"'This is an insult to injury,' one of Blake's uncles told media Thursday. 'He is paralyzed and can’t walk and they have him cuffed to the bed. Why?'"

"During an appearance in Kenosha on Thursday, Gov. Tony Evers said he 'couldn't imagine' why handcuffing a paralyzed man 'would be necessary.' I would hope that we would be able to find a more, a better way to help him … in recovering. That seems counterintuitive. It seems to be bad medicine."

From "Family says Jacob Blake is handcuffed to his hospital bed; has retained Racine Attorney Patrick Cafferty" (madison.com).

Here are some possibilities that I can imagine: 1. It's not true that Blake is handcuffed to the bed, 2. It's not true that Blake is fully paralyzed, 3. There's a concern that others might help Blake escape, 4. Blake is capable of doing dangerous things with the part of his body that is not paralyzed.

Also at that article, we get some additional information about Blake: "According to a criminal complaint, at around 6 a.m. on May 3, Blake entered his ex-girlfriend's home the 2800 block of 40th Street — the same block where he was shot three months later — in an attempt to retrieve his property. While there, Blake is accused of having penetrated the woman with his fingers." They should add "without consent"! That's what makes it a crime. The crime is sexual assault. In other words, rape. He deserves to be under arrest, and he resisted arrest vigorously. There is reason to feel empathy for any human being who suffers a grievous injury, but let's not forget about the seriousness of the charge of rape!

I need to read the criminal complaint.  Here (boldface added):
Count 1: CRIMINAL TRESPASS, DOMESTIC ABUSE
The above-named defendant on or about Sunday, May 3, 2020, in the City of Kenosha, Kenosha County, Wisconsin, did intentionally enter the dwelling of LNB, without the consent of some person lawfully upon the premises, under circumstances tending to create a breach of the peace, contrary to sec. 943.14(2), 939.51(3)(a), 968.075(1)(a) Wis. Stats., a Class A Misdemeanor, and upon conviction may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than nine (9) months, or both. And further, invoking the provisions of sec. 968.075(1)(a) Wis. Stats., because this charge is an act of domestic abuse, costs upon conviction would include the domestic abuse assessment imposed under sec. 973.055(1) Wis. Stats.

Count 2: THIRD DEGREE SEXUAL ASSAULT, DOMESTIC ABUSE
The above-named defendant on or about Sunday, May 3, 2020, in the City of Kenosha, Kenosha County, Wisconsin, did have sexual intercourse with LNB, without that person's consent, contrary to sec. 940.225(3)(a), 939.50(3)(g), 968.075(1)(a) Wis. Stats., a Class G Felony, and upon conviction may be fined not more than Twenty Five Thousand Dollars ($25,000), or imprisoned not more than ten (10) years, or both. And further, invoking the provisions of sec. 968.075(1)(a) Wis. Stats., because this charge is an act of domestic abuse, costs upon conviction would include the domestic abuse assessment imposed under sec. 973.055(1) Wis. Stats.

Count 3: DISORDERLY CONDUCT, DOMESTIC ABUSE
The above-named defendant on or about Sunday, May 3, 2020, in the City of Kenosha, Kenosha County, Wisconsin, while in a public or private place, did engage in violent, abusive, indecent, profane, boisterous, unreasonably loud or otherwise disorderly conduct, under circumstances in which such conduct tended to cause or provoke a disturbance, contrary to sec. 947.01(1), 939.51(3)(b), 968.075(1)(a) Wis. Stats., a Class B Misdemeanor, and upon conviction may be fined not more than One Thousand Dollars ($1,000), or imprisoned not more than ninety (90) days, or both. And further, invoking the provisions of sec. 968.075(1)(a) Wis. Stats., because this charge is an act of domestic abuse, costs upon conviction would include the domestic abuse assessment imposed under sec. 973.055(1) Wis. Stats.

PROBABLE CAUSE:
On May 3, 2020 Kenosha Police Officer Raiche, in full uniform and operating marked squad #3343, responded to 2805 40th Street Unit D, City and County of Kenosha, state of Wisconsin for a report of an ex-boyfriend who had broken into the residence and stole vehicle keys, a vehicle and a debit card from the victim before fleeing. Officers Matz and Raiche arrived on scene and spoke with LNB. Officer Raiche reports LNB was crying and visibly shaken, dressed only in a nightgown. LNB invited them in and explained that the previous evening she had left at approximately 8PM to attend a party in Milwaukee. LNB rented a vehicle for the weekend because she didn’t think her vehicle would make it because of mechanical issues. LNB asked her sister Tamara to stay the night and watch her three children while she was gone. LNB returned home at about 4:11AM, her sister was sleeping in the living room on the couch with numerous children so LNB brought her son with her into the first bedroom down the hallway on the east wall, they then lay down to go to sleep. LNB stated at about 6AM she was woken up by the father of her children, Jacob Blake, herein known as the defendant, standing over her saying, “I want my shit.” As LNB lay there, on her back, the defendant, suddenly and without warning, reached his hand between her legs, penetrated her vaginally with a finger, pull it out and sniffed it, and said, “Smells like you’ve been with other men.”

Officer Raiche reported LNB had a very difficult time telling him this and cried as she told how the defendant assaulted her and then the defendant immediately left the bedroom. LNB stated the defendant penetrating her digitally caused her pain and humiliation and was done without her consent. LNB stated she was upset but collected herself and ran after the defendant out the front door and then realized her vehicle was missing. LNB ran back inside to her purse, which was on the kitchen counter and checked it, quickly realizing her key to her truck (Ford Explorer 2002), a black individual key and the only key for the vehicle and her Great Lakes Debit Card were missing. LNB immediately called 911 and while waiting for Officers, checked her Great Lakes Account and saw two fraudulent ATM withdrawals on May 3, 2020 that she did not make, both at PNC Bank, 3920 Washington Road, both for $500, at an unknown time.

LNB stated she and the defendant have three children together but have never resided together in the eight years they have been on and off. LNB stated the defendant is unemployed, has no vehicle, and would not tell LNB where he was currently living. LNB stated over the past eight years the defendant has physically assaulted her around twice a year when he drinks heavily. LNB did not know how the defendant entered the apartment and thought maybe through a window....

First of all, killing someone because they have damaged your property isn't murder, it's justified homicide. Secondly, random property destruction isn't an answer to anything. In order for your idiocy to have any basis, the property damage would have to be limited to the person who committed the murder, which it never is.

No one is arguing that killing people at random is an appropriate response to property damage.

Which property damage were you referring to, anyway? Blake wasn't accused of property damage, he was accused of rape. Most people here probably think that that that is a suitable penalty for rape.

Shouldn’t there be two more felony charges added to the court docket for Jacob Blake from this encounter the victim had with Blake? Under the Probable Cause headline above, Blake allegedly took the victim’s personal vehicle and her debit card. I would say that a count of operating a vehicle without the owner’s permission constitutes auto theft and if he used the debit card, thus draining her bank account, would be accessing her bank account without her consent.

My spouse worked the ER in Grady Hospital in Atlanta in the 1980s. Prisoner/patients were cuffed to their beds even when unconscious, because they often misbehaved when they regained consciousness. If you are working on a patient and they are cuffed to the bed, you're working on a person the police brought in, and should have appropriate regard for your own safety. And if you cuff every single prisoner who is a patient, even if they are paraplegic, it saves the confusion of wondering who is a prisoner/patient and who is just another nice person who got shot.

My dad was handcuffed to his bed to keep him from getting up during the night and accidentally ripping out all of the tubes, etc. They told me they had to do it for his safety, as he would get disoriented during the night and struggle to get up.

Blake also had been charged with gun-related crimes in 2015, but those charges had been dismissed.

In September 2015, the Racine County Eye reported that Blake had been arrested after brandishing a gun at a bar in Racine, and that officers required the assistance of a police dog when Blake allegedly refused to comply with their orders. He was charged with several offenses, including: felony resisting arrest “causing a soft tissue injury to a police officer”; carrying a firearm while intoxicated; and endangering safety by the use of a dangerous weapon.

However, Blake was never tried or convicted on those charges, and in August 2020, the Racine County Eye reported that the charges appear to have been dismissed at the urging of the prosecutor and no longer appear in public court records.

I have no problem with Blake being handcuffed to the bed or whatever, even if he is paralyzed. The man is facing prison time for these charges, which are very serious. Obviously, if he had an outstanding warrant for his arrest for sexually assaulting a minor and the police couldn’t find him, he was hiding and is a flight risk. All it would take is for some of his friends, heavily armed, to break into the hospital & overwhelm the police guarding Blake. Unlikely, but it has happened elsewhere before (El Chappo escaped numerous times from more heavily secured facilities). Yes, also unlikely given that Blake may be in a position to reap a large financial award from the City of Kenosha in civil court for the shooting, but that is not a given as he was resisting arrest, armed, and maybe trying to escape in the vehicle when he was shot. And, if he is in prison, he won’t be able to spend that money. If by chance he does win an award in civil court, the State of Wisconsin should immediately seize a good chunk of that money for child support to pay for those 6 children’s financial needs as they grow up. I am going out on a ledge here, but I suspect he hasn’t provided much financial support, if any, for his children, or any of the women who he had impregnated.

I admire Jacob Blake's mother, Julia Jackson. She seems both good and intelligent, and maybe even a special person. It hurts to imagine myself in her shoes.

I feel badly for the police, who were put in an impossible position. I believe they did the right thing in shooting Jacob Blake, although I think seven shots were excessive.

I don't believe the police knew what Blake was reaching for in that car, but they had an many good reasons to think that he was reaching for a weapon. Given that context, it would have been wrong to have not shot him. I just don't see that there was another reasonable choice. An ignorant viewer might have assumed that the officer could have physically overwhelmed Blake, and of course that would have been what would have happened in the movies, if the officer had been the protagonist. But real life is different from the movies, and in any case all three officers had already tried to physically control Jacob Blake and failed.

If it's true that a knife was on the floor of the driver's seat, then that is what Jacob Blake was reaching for and it is fortunate for the officer behind him that he shot him when he did -- as he was just in time. But even if that wasn't Blake's goal, it doesn't matter, he created the situation which gave the officers no good option.

Note all of the falsehoods underlying this statement that makes attempts at finding common ground impossible.

1)The 17 year old charged with murder did not "murder" 2 people "commiting property damage". He fired his weapon while under assault by multiple people (video appears to show at least 4 people attacked him). Whether or not that was justifiable needs to be determined by a jury.

2)"Property damage", as described above, in Kenosha is not in response to any "murder" as the arsons, riots and looting began after Blake, a known felon with existing felony warrants, was shot while fighting with the officers who were responding to a 911 call by one of the victims of Blakes multiple assaults, but was not killed.

3)The proper response should be to review the evidence, charge defendants with crimes based based on probable cause and have a jury judge them.

4)One side is advocating for special status for a select group, while decrying what they claim is special status for a select group.

5)The other side advocates for law and order for all. Note that no reasonable person has said that the officers involved in George Floyds death should be given special status because they are police. They were immediately suspended and eventually charged and will face pur justice system.

6)The police involved in Blakes shooting will also be facing review and potential charges if warranted.

This is the choice before us, surrender to the violent, lawless and unaccountable mob, or stand for law and order.

When Black fathers have the Ta Nehisi Coates father-to-son talk to explain that all cops are bad and always looking for the first opportunity to off a Black man, do they ever explain that the best way to avoid interactions with cops, hence getting offed, is to refrain from committing felonies? And, if such restraint is no longer an option then advise the youngster to avoid resisting arrest or assaulting a police officer if and when questioned by said police officer. If not, could someone recommend that Ta Nehisi add a paragraph which addresses those factors? I don't want to be insensitive to the plight of the Black man or jump to conclusions, but it does seem that felonies and resisting arrest and assaulting police officers could possibly be a common thread in these unfortunate confrontations that seem to cause buildings to spontaneously ignite and professional sports contests to be cancelled. Just a thought. I suppose I could be way off base here.

The press the WI Gov/Lt. Gov aren't telling anyone: The "shot 7 times!" battle cry is possibly a lie. To me, 7 times is really disturbing even if the cop was justified. But from the get-go, Reuters quoted Blake's attorney, Crump, as saying 4 of the 7 shots hit Blake. Can't figure out why Crump would say that unless it were true. As to why others might inflate the number of bullet wounds, well, one obvious answer would be to make the shoot look more vicious, incite riots, etc.

The state AG's official statement carefully (weasily ?) avoids saying Blake was actually shot seven times...why? This can't be a fact in dispute at this point, can it? ("the cop fired 7 seven times. the cop fired into Blake's back.")

Truthfully, 3-4 shots to the body in this situation doesn't disgust me. (I know the damage one of my former clients did after getting hit with fewer.)

Well, as to the latter, I should think that property damage might be an appropriate response to murder -- but random property damage, by people with no connection whatsoever to the victim, to owners having no connection whatsoever to the murder or to the murderer(s), simply can't. "You cops killed a man I didn't know, so in retaliation, I'm going to burn down this car dealership, owned by people I also don't know, and who have zilch to do with you" is so far off common sense that you can't see there from here. It's like a slightly elaborated version of "Let's you and him fight."

I didn't repeat the internet chatter that Blake was an accused rapist. Now we have that in the form of an arrest report.

Common sense tells me shooting persons that refuse to follow police orders will save the lives of lots of people.

I have repeated it more than once here. My dad had "the talk" with me and my two older brothers. Obey all police directives. Regardless of circumstances, obey. IF, IF, innocent, dad would sell off part of the farm to clear our name. IF we were innocent. But there is empty victory in clearing the name of corpse.

Facts are piling up that both of these shootings are honest shoots. I have real doubts about a prosecutor wanting to push a trial, knowing of all the exculpatory evidence they are going to have to address.

Are there police abusing their power and killing suspects without cause? Absolutely. Is every shoot a crime? NO.

This is a false premise: Murder is some species of wrongful killing of a Human. One can kill a Human without it being wrong, self-defense--for example.

Also, the conclusion doesn't follow the premise, even if the premise was correct (which it isn't). An appropriate response to murder is arrest (by police), conviction (by jury) and sentencing (by a judge).

There is a difference between defensive use of violence, to stop depraved assaults upon the innocent, against their property or their lives, and offensive violence, which is the depraved assault upon others' property or their lives. I made this point before but it bears repeating.

I volunteered for years at a shelter for homeless women and children, mostly black (I'm such a racist). One of the workers was a young, black woman...off the charts beautiful...a real stunner. And at first I really liked her, we got along well.

But after awhile it was race, race, race. She looked at the entire world through the lens of racism.

When she left the job to attend graduate school, she sent me an email asking if I would help fund her college bills. I didn't reply...I was an evil white man after all...I didn't want to spoil her world view.

An early report I read said seven shots were fired, but only four hit him. So is four hits excessive? The cop may have realized he was missing his shot and kept firing in order to make sure he actually hit the perp. I doubt these police officers are in many situations where firing their service firearm is necessary. Unless they have a lot of live fire military experience, I'm not surprised he got off seven shots.
Having said that, the optics are terrible. Having said THAT, because the optics are terrible there will be a horrific emotional reaction by governors and others not familiar with the whole situation. So it will take a lot of logical, even tempered explaining when the facts come out clearning these officers.

They now also risk losing their jobs, criminal indictments, and personal actions for damages. In NYC, a cop can be charged if during an arrest or other skirmish, the cop somehow impedes the diaphragm of the perp. Given how violently perps often resist, it’s an impossible task to subdue someone without finding yourself subject to charges. It would be safer to let the fucker flee. Arrests in NYC are way down and the mayor is claiming victory in a reduction in crime. Hahaha

I can’t imagine why any cop would look forward to going to work.

I like Crack. I often read his website. I would appreciate his thoughts, step-by-step, on how the events in Kenosha could have unfolded in a way that produced a satisfactory outcome for all. Of course, when Blake resisted arrest, the officers could have backed off and let him go and try to take him into custody another day if they could find him.

And we’ve all seen dash cam footage of perps who reach into the car and come out shooting. So the cops would have to take cover immediately upon giving up on the arrest. I guess if the perp gets off the first shot, then maybe the cops could shoot back a shot or two, but nothing that could be characterized as excessive force like, maybe, emptying a clip.

But, of course, perps know the drill, and if it becomes clear that all they have to do is put up a fight, the cops will let them flee for fear of a tragic outcome or criminal charges leveled at the cops. I’m not sure how this would be a satisfactory outcome. Would we then later send in a team of social workers to talk the perp into surrendering while explaining how deeply they feel the perp’s pain from societal oppression and injustice and white supremacy.

Most folks are seriously trying to imagine a different way of handling a domestic 911 call like this. Maybe don’t show up at all? Help us out, Crack

There were also three children in the car, so no, I'm not sure the cops could have fired back.

There were no good options. By the time they get to the door of the car, shooting the guy was the only option. Every other choice would have been even worse.

It's a mystery to me how the police officer that was holding Blake's shoulder could have missed three times when his gun is no more than a foot away. A possible explanation is that the first three shots were not intended to hit and the officer was hoping Blake would freeze.

Really, almost all real-world police pistol marksmanship is that bad. Most cops don't practice regularly, and that's before you throw in the fact that a) they tend to practice in a controlled environment with non-moving targets and b) adrenaline seriously screws up fine motor control.

Seems to me those of us who aren't just blindly and blithely assuming that the police shot Blake without provocation (an assumption very much not borne out by video evidence) are instead focusing on the circumstances. The circumstances were:

* The police were called out by a complainant on 911 to stop this particular man.
* When they arrived on the scene (or before), they learned that he had an outstanding arrest warrant for a violent crime.
* The car he was driving had three kids in it.
* He resisted arrest (for the outstanding warrant and for the current 911 call).
* The police attempted to subdue him with nonlethal force - a TASER - which he apparently shrugged off and walked away from.
* He may have been armed with a knife already at that point - this point isn't clear - but he continued toward the driver's side of his car against police warnings, opened the door, and bent low, apparently (a reasonable person would conclude) to pick something up. Even if all he was doing was ducking to enter the car, if he had been successful, he could have driven off with the kids - or he could have driven into the officers.

The "video of 7 shots into the back of an unarmed [sic] man" is far less dispositive than these pretty well undisputed facts.

My great uncle was a cop in the '30s and '40s in a well-known city now over-run with bums and junkies.

In those day there were junkies, but they hid from the law. There were few bums.

The result was people being able to walk in their neighborhoods at night...even women walking alone. Imagine that.

It's not a very nice place to live, despite being run entirely by and for black people. Per capita income and living standards way below what even poor black people have in the USA.

If you don't like that specific example, look at the rest of sub-Saharan Africa. Lots of countries run by black people to choose from. Not a one that approaches the living standards of a typical black person in Mississippi.

Like Mikee's wife, I was in the Grady Hospital in the 80's and 90's as a VISTA and a volunteer. I spent some weekends in the gynecology emergency and rape crisis center. It was extremely dangerous - - a doctor was beaten into a coma and brain damage one night. I'd stand in front of the elevators and stairs and try to decide which one I wanted to risk taking. Inmates were brought in after midnight. Of course they had to be handcuffed. If you've never lived this sort of thing, you have no idea what police face every day.

We could not get convictions for even the most heinous sexual assaults in Atlanta courts, not the prostitutes garrotted to trees in a cemetery, not the ten year old victim beaten half to death, not with mutilation inflicted on old women. The cops caught them; the media and the ponytailed lawyers defended them, and the moronic jurors and preening judges cut them loose. Most of the victims I saw were very young black girls or elderly women. I still have the file a ranking officer gave me of rape cases of underaged girls at a politically connected strip club -- cases officially "disappeared" by the city's first black female Chief of Police, Beverly Harvard. Oprah and Michelle's pal. Rape was practically a defense: you'd get more time for breaking into a house than breaking into a body. That's why the majority of the first thousand or so stranger offenders identified through our state DNA database had only burglary or drug priors -- they pled down and prosecutors took what little they could get, knowing they couldn't get them for rape. It's worth repeating: if you haven't lived this, you have no idea what police face every day. We do not have a police brutality problem in America: we have a brutal criminal problem.

This might have been a "zero tolerance" rule thing. I heard on the radio that's it's SOP to handcuff hospitalized prisoners if they're under arrest. The person said that he's even seen people in comas handcuffed to beds. I also heard that they unhandcuffed him once the bad optics of this became apparent.
