He might get off, but I think the trial is already being tried publicly, and Weinstein is going to lose in court because he has already lost in the public.

What I find CHILLING is my original perception that this story was about Donald Trump - depressingly symbolic of today’s culture of elite impunity.

In all kinds of ways, of course, Trump himself demonstrates how deeply the culture of impunity has penetrated the GOP. We’ve seen bottomless self dealing and a refusal to show basic transparency on his business holdings; extensive and potentially criminal efforts to derail the Russia investigation; the refusal to hold the Saudis accountable for the dismembering of Jamal Khashoggi; maximal resistance to any and all congressional oversight; the turning loose of Attorney General William Barr on his political critics; Acosta’s potential survival; and so much more — much of it with nary a peep from Republicans.

He has done it often enough in the past. If he can get an Academy Award for The English Patient, how hard can it be to get an acquittal. Still, I don't think he understands that a NY jury pool is nowhere near as stupid as the voting members of the Academy.....Maybe he can cop a plea with Cyrus Vance. It worked for Jussie Smollett.

Let’s be honest... the women accusing Weinstein would never have said a word if they’d gotten the part.

I know, I know... saying such a thing sounds terrible and cruel, but someone needs to say it.

Sure, Harvey Weinstein is the prototypical creep. But he’s a rich, powerful creep. Which puts him in play.

Is it an abuse of economic power? You’re damn right it might be, and likely is. But these actresses attempted to exert their sexual power in exchange (or over him) to get the result they wanted. This case is a primordial contest. Homo sapiens has sex in private, no matter what the nutjobs at Burning Man say. These Weinstein encounters happened to be private. He said, she said.

I know it’s wicked and awful to say, but these adult women have to have been too stupid, or the man too evil. The results are inconclusive, though perhaps not to an NYC jury. But try this case in Kasper, Missouri, and you might get a different result. Fortunately, the Constitution and most state and municipal law says a jury of one’s peers.

We shall see. There are two sides to every story, no what the media victim narrative may be. Unfortunate things happen in life.

That doesn't excuse Weinstein.

It needn’t excuse her, either.

Unless proven beyond a reasonable doubt by a jury of one’s peers, it should not deprive a man of his freedom. That’s what we call justice. Unless it’s a self-defense trial in Ohio.

I don’t know for sure, but a corollary might go something like this: “How many actresses appear on the big screen because of their performance on the casting couch?”

Both questions are impossible to answer.

But the probabilities of both being true are probably quite high, given the stakes involved and the desires on both sides. Wouldn’t you think?

I think he knows he'll be found guilty so he's trying to do the trial in a way that links to a larger cause while his lawyer is trying to win on legal issues or at least, keep the sentencing down. If HW gets his way he can make a movie "The Sentencing" with flashbacks showing how his lawyers muffed all their opportunities, not realizing he was a martyr but just trying to get him off on most charges. At the end he shouts "I shall return" while in the background Alison Krause sings "O Brother." This, then, followed by "Harvey Weinstein in Folsom Prison." "Harvey and the Half Way House". "The Return of Harvey Weinstein." He and Roman Polanski get a Lifetime Achievement Award at the Academy Awards. Or, they are getting it when a maddened horde of women break through police lines and charge the stage, throwing cream pies. Harvey slips and falls into a heap of pies. You see a hand rise above the meringue holding the Motion Picture Academy Award statue. "Lifetime Achievement" is clear on the screen, then dips, and then ... fade out. But, controversially, it does not say THE END.

Weinstein's initial strategy was to distract from the allegations by trying to "take down the NRA and President Trump." That normally works for charlatans like Clinton and Biden. Weinstein's acts were way beyond that but give him credit -- he was prescient in making sexual assault accusation against him about the NRA and Trump. Now it happens every night in the media. Cough, Jeffrey Esptein, cough.

He still thinks he will walk if he just makes the right story.

Granted I haven't been following this case that closely, but I would guess that a halfway decent lawyer could get an acquittal. Weinstein is undoubtedly a scumbag and was protected by all kinds of powerful, self-important people. But in all honesty, I have a difficult time mustering a great deal of sympathy for people who went along to get along. I have encountered innumerable victims of sexual abuse in the course of my career (some as young as infants), and I don't recall a single one ever getting rich and famous as a result.
