"Isn't it beautiful?" — a middle-aged white woman enthused gently...

... as I was photographing this...

... in downtown Madison. Maybe she was just trying to say the right thing, but maybe she was delusional or had very low standards. I aim to help — and I have to admit that she wasn't the slightest bit intimidating to me — so I said, "Actually, I don't think this one is very good." In my endless search for positivity, I added that there were a lot of other murals and many of them were good. And then, because I'm always looking for a point of agreement, I said, "The eye is... interesting"....

Despite or maybe because of the roughness of the painting, it has a creepy drippiosity that's vaguely riveting....

Your efforts to take discrete instances of tragedy and turn it in to a violent race war has already resulted in 17 deaths in about 10 days. Let that sink in. Police killed 9 unarmed blacks last year out of 350 million contacts. That is a tragedy rate of .00000002 or .000002%. In the US, lightning strikes killed 51 last year for a tragedy rate of .00000015 or .000015%. Regarding riots, at the rate of 17 killed per 10 days, that would be 620 people. 9 people killed by officers 620 killed by the rioting response to one tragic death. (Equivalent rate, mind you, not actual for those with low comprehension abilities.)

So I guess I have to agree with you I shall not be silent about violent riots because silence is violence.

Silence is Violence has a much more sinister potential than other slogans. In order to carve out an exception to freedom of speech there needs to be an argument for substantive harm. Silence is Violence could be the core of that argument in a way Silent No More could not. For that reason I can't see the slogan without thinking of it as the opening shot in a case for compelled speech.

Silence is a form of expression, and forcing people to speak is an infringement on the freedom of speech. And here, the point isn't that you should not be silent, but you are required to say what is being dictated to you. You're not free to say whatever you like or to have an independent point of view. That's even more disapproved of than silence. Compelled speech is a nasty tactic. There are many of us who keep silent because we feel we don't yet know all the facts or because we don't understand what you're talking about. Some people are feeling pressured to say "dismantle the police" and they're saying it even when they don't know what it means! And, shockingly, the people who are demanding that people pledge to dismantle the police don't even know what they themselves mean. In this circumstance, silence is a respectable option, and to be accused of violence is... well... I guess they don't mean that literally either...

How much more powerful is the slogan "Silence gives Consent", compared to the bizarre "Silence is Violence". No one was silent when the cop kneeling on the guys neck was shown- America was united as one to say that was uncalled for and out of bounds, that cop needs to be held accountable. BLM and Silence is Violence and Antifa and Defund the Police and all other assorted loons are responsible for dividing the nation.

This is just SAD!

I'm seeing the contradictory- and therefore perfect for this moment in time- demand that white people just listen for once. I had a lot of Facebook friends post last week that they were going to mute themselves so people of color could speak and they could learn.

Then, of course, there is the National Conversation on Race that we are supposed to engage in.

Yet none of those things really involve letting people have any opinion but The One True Opinion.

As a law professor, you are completely familiar with critical legal theory and I assume at least basically familiar with the associated philosophy of critical race theory et al. If you don't think that the dedicated proponents behind these theories don't use the term "violence" in all it's overt potential, maybe you haven't been paying close attention. It's terrifying to see these beliefs being widely adopted by unthinking masses and by political leaders, because they most certainly fucking DO permit and promote violence as a moral given.

I can understand why a struggling business would use any means to try to stay alive, including signals that they are sympathetic to the mob's stated objectives.

But my litmus test comes when I am left alone to contemplate and form my own beliefs on the matter, and then speak it without fear of being cancelled. And incidentally, disagreeing is not the same thing as not caring.

This lady - she sounds like she’s maybe from the Caribbean - lets the air out of the ‘protest’ tires of some virtue signalers in front of the White House.

This is a 4 Seasons song. A mere B-side. The Tremeloes copied it and had a hit 3 years later.

Still, it can be violently (though not silently) spray painted onto a wall or other surface as a form of artistic expression, without permission and within public view, to mark territory or to serve as an indicator of gang-related activities:

I am not sure that Executions have to be pre-planned. I think I can still execute someone "on the spot." Pre-meditated means pre-planned and does not require execution to be assumed.

As for Althouse, I don't recall whether she said Floyd was executed. If so, I think it might be an early reaction to what seemed like a deliberate desire by the officers to kill Floyd. If so, hopefully, she has stepped back from that position and will wait for all the evidence which is generally how she applies her mind to such things.
