cross over to agreeing.
Live updates on Twitter saying the defense is doing a great job and the gubmint is getting handed its ass. But...it's kangaroo's all the way down.
I loved how Bannon stood in front of the cameras yesterday and called out the committee. Also called out the 2020 election fraud and Biden's illegitimacy. Guys got balls and the truth on his side.
Bannon is right. 50% of the country know the 2020 election was dirty. Watched it happen in real time. That as the coup. Some additional percentage know its true, but ignore it despite the shit condition of our country. Robin Vos for example.
Some hope the J6 committee can take out Trump...even if they claim to support and believe in "democracy".
This isn't even a functioning government any longer. It's a giant grift machine. A Kakistocracy, populated by corrupt and stupid people who think that 'power to the people' is referring to them. And so they use every bit of the power of the government to harass, censor, jail, interrogate, financially destroy, and remove from employment any person who would stand against them, talk against them, or question them.
This is a live held Clown Show, broadcast and widely reported on, with the media playing the role of the gatekeepers for the corrupt, believing with all their might, that they are the good and right, and that anyone who isn't with them should be put away.
I truly wish I was being hyperbolic. But from where I sit and what I've seen over the last 15 years, we are treading precariously close to Banana Republic level. The Guatemalans coming here are in for a great disappointment.

Jawohl, mein Fuhrer!

Isn't it ironic how our corrupt deep state Democrat dominated government believe they are above the law doesn't follow the it either???

Yeah. You might as well put Bannon on trial in Madison, WI.
"The defendant decided he was above the law..." how many years of law school necessary to come up with that argument from a prosecutor in a criminal case? However long, it cost more than the results show.
"The defendant decided he was above the law, and he didn’t have to follow the government’s orders like his fellow citizens. So this whole case is about a guy who just refused to show up? Yes, it is that simple." Assistant U.S. Attorney Amanda Vaughn argued to the jury, quoted
Sure it's a simplistic self-serving characterization, but it's from an attorney arguing in court. It's her job to be simplistic and self-serving except where it's in her client's interest for her to be convoluted and self-serving. The key is to be self-serving at all times. Which she is.
Congress, what a joke, these assholes tell the truth about as much as news actors on the MSM. How did sandy ocasio get 10+ million dollars, 4 or 5 properties. Didn't think crongresssuckers got paid enough for a former bartender to amass that kind of money. Did she take a bunch of zuckerbucks? Did she sleep with another wealthy politician like someone else we know? where did all that money come from? when will it be a crime for congresscritters to lie to the American people? when will it be illegal for congress POS like peloozy to buy and trade stocks according to the bills they are voting on. PHUC congress, just rich elitist slavers, and we are the slaves. When will the POS admin and congress secure the southern border. Far as I'm concerned congress is full of criminals who deserve nothing but scorn. Next time you walk by a POS congresscritter, spit in their shadow.
I believe that Bannon's lawyers are arguing that he was negotiating terms with the House J6 committee, not that he was refusing to testify.

Nailed it. The Gop is in thrall to the leftitarians and the DNC is in thrall to the commies. I won't even call them progressives anymore. Here in Georgia, our fake takeover of the GOPe was a rag-tag bunch of defense attorneys who want to legalize pot, making kumbaya with the usual suspects who wanted those limited grow house licenses who already ran the party.
We don't just have fake coups: we have idiotic fake coups. And that's just the GOP. The DNC is a bunch of old-school wealthy hippies with nice houses quivering at their own young'uns.
I wish Ann Coulter would run for President.

Bannon is Alger Hiss.
No, he is actually closer to Whittaker Chambers. He sees his enemies clearly and doesn't care if he is sacrificed. Chambers thought he was on the losing side, that the communists would win. Chambers and Bannon were/are both very smart guys. I wonder how Chambers could see the future so well?
Lawyers, can you explain the following to me?
It is my understanding that no J6 participant is being charged with "insurrection", "domestic terrorism", or "attempt to overthrow the government". Stipulating that that is true, why would the judge allow the prosecution to use these inflammatory terms in Bannon's case when he is only being charged with a nitpicking violation of failure to respond to a subpoena? I say nitpicking because even the prosecution admits that Bannon's lawyers were negotiating over terms of his testimony (standard practice) when the authoritarians decided to arrest him.
Can anyone make legal sense of my question?
Nancy Pelosi's kangaroo court is not "the government." Full stop.
When Hilary, Tank Adams or Algore claim that they actually won their elections, does the WaPo point out that those claims are false?
Why does Bannon get treated differently? Is it because everyone knows Hilary et al are lying when they claim they actually won the election and nobody believes them? In that case the caveat is not necessary.
In the case of President Trump, many, perhaps the majority, of people believe that he actually won. Thus it is necessary to tell them they are wrong. Tell them often enough and maybe they will believe it. Doesn't seem to be working, though. More people believe Brandon lost today than a year ago.
And how does the WaPo know the claims are false? They may believe that President Trump lost but they have no way of knowing.

Really? Hiss (KGB code name Ales) was guilty of spying for the Russians. He was convicted on related charges. When the USSR collapsed, we got the files on him which confirmed everything we had known from the Venona intercepts.
What is Bannon guilty of? What is he even charged with? Other than, quite properly, holding Congress in contempt.
Famous Mae West line:
Judge: "Are you trying to show your contempt for this court?"
West: "I am trying very hard not to."
John LGBTQBNY Henry
Calls to mind the old country lawyer anecdote.
Judge: Counselor, are you trying to exhibit contempt to this court?
Old country lawyer: On the contrary, your honor, I'm doing my best to conceal it.

I'm looking for the part where they can order citizens to appear before them and testify. Or for that matter, for them to conduct any other trials other than impeachment trials. Or for their power to conduct investigations into anything. Must be in the penumbras or emanations, because it certainly isn't in the text.
I'd like to see someone like Bannon treat a congressional committee with obvious contempt, and when they threaten to hold him in Contempt of Congress say something like this:
"I have the greatest respect for Congress as an institution, and that very respect is the reason for my utter contempt for greedy corrupt two-faced unAmerican swine like [pointing] you, you, you, and you, who pollute these halls by your very presence. That's not Contempt of Congress, it's contempt for specific individual members of Congress who richly deserve the contempt of every American. Would you like me to list the particular reasons for my contempt for each of you? Let's start with sleeping with a known agent of an openly genocidal tyranny that is already at war with us in an almost overt way . . . ."
I'm sure a skilled speech-writer could greatly improve my words, but something along these lines would be electrifying.
Phuc,
AOC probably got millions from Jeff Bezos for her part in "Cooling the mark" in the Amazon 2nd HQ scam.
Amazon never had any desire to build a 2nd HQ anywhere, including NYC. The whole scam was just away to get hundreds of cities to pull down their panties and give Amazon all their most intimate demographic and planning data for free. Probably 10s of billions in free data, much not otherwise available at any price.
Once they got that, Amazon couldn't just say "Gee, thanks, but we've decided we don't need another HQ after all"
So they announced NYC then got AOC to kill it. You did notice that they never built it in their 2nd choice city, didn't you?
It is one of those scams so clever that you just have to stand in awe of. It's the ability to think of such things that made Bezos the 2nd richest man in the world.

Always good to have editorializing in the "news" articles
The leftmedia continues to characterize the claims of a stolen election as "false" while ignoring a growing mountain of evidence of fraud and irregularities coupled with Democrat actions to prevent reviews of those claims.
Polls indicate they have failed to convince a majority of our citizens. Although the polls may be influenced by an unwillingness to believe that 80 million Americans were stupid and self destructive enough to vote for QuidProJoe.

The leftmedia continues to characterize the claims of a stolen election as "false" while ignoring a growing mountain of evidence of fraud and irregularities...
Well where is this mountain?
Bannon is Alger Hiss.
There appear to be multiple Hisses about lately.
Everyone who lives in objective reality understands that Donald Trump did not win the 2020 presidential election. He lost by 7 million actual votes and 74 electoral votes. His claim that the election was rigged has been debunked by numerous Republican state elections officials, and rejected by judges in both state and federal courts in more than 70 lawsuits filed by the Trump campaign and its proxies. Trump’s own Justice Department as well as his former attorney general, William Barr, found no evidence of widespread fraud. - The Hill
So, where is the growing mountain of evidence that proves otherwise?
And as far as elections go, we can sure of scrupulous honesty this year. After all, in Maryland, they'll be able to find the lost flash drives containing the votes if they look for them. I mean, so what if they're lost for a while not under anyone's observation? No tampering will occur.

“The judge has already ruled that any Bannon defense is inadmissible. Then issue of the validity of the "committee" for example. Was the subpoena legal ? Nope. Can't question that. Plus, of course, a DC jury that acquitted Sussmann a few weeks ago.”
I think the appeal is gong to be interesting. The committee didn’t legally have subpoena power. So, what is being charged with? We have a runaway DOJ (duh!) that indicts and tries for non crimes. And a heavily biased DC court system and jury pool. Sure, the DOJ was operating in bad faith. But they do that with regularity with the J6 defendants. But maybe more important, he is being tried for contempt for refusing to comply with an illegal subpoena. Sure, the DC Circuit has a Dem bias. But it isn’t really that leftist. And judges there ignoring these technicalities are going to be called out by their Republican colleagues. It should be interesting.
“Bannon ought to be convicted just for not owning a suit.”
Bannon is honest, whereas Democrats and NeverTrumperellas are some of the most dishonest, malevolent motherfuckers you will ever have the misfortune to encounter in life.
@Heywood Rice: You ask, "Where is this mountain" of evidence regarding fraud and irregularities in the 2020 election?
You actually have to look for it.
Imagine that.
I invite you to start by reading Molly Ball's article in Time, 4 February 2021:
https://time.com/5936036/secret-2020-election-campaign/
Then conduct the thought experiment of reversing the parties' roles.
First there is a mountain, then there is no mountain, then there is--under a tsunami of bullshit from the Democrats, the Never Trump Republicans, the corrupt courts, and their allies in the media.
Whataboutism is a logical fallacy entail the original issue and the related “whatabouts” violate the equal protection clause of 14th amendment. Then “whataboutism” becomes a tool for enforcing civil rights mandated by the Constitution. Those who attack “whataboutism” in such circumstances are promoting the mass violation of civil rights.
Imagine that.
Oh I see, the evidence is imaginary and can only be found through thought experiments. I think the technical term for that kind of evidence is "bullshit" although it's sometimes called hyperbole by professional liars.
The guy loves to talk on his show and outside the courthouse. So I imagine he will gladly take the stand tomorrow, raise his right hand, and answer all the prosecutor's questions on cross. Nah. He has as much courage as Trump.
"They were never going to allow Bannon to testify publicly, so he never would have had the opportunity to do this."
Let me see if I have this right. Bannon has a popular radio show about 12 hours per week, He never talks about his role in Jan 6. He never talks about his conversations with Trump leading up to Jan 6. But somehow the committee was going to shut him up if he complied with the subpoena and answered their questions under oath? Don't follow.

can you be above or below the law in a one-sided show trial?

"whataboutism": What a left winger says when you correctly point out that they're completely full of shit.
There's a growing mountain of evidence that Greg is not the sharpest pencil in the box.

I beg to differ...especially after reading any of YOUR comments. You are too dumb to understand what he is saying.
Trump’s own Justice Department as well as his former attorney general, William Barr, found no evidence of widespread fraud. - The Hill
This would be the same Justice Department and AG who refused to prosecute the FBI agents who lied to the FISA Court so they could spy on Trump, yes?
Open and shut cases, facts well known, refused to do anything because it would harm a member of "the elect", and that's just not done.
So, yeah, if you're a moron or a partisan hack, you "trust" them. Other than that, you don't
@Heywood Rice: You ask, "Where is this mountain" of evidence regarding fraud and irregularities in the 2020 election?
Have you watched 2000 Mules? no?
Then go watch it. After you're done, we will, once again, discuss more of the mountain you refuse to see

The fact that you're really stupid, and "can't follow" that "1 + 1 = 2" has been obvious for a long time now, Jim.
You watched any recent Congressional hearings? Ones where Democrats make a statement accusing the "witness" of being an evil criminal scum, doing so in the pseudo form of a questions, and then say d"I reclaim my time" when the witness tries to respond?
We've have
Multiple Secret Service Agents were questioned in private. They didn't say what the Committee wanted them to say, so none of their testimony has come out.
the Democrats are all lying hacks. The J6 Committee is not a legitimate committee, since all it has on it are Democrat appointees. The entirely proper response is to refuse to go in from of them

Poor Mutaman. Still knows he's completely full of shit. Still knows he can't make any sort of substantive point. Still feels the need to throw poop like a 2 year old
See, Mut, this is what happens when you have absolutely no principles, while claiming that you do: People point out that your'e violating your claimed principles. You ARE in fact violating them. And so you have to babble about "whataboutism", because anything else would require you to admit what worthless scum you are
Sucks to be you
jim5301: "The guy loves to talk on his show and outside the courthouse. So I imagine he will gladly take the stand tomorrow, raise his right hand, and answer all the prosecutor's questions on cross"
LOL
How revealing.
"the prosecutor's"
Last weeks lefty/dem/nevertrump talking points: This is not a trial so there is no reason to not answer questions!
This weeks lefty/dem/nevertrump admission: This is a trial where the dems and dem-adjacent liars are judge, prosecutor, jury with dem hack Garland in the wings as executioner.
How perfectly and wonderfully Soviet resident idiot jim5301 has put it today!
Greg - Public congressional hearings is the only way for Bannon to be heard? I'm sure MSNBC and CNN and perhaps FOX would love a prime time interview with him. And then of course there is his own show.
Drago - It's revealing to say that defense witnesses at criminal trials get cross examined by prosecutors? That you apparently think so is quite revealing.

I’m forced to defend Drago- he’s very familiar with criminal litigation due to that time he was charged with violating the Peeping Tom laws. He ended up copping a plea and picking up trash in the parks for several weekends

Jim: Bannon does not the Dems, or their Committee formed in violation of House rules, anything.
So he should go on his show and say what he wants, and tell the Dem to FOAD when they want him to come talk to them.
Since Dems like Adam Schiff have repeatedly showed that they will lie about unreleased testimony, giving them testimony to lie about is also quite stupid.
I'm sure Bannon would have been willing to go testify if it was required that it all be in public, and that he gets 3x the time a member spends on a "question" to answer it, with no cut-off allowed by the member or the Chair.
IOW, he might have agreed to appear if they agreed to not play bullshit games.
But since they weren't willing to do that, FOAD was the correct response.

Already did, Sparky. Your stupidity / dishonesty is not my problem
