"I want to get out and protest right the fuck now - thinking of heading to the Capitol with a sign + my rage and hoping others join in."

Said one commenter — an hour ago — in the r/madisonwi discussion at Reddit.

An hour ago is about exactly when I walked through the Wisconsin Capitol Square, past the "Forward!" statue, loomed over by the spire of the Episcopal church:

I thought I'd find at least a few people with signs, getting the protests rolling, but there was no one (other than a state employee watering the nearby flowers).

But you'll find some links at that Reddit link post. One goes to Facebook, where there's an announcement of a march to begin at the spot you see in my photo, beginning at 5 p.m. You're told to "[b]ring your loved ones, your rage, and your grief."

UPDATE: We drove up to the Capitol around 5 and there were lots of people with signs converging on the place. Traffic was blocked off.

Maybe the incongruity of once having been compelled to significantly modify our lives over the last 2 years, in order to preserve to lives of others, versus, having to carefully consider a pregnancy beforehand, in order to protect the lifeline of future generations, is not so patently obvious after all.

Wisconsin has an 1849 law that bans abortion, except to save the life of the mother, but whether that law is enforceable was expected to be the center of yet-to-be-filed lawsuits.

What specific changes in Wisconsin do the protesters desire from their legislature and governor? If it's getting rid of the admitting privileges it seems a lobbying campaign rather than a protest is in order.

Yes. Bring your rage. Outrage is the only thing manufactured in the US anymore. Our output of outrage far outpaces any other country and exceeds actual demand, yet we keep producing it. Daily. By the truckloads. It's making the value of outrage go down and so when we finally get something large to debate, such as abortion, many of us are unmoved. We just want to get moving on already. Our outrage has been cheapened. It no longer has the kick it once did when there was more demand for outrage than the actual outrage being produced.

Networks and newspapers have lost their way when it comes to journalism. And politicians have lost their way when it comes to leadership, statesmanship. But they far exceeded anyone's expectations when it comes to producing outrage. They do that extremely well. And it's had an impact on many of us react now to things that probably should manifest some outrage- one way or the other. I'm just tired of all of it. Sorry. No outrage from me today. I'm all out.

I had heard the same thing weeks ago that there is still a law from 1854. I went and looked and find it has been updated several time. Most recently in the 1970s iirc. Still banning abortion.

I had not heard that it might be unenforceable. Do you or anyone else know why it would not be enforceable?

63,000,000 completed abortions since Roe might indicate the pro-abortion side should be able to win in every state legislature. Then again, that huge number might be the very reason the pro-life side has been able to win in about half the state legislatures.

A million women per year getting abortions is a failure of massive proportions in raising women to understand the reality of their bodies, educating women to care for themselves, and having women use birth control to avoid pregnancy. This is a woman's issue, all right, but not the one that the news media is bloviating over. Women should not still need one million abortions annually in this day and age, and that they do is on them. I'll offer my toxic masculine help if it can be useful, but damn, girls, get your shit together.

Professor Althouse, I’m honestly curious. Do you read the comments on your posts? And, if so, how do you decide whether to respond (if you do)? I’m outraged by today’s decision for a litany of reasons—most not having to do with substantive due process. And while I live in Madison, and blocks from the capitol at that, I’m not at the square “protesting.” Like many, I feel paralyzed by our state’s gerrymandered legislature but buoyed by Evers’s veto. I’ve been spending a lot of time contemplating 940.04, and its changes over the years, to try to craft counter arguments to what WILL says it means.

Professor, I miss your actual substantive take on cases, your probative questions about them, and your lectures from 20 years ago.

There have been problems in some jurisdictions, lately, with enforcing laws. Soros correctly calculated that the most cost-efficient way to render America impotent and moribund was to purchase -- for a song -- the offices of DA in a number of large cities. Not sure who they've got in Madison, but I seem to recall that during the recent unpleasantness, the laws against destruction of private property were found to be unenforceable.

It was a tactical error on the part of the Supreme Court to release this decision on a Friday morning. This means that protestors with regular jobs have their whole weekend off to cause mischief. Doing it on a Monday where they might get in trouble with their job if they don't show up for work the next day might have held down the number of troublemakers. And yes, I know that most of them are loafers and ne'er-do-wells who probably don't have jobs.

Interesting that an 1849 law is claimed to be controlling in WI. I think it is a perfect example of how Roe stifled debate and "progress" at the state level. I admit I am confused by the coverage that also says that Scott Walker signed legislation that banned abortions after 16 weeks. Further research only convinces me that both laws are in effect and which is currently effective will have to be decided either in court or at the legislature. Since the 16 week ban is most current one would think that it most probably represents the view of the majority of the electorate and that closing down abortion clinics is just intended to stir the pot.

Had a friend who had an abortion in the '80s, on the behest of her husband. (Who was a somewhat abusive asshole in the first place.) They got a divorce a few years later - but the psychological cost to her was very high. She wasn't the healthiest of women, and struggled ever after with depression and eating disorders.

TBH, I don't know how good a mother she would have been, and I know her husband didn't want to grow the hell up - so maybe it was for the best Still, until she passed away she regretted being forced into it.

Back in the day, I thought it was a good thing. I didn't want kids, was never going to be a dad, but used birth control or my partners did. But then I married and had a son - and I think about what could have possibly been for my friend.

I'm thinking they got this right. Leave it to the states to decide and ignore the rage-filled assholes who are looking for something to riot over.

Grief is a strange thing to feel over this. Even if you think a woman’s bodily autonomy is more important than her baby’s why would you use the word grief? Grief is for the deaths of loved ones or innocent strangers. The deaths of millions of babies. Not the end of a law giving you a “right” that has been illegal in most human societies through most of history.

Anyway maybe they should understand now how people felt having their lives destroyed while gays and their “allies” tried to force them to “bak the cake and make the wedding flowers”.

What exactly are people in Madison protesting? I doubt that there will be any changes in abortion laws in Wisconsin? Has the state tilted farther right that I realized? As far as other states are concerned, how is it their business? If they do not believe in the United States of America, and think they get to push their values on people of other states, then maybe we do need to dissolve this great experiment.

I think Ms Althouse is probably right that there may be privacy rights to terminate pregnancies in early stages as there are privacy rights to birth control. That was not at issue in this case. Let's see what happens when some of the heartbeat laws get litigated. Personally I'm happy with the Mississippi law at issue and the Florida law that mirrors it with a 15 week limit. Once, the baby is kicking, it seems like a person to me and I think to most people.

She clearly reads (and responds to) some. Moderation suggests they (she and Meade) read more, but I suspect a lot of people get at least an initial pass. As witness a number of double/multiple posts that get passed through. And an occasional comment (of the few comments) of mine that go up immediately.

She responds when she is tickled by a response.

She can also have a bit of a thin skin and respond when she thinks someone has misread/failed to read her post or is insulting her.

I think she rarely responds on a substantive basis. Not what she is going for.

Sure, it's not the result they would have preferred but they've proven to be adept at getting people's ballots to where they need to be in order to be counted. I can't see any reason that skill can't be repurposed towards getting women who need an abortion to where they need to be, either.

The Guttmacher Institute, hardly an anti-abortion outfit, wrote just 8 days ago that abortion was legal in Wisconsin prior to 20 weeks post-fertilization. Wisconsin, like a lot of states has passed laws in the last 30 years based on the Casey's viability standard. Those various laws have superceded the 1849 law itself. So, today's decision doesn't change anything in Wisconsin- abortion is still legal prior to 20 weeks post-fertilization because that law is still on the books, you dumb fuck.

I read a longish NPR article on what will happen in Wisconsin post Dobbs.
There are about 6,000 abortions performed annually in Wisconsin. Only four clinics in the state perform abortions, and they are in urban counties controlled by Democrats. The Democrat prosecutors in these counties have said that they will not prosecute abortionists, despite abortion being illegal. The state AG, a Democrat, has also said he will not prosecute abortionists.
However, a future, pro-life DA may choose to prosecute these cases.

The decision being announced as early in the morning (Pacific Time) as it was, I was able to get to the noon Mass here afterward. A full house today, for some reason. Father managed (it can be a challenge, ahem) a quite decent homily, weaving the pro-life ministries of the past fifty years in with the texts of the proper and lessons of the feast's Mass. I think it is more than likely an unnecessary precaution but the pastor at the parish I belong to (the only one downtown) has asked the male parishioners to sign up to a rota and then walk around the block where the church is situated 'being vigilant', telephones and flashlights in hand, during the weekend. Although it is certainly true that Eugene has its share of (not to put too fine a point on it) crazy people, in the past (e.g. back when 'the leak' happened) the federal buildings have been the focus of such nonsense. I'm not going to stand outside in the 90 degrees of heat for two hours in the day, sorry, and reliance on the city bus means I can't do my duty in the night or early morning; since I'd need to have my cane with me I'd be apprehensive anyway that it might be perceived as a weapon by some deranged vandal (or that I might be tempted to use it as one).

At least the protesters in Madison are protesting at the correct venue. It is going to be interesting what laws end up being the actual relevant statute. If for example the Mississippi law that the SCOTUS has now blessed supersedes all previous legislation then Mississippi now has one the most liberal abortion laws in the developed world.

The reason the abortion clinics are shutting down is not that they really fear they will be prosecuted for performing them, it’s to further incite the mostly peaceful protestors. This is not some bolt out of the blue, they knew it was coming. Now, the Wisconsin legislature could surely call an emergency session and rescind the previous law and replace it, but I expect they’d rather demagogue it instead.

I imagine a majority of the Amlaw 200 law firms, like mine, issued statements today in support of women. At least one gave everyone the day off to process.

It was said that Roe was harmful because it cut short the political work that had been going on to enact abortion rights. Like in California under Gov. Reagan. It will be interesting to see that engine rev up now. Especially in light of the Thomas concurrence.

It’s going to be interesting in places like WI, and esp Madison. The feminist movement nationally has lost a lot of cohesion this last year due to the left’s demand that people born with, and even still having, penises be included as “women”, if they want to be. Women born with penises personally just don’t care that much about abortion. Why would they? They will never get pregnant. They are, of course, told that one of the requirements of assuming womanhood is supporting abortion rights. So, they ostensibly do. But it often isn’t that heartfelt.

There just aren’t going to be that many women deprived of abortions in WI, even if the law isn’t changed there. Most of the population, and esp Blacks, in the state just don’t live that far from IL, and esp Chicago, where abortion is going to stay mostly, if not completely, legal. Sure, there are going to be some people with uteruses inconvenienced by this, but likely very few, if any, of them actually deprived of an abortion, esp with Blue states are waking to the possibility of abortion tourism. Worse comes to worse, and Planned Parenthood can just start running abortion buses down to Chicago every week from the bigger cities in WI (where most of the uterus people who might want an abortion, and can’t just jump in their car for the trip, live).

My point is that while a couple years ago, the feminists in WI were probably united enough to eke an abortion bill through the WI Legislature, and get it signed into law, that lack of cohesion, of focus, now combined with the likely ease of getting an abortion in nearby IL, may call that into question today in WI. It’s really more symbolic, than anything. But then it always has been - the types of women running the feminist movement have always been the type who would rarely need an abortion in their own lives, since for the most part, they aren’t the type of women engaging in a lot of unprotected sex outside marriage.

We shall see.

They had a protest in Nashville this morning too. The local "news" tried very hard to make it look like a huge crowd, but the best I could tell, it was between 100 and 200 people.
